    I am the president of **************. The strata is a 15 unit ,over 55 strata building.Nixson painting of **************************** provided quote ********* and awarded contract to paint exterior in summer of 2021. *** Nixson owner of company requested deposit ********. Deposit paid. Emails, texts, phone conversations started in 2021 and continue to today. Excuses documented. This year the strata decided to request our deposit be refunded. I am getting more delays, waiting for other cheques to clear from others, had to pay ****** to government for ***, waiting for bank to increase line of credit. I have lots of documentation to go into detail of our good faith this job would be done and our patience.

    I don't dispute 90% of what ****** has said. I like ****** and have been open and honest with him from day 1. Alot of unforseen circumstances: weather/ health and financial issues have happened. I promised ****** days ago that by end of next week Nov 1st that the deposit would be sent. Approval from our bank has taken longer than expected. The circumstances that have happened have been unexpected and my apologies to both ****** and the Strata.

    On Aug 15 2022 I pre-paid $2115.00 to *** ********************** of Nixson Painting & Renovations in *************************** ** to paint my house. In Dec 2023 *** re-funded me $500.00 for his tardiness for not getting the job done quicker. It is now Sept 22 2023 over a year later and the painting is still not done. I have phoned him many times and emailed him to return the remainder of my money ($1615.00) to get someone else to paint my house. He has ignored me completely. I finally have turned to the Better Business Bureau for their assistance in resolving this matter.

    It is correct that *** did hire ** at end of August and I dud say would try to get done before weather turned. Got place pressure washed and the weather did turn as we were finishing couple other jobs. I went to *** and told him don't recommend trying until next year. He agreed ***** gave him  refund of $500 because I felt bad. Not  tardiness as he knew we were finishing other work. This year has not been great year for weather with either rain or heat. Plus torn rotator cuff and broken ribs it would be my son to try and get done. *** could have at anytime asked for a refund. But instead while I was working out of town he gave me ultimatum and we had already washed building again and he asked to be done by end of Sept by email to me which I had agreed but he decide to send this to BBB. I like *** and sorry he couldn't wait till allotted time cause it wouldn't have been completed. I have returned $ in full and even the 2 gallons of paint that were purchased for his place. I do apologize *******
