July 14, 2022 at 10:53 am, I talked to ******* ********, from Laneway Enterprises, about getting some pressure treated lumber from the company. She told me to contact ******, as he was the foreman (with 50 years experience, is posted on the internet). I called ****** at ************. I told him that I wanted pressure treated lumber but no garbage. He showed up Wednesday afternoon. My neighbour, ***** *******, ****** and myself unloaded the truck. I am not a carpenter and neither is *****. I did not know a bad piece of lumber until the contractors showed me the bad ones, and a lot of them at that. ******* ******** told me that I must have the company mixed up, which was a lie. She also tole me she is not associated with the company, but she has runs ******* ******* ******* *** ****, ** *** **** ********. I told ****** *** ******* that I am a senior, that we saved for 2 years for this deck, I have not worked since last year, my wife just started working at a daycare, we have no income but the babybonus, we have 3 young children of 12 to 3 yrs old. But they do not care. He did not want to give me a receipt, for the lumber. The contractors showed up on Friday, and the 2x10x14 joists- most of the ends had to be cut as they were split. Some were so bad, they can not be used for any building material. Some were split right down the middle.....Structurally unsound......illegal to use, unsafe. The 2x4x12s.......70% were so bad, they cannot be used. All of the bad ones should not have been sold. Some were not even pressured treated, ****** lied and tried to tell me they were sunfaded. He said he was not taking any back. I have 5 witnesses who will testify that the lumber is no good. If this goes to court, he will be paying for 2 contractors to take time off, as well as the of us to appear, I am charging him for storage for a week, and more after that, If I have to dispose of them to the dump, ****** will be paying.

    Business response

    25/10/2022

*** ******* made a lumber order of 34 pieces of 2x10x14 and 140 pieces of 2x4 that was delivered by the company foreman to his residence on Wednesday October 19, 2022. *** ******* and his neighbour ***** were present at time of delivery.

On Friday October 21 *** ******* texted the company foreman that some of the 2x10 boards were not good. The foreman responded to *** ******* to go ahead and use up all of the good boards and then the company would replace however many boards were left that he was unhappy with. On the evening of October 21 *** ******* texted the company foreman again to inform him that he was unhappy with the 2x4 boards as well.  The foreman responded again that the company would replace any bad boards.

On Sunday October 23 the company foreman went to *** *******’s residence to personally see the boards that *** ******* was unhappy with. At this time *** ******* told the company foreman that he did not actually want to use any of the 2x4. The company foreman offered again to replace any boards that *** ******* was unhappy with.

On the morning of Monday October 24, the company foreman texted *** ******* that  he could keep the 2x4 at no charge as the company would refund the full price of the 2x4 which totalled $1120. The refund would be done that day and could be sent by either e-transfer for a delivered money order, whichever *** ******* preferred. It would be accompanied by a receipt that would read $1706 paid for 2x10x14, and 140 pieces of 2x4 at no charge. *** ******* responded to this with the following text “I will talk to a lawyer and county first”.

The next morning, Tuesday October 25 we were still waiting to hear back from *** ******* for further instruction on how we could facilitate his refund and resolve this situation when we received this BBB inquiry in our email.

Our thought process with *** ******* keeping the 2x4 at no charge was intended as a  kind gesture as *** ******* had expressed experiencing some family hardships. He had mentioned to the company foreman that he intended to build a large shed and we thought perhaps he could use some or all of it for that project. However if he prefers for us to pick up the 2x4 we are more than happy to do that as well.

It is of the utmost importance to the Company to resolve this issue with *** ******* in a timely manner. However we do need him continue communicating with us so we can finalize an amicable resolution and issue his refund and pick up the 2x4 boards if he does not wish to keep them at no charge.  If he prefers we resolve through his lawyer we can do that too but would need the contact information for the lawyer in that case. We welcome any suggestions and assistance the BBB can offer for how to proceed with this resolution.

