CareMaster is threatening me with a lien against my house because they have not completed the work done on my house. They broke my counter top and refuse to fix it. I have refuse to pay the for an unfinished job. Why would I pay for a job that you did not complete. I have been harassed by CareMaster to pay them for a job unfinished.

All work was completed at the homeowners address back in March 2023.  We sent our final invoice in the amount of $3,452.57 to the homeowner at that time for work that we completed and was approved by her insurance carrier. The homeowner also signed a Certificate of Satisfaction on 3/24/2023 accepting our work and did notate her dissatisfaction with the countertops.  The original scope of work that was approved did not include replacement of the countertops but to only remove and reset them, in which we did. We acknowledged that the countertops may have been damaged when the tops were reset and we have made several attempts to rectify the situation by having them replaced as a warranty item. Since the countertops were never part of the claim, we are not charging to replace them, and the cost is not reflected in the amount that is owed. We would be happy to arrange an installation date once the homeowners balance is paid in full.CareMaster is not harassing the homeowner but trying to get paid for services that we provided. We fully intend to warranty our workmanship regarding the countertops but cannot warranty something on a job that we have not been fully paid for.

I am rejecting this response because: ****** agreed that it was your companys fault. I have documents from me insurance that he agreed to replace the countertop.  My insurance company was called on this matter.  No, it might not have been part of the contract however your workers damage my property. Yes, your workers was notified of my countertop was damaged by your employees. I have text messages that was sent to him with pictures alone with unfinished trimming.  All this was related to ****** and the insurance agent. She spoke with him and agreed that it was your employees fault and it would be repaired correctly. Plus the person he sent over to measure my countertop stated that your company was paying to have my countertop replaced.
I am being harassed and threat about this matter.

    Sincerely,

    Hello,

As we have stated before we acknowledge that we may have damaged your countertops and have agreed to replace them as a workmanship warranty issue. We also understand that your insurance adjuster is well informed as we have communicated this to them as well. Our company needs to be paid for the services rendered that did not include replacement of the countertops. This cost of the countertop replacement will be incurred by CareMaster and was never reflected on the amounts that you owe. Your last invoice that you owe us for reflects only to reset the countertops which we did several months ago. We cannot honor a warranty for a job that we have not been paid for in full and have been trying to collect on for months now. This is not harassment but only a standard business practice. Again, we are more than willing to install the countertops once your account has been paid. Please let us know how you would like to proceed.
