August 22, 2023 1200pm I started using Zonatletica to train my clients for personal training. On the day of the 8/22/23 I was approached by ******* owners sister regarding my clients not paying the drop in fee, I replied which one isn’t paying, she pointed to one that I knew has paid, and then ******* approached so I acknowledged ******* since he’s the one in charge, I told him the lady in question has paid and his sister stood their shaking her head. So we talked about ways to track the process of paying and agreed. The next day on the 22nd ******* said he needed to speak with me after I saw my clients. I entered his office asking what’s up, he replied he didn’t like my energy and he didn’t want me there anymore and didn’t like the way I talked to his sister the previous day, he didn’t like my tone and said I don’t need to get defensive and I replied I was going off his demeanor towards me, his response it’s my business I can talk how I want. I replied so your a hypocrite so you can be defensive but don’t want it in return. He showed me a spreadsheet of my clients who hasent paid, I asked for my copy of my contract and all paperwork he refused to give me a copy of the clinets he said hasent paid and contract I signed using his facility. He wanted his blue door entry key back, I relied when I get a copy of my contract and refund for termination of my contract for self personal reason of not liking my energy. I signed a contract to use his facility I am not a paid employee of Zonatletica and he terminated contract without a valid reason.

On August 8th, I open the door to my gym to Mr. *******, giving him the opportunity to work with his clients at my location. We signed a month-to-month contract. Every month he will have to cover $200 fee to be able to bring his clients at my gym. Also, his clients will have to pay a $5 drop-in fee every time they will come and use the facility or pay a $35 monthly membership fee.
When we signed the contract, I asked him for a copy of his personal trainer certification and a list of his clients. He never provided me with proper documentation or any information of his clients.
On August 21st, my sister approached him and ask him to clarify the list that my employee created based on his attendance, with the client’s list he supposed to provide. When my sister asked him to sit down with her to clarify, He was rude and started raising his voice at her in the middle of the gym during rush hour. I approached and I told him that we needed to talk about this on my office and not on the middle of the gym with all clients around, making clients uncomfortable with the tone of his voice.
On August 22nd, I have decided to terminate his contract, due to his lack of communication, lack of professionalism as a personal trainer, mistreatment to myself, to one of my staff members, plus he never provided proper client’s information or certification that validates him as a Fitness Professional.
Even before he walked out the door and after he insulted me, I tried to fix the problem personally at my office, he refused to sit and solve the problem.
I have been on business for more than ten years now, and I will not tolerate at my gym any type of mistreatment to any other trainers, staff, or clients. My gym is well known for being a family-oriented gym, we treat each other with respect and Mr. ******* refused to follow my rules stated in the contract he signed.

    Sincerely,
    ******* ******** ***** ********

    Complaint: ********

I am rejecting this response because: Everything in his response is a lie and not once was I asked for my certification, or asked to go to his office . Nor was anything about certification or client list in the contract we signed which still haven’t been given to me. As for me giving him my client list is invalid and invasion of my clients privacy, my clients are my responsibility when in my care that’s why i carry my carts for training, first-aid, its HIPPA violation to give him any other medical information without their consent. As for the floor incident I have a witness who can give their comment of the encounter, and he has plenty of surveillance cameras that recorded the event. As for lack of communication i don’t report to ******* I am not an employee of his r the gym, if he has been in business for over 10 year as then he should know that you need to give a copy of the contracts between the parties. At this point his response contradicts to everything that happened and misleading to actual events and wants to damage my character and have clients that can conform my actions while in the gym and towards him at any given time while in the establishment. He has plenty of cameras that will tell the truth and the contract he avoids to still give to me. I am a Veteran and will not be treated with disrespect because of someone having their feelings hurt and acting childish instead of handling the situation like a grown man and lying about the incident. I have a witness of the incident and his cameras, at this point he breached the contract for unjust reasons.

    Regards,

    ****** *******
