Ad Review

On February 16, 2023, as part of an industry-wide review of CBD businesses in our service area, Better Business Bureau contacted Haleigh’s Hope Inc. concerning the following advertising claims found on their website, https://haleighshope.com/:  

- "Haleigh's Hope® was created from a proprietary genetic plant strain that was carefully bred and cultivated over seven years to achieve a precise combination of clinically proven, therapeutic plant compounds." 

- "This organically grown, whole plant extract contains a full spectrum of naturally occurring plant-based compounds that are clinically proven to provide a powerful combination of antioxidants and neuroprotectants." 

- "Revitalize, rejuvenate and restore your skin with a powerful antioxidant derived from natural whole plant sources. Our lotion designed for all skin types goes on smooth and combines moisturizing ingredients with the antioxidant effects of cannabidiol."

- "Revitalize, rejuvenate and restore your skin with a powerful antioxidant derived from natural whole plant sources. Our lotion designed for all skin types goes on smooth and combines moisturizing ingredients with the antioxidant and anti-inflammatory effects of cannabidiol." 

- "All of our products can be ordered online and shipped to all 50 states and many countries." Since CBD is considered a drug under federal law, CBD products cannot be shipped across state lines. 

- "At Haleigh’s Hope we know first-hand that CBD can improve health..." 

- "CBD is a non-psychoactive cannabinoid that has been shown to provide numerous therapeutic benefits without causing the high that users typically associate with cannabis."

- "Patient and physician education is provided by the Flowering H.O.P.E Foundation and can be obtained by visiting FloweringHope.co or by calling (719) 368-7963."

- "HALEIGH’S HOPE® HAS NOT BEEN FDA APPROVED AS A CURE OR TREATMENT FOR ANY DISEASE. THEREFORE, WE DO NOT MAKE OR SUPPORT ANY MEDICAL CLAIMS RELATED TO THIS PRODUCT" - This type of disclaimer is to be used with food supplements. CBD is not considered a food supplement. Advertisers should stay away from using disclaimers that negate claims made throughout their websites.

- Education\Blog page contains multiple unsubstantiated health claims.

- Testimonials. - The business website is displaying testimonials that include numerous unsubstantiated health claims.

- Endorsements. The business website is displaying the FDA seal and NBC, ABC, HBO, and Nat Geo logos. - BBB could not locate information regarding a partnership or articles about this product on the company's website.  

BBB requested that the business review its advertising and provide substantiation based on reliable, recent, competent testing for each of the health claims made and to discontinue any advertising that is in violation of FDA and FTC mandates for this industry.

Despite written requests, as of March 3, 2023, Haleigh’s Hope Inc. has not responded to BBB’s request for revisions and clarification in its advertising.

Advertisements should be truthful, sincere offers to sell. Advertisers have a responsibility to have substantiation for all claims made and should be able to provide that substantiation upon request. All advertising that may mislead or deceive consumers should be avoided. 

Claims relating to performance and results should be backed up by reliable evidence.

Advertisers should ensure that testimonials and endorsements are not misleading and represent the current opinion of the endorser. A consumer endorser’s experience should reflect what users generally achieve unless there is a clear and conspicuous disclosure of what the expected results will be. Advertisers should not include claims in testimonials that they themselves cannot make and support.