    Complaint: 18303063

I am rejecting this response because:

    Sincerely,

    *** *******

*** ******* made a lumber order of 34 pieces of 2x10x14 and 140 pieces of 2x4 that was delivered by the company foreman to his residence on Wednesday October 19, 2022. *** ******* and his neighbour ***** were present at time of delivery.
First of all, let's look at the lies.
Lie# 1........it was 33 pieces of 2x10x14.....and not 33 Most, if not all (I can ask the contractors about which one) were cracked at the end.  We had to cut some of the ends off in order to safe time and money. Some had mold on them, some were split down the middle, some were warped and twisted.
    Structurally unsound. Unsafe to use.

    Lie# 2- it was 92 pieces of 2x4x12, and not 140 pieces.
One of the contractors sorted out the bad ones. 80% of them were split down the middle, rotted, mold, twisted and/ or warped. 5 people will testify to this.
Some were not even treated. ****** lied (lie # 3) and tried to tell me it was sun-faded on one side. They were not treated on all 4 sides.
But ****** has told me it was from a fresh load (lie #4). It cannot be from a fresh load if it was sun-faded. But there are 5 that will call him out on this.

On Friday October 21 *** ******* texted the company foreman that some of the 2x10 boards were not good. The foreman responded to *** ******* to go ahead and use up all of the good boards and then the company would replace however many boards were left that he was unhappy with.

****** **** ******* *********** texted me......"I don't mind replacing a few boards but they were fine when we carried them all into your backyard" which I told him that it was him that loaded the boards onto the truck.......the centre cracked one, moldy ones, warped and twisted one. I told him that I am not a carpenter and thought that I could trust him.

Also, ****** said, "I won't be taking all of them back".

On the evening of October 21 *** ******* texted the company foreman again to inform him that he was unhappy with the 2x4 boards as well.  The foreman responded again that the company would replace any bad boards.

Lie #5. This is another lie. ****** did not reply to me on Friday Oct 21. Nor did he text me on Saturday, Oct 22.

****** from ******* *********** showed up on Sunday Oct 23. He PROMISED that he was going to text me first. Lie #6

Lie #7, on Sunday Oct 23, ****** did not offer to replace any boards. All he was interested in trying to prove to me that the boards were 'sun-faded'. 5 people will testify in court.
He was not interested in looking at the split down the middle boards, nor the moldy ones, nor the ones that were warped and twisted.
He told me that he was not going to take any back that day.

I told him that I would go to the RCMP. He told me to go ahead, that they would not do anything anyway. So he has been involved with the police for the same thing.
But he is committing fraud- for selling something that is not true- structurally unsound  lumber. ******* ** ******* *****

Lie #8, it was not the company foreman that texted me, it was ******* ******** that texted me, even though she told (lie #9) the night before, and blocked me from her messenger as well as the company's FB page.
The total of the 2x4s is not $1120 (lie #10) but $1200.
The price for the 2X10s was $1551 and not $1706 (lie #11).

******* also texted me that "All of our customers are more than satisfied", unless they are not getting the bad lumber that I have received, or is a lie, also.

The next morning, Tuesday October 25 we were still waiting to hear back from *** ******* for further instruction on how we could facilitate his refund and resolve this situation when we received this BBB inquiry in our email.

I have sought legal advice, an inspector who will determine that the wood should not have been sold to the public. Companies such as ******* *********** should not be ripping people off- even seniors, low income nor families with children. That is probably why they have went out of business with R & H Mobile Home Service Ltd.

And the 2x4s and the bad 2x10s will cost me take to the dump. It will cost $14.50 for 100 kg( $0.31 per lb) at the dump. Home Hardware tells me 92 boards weighs 1518 lbs X $470.58. As my truck is small, it would take 4 trips to the dump.

I do not like being taken advantage of, nor lied to by ******, ******* ******** nor by ******* ***********/ Purpose Driven.
I have also sought advice from ptw-safetyinfo.ca.

I have requested my money back, $30 a day storage, $100 for moving the lumber out of the way, and the cost of taking the garbage to the dump.
