On June 2, 2022, BBB requested Dubby to modify, substantiate or discontinue claims made on their website (https://www.dubby.gg/) that read, "America's Tastiest Gaming Energy Drink of 2022", On the "FAQs" page, it reads: "DUBBY is produced in the United States of America..";"DUBBY is produced in the USA.."; "Unlike other energy drinks in our category, we pride ourselves on actually developing a clean energy formula that is free from fillers, maltodextrin, and artificial colorings.", Additionally, under the "Shop Now" link at the top of the homepage, it reads: "DUBBY allows you to have faster reaction time paired with laser sharp focus. If you want to start winning more - we made this for you. Our Premium Gaming Energy Drink". Advertisers must be prepared to substantiate such claims per BBB's Code of Advertising.
BBB's Code of Advertising Section 1 states, the primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB. Additionally, BBB Code of Advertising 28 states, superlative statements in advertisements about the tangible qualities and performance values of a product or service are objective claims for which the advertiser must possess substantiation as they can be based upon accepted standards or tests. As statements of fact, such claims, like “#1 in new car sales in the city,” can be proved or disproved. Additionally, BBB Code of Advertising Section 34 states, Claims relating to performance, energy savings, safety, efficacy or results for a product or service should be based on recent and competent testing or other objective data. Additionally, BBB Code of Advertising Section 37 states, “Made in USA” and similar terms used to describe the origin of a product must be truthful and substantiated. Advertisers can refer to products that are manufactured with foreign components as “Assembled in USA,” if the product's principal assembly and last substantial transformation was completed in the U.S.
