North Dakota Attorney General Action

On November 14, 2022,  the North Dakota Attorney General's motion and request for a Summary Judgment against the business and its owner, was granted by the Stutsman County District Court.  The business owner,  David Hansen failed to respond to the Motion for Summary Judgment.  

The Judgment settles allegations that the business is in violation of consumer fraud law and NDCC 51-15-02, including soliciting advance payments from consumers and then failing to provide the products and services promised. The Judgment states the business, its owner, agents and employees are permanently restrained from directly or indirectly, making false statements, false promises or misrepresentations in connection with the advertisement or sale of general contracting, home improvements, repairs or services, including elevator servicing and repair.  In addition, the business and its owner are permanently restrained from offering sales of contracting, home improvement, repairs or services including elevator servicing and repairs.    The business and its owner have judgments totaling $27,495.15 and $1,452.00 for investigations costs.

North Dakota Attorney General Judgment

On November 16, 2021,  the business received a Summary Judgment filed by the North Dakota Attorney General. The Judgment settles allegations that the business violated North Dakota Century Code 51-15-02 by engaging in deceptive practices by soliciting large advance payments from consumers and using the funds for personal use, falsely representing the business as an limited liability company and falsely claiming liability insurance. Under terms of the judgment, the business is permanently restrained from making false statements, false promises or misrepresentations and advertising the sale of contracting, home improvements, repairs or services and permanently restrained from engaging in the sales of contracting and home improvements, repairs or services, including elevator servicing and repair.  In the future, the business may apply to the North Dakota Attorney General and the Court to lift the permanent injunction, if the Court finds the business has paid full restitution to all consumers who have paid for but not received services or merchandise not delivered in North Dakota, paid all fines and fees to the State of North Dakota. The amounts owed total $104,128.92 in restitution and $6,332.00 in fines and fees.    For more details go to the below link.

On November 9, 2022, Mr. Hansen was found to be in Contempt of Court and an Order of Contempt was held based on the November 16, 2021 Judgment. The Order requires Mr. Hansen to make payments of $1,000.00 per month starting in January, 2023 until he has fully satisfied the restitution of $104,128.92.   For more details on the action go to this link.
