On June 18, 2024, around noon, I parked my car at the parking lot, which doesn't look like a commercial/private property. Since the parking lot was right adjacent to a public park, belonging to the City of *********, I thought it was part of **************, because there was no visible sign of the private property at the entrance. The towing business sign that I noticed was attached closely to the condo building that was adjacent to the parking lot. I think this could lead to misrepresentation in the eyes of the public. As soon as I came back to the parking lot, I noticed that my car was removed and then I realized that the property was private property, It was not easy to find the parking warning sign because the signs were all invisible. One was hidden by the ****, and the other 2nd, 3rd sign had been blocked by the big car and the dumpster bins. Most importantly, I found out that towing the cars at the subjective property, violating the bylaw. According to the City of Coquitlam Bylaw No. 4540, 2015, Section 16.7, there should be the signage on that property indicating the name and contact information of the tow business, but was not placed. If the towing company was a hired agent to tow at the site, they should notify to the management company to maintain the parking site to be more clearly visible of the private parking site to the public. I have reported this incident to City of *********. If I don't get it the full refund, I will go to CRT. Before filing on CRT, I would like to give it shot, if it can be resolved in here for the refund part. There is another concern about the excessive charge, but I don't want to bring it up here. Anyway, I would like to request the full refund, and the property management must put on some visible sign of the private commercial property at entrance and add the towing business contact under the towing warning.Business response

Hello,
As you mentioned, the car was parked on a private property against the parking rules and regulations which is posted on the signs. It is only the responsibility of the driver of the car to look for the parking signs where ever the car is being parked. The towing company's signs including the name and contact of the towing company is just a few feet away from where you were parked as you can see in one of the pictures you have attached. Unfortunately the impound cost and expenses are not refundable, you had violated parking regulations in a private property and your vehicle got impounded for that. To prevent such an unpleasant experience in the future we strongly recommend you to look for the parking signs where you are parking and avoid taking any chances if you are not sure.

I am rejecting this response. We are talking about the the same sign, aren't we? Nice, please refer to the other photo showing the exact location of YOUR BUSINESS SIGN. Of course, I saw it, but any reasonable person expected that business sign was referring to the commercial private parking site where my car was towed. Please look at the wall of the parking lot, can you see the sign????Sure, after my car towed and when I tried SO HARD TO LOOK FOR THE SIGN, and finally ah ha! Is this HIDE AND SEE, PEEKABOO or what? Now I feel that I am a victim of the predatory towing company doing deceptive business practice with the ambiguous notice of the signage. See you at CRT!

Please understand that we are not setting parking rules and regulations. We are the towing company under contract with the property. As you know the parking lot where you parked your vehicle is a reserved parking lot located at the rear side of a private commercial property. There are signs informing the regulation. Unfortunately the impound cost and expenses are not refundable. I am rejecting this response because:On the other morning I went to the parking lot to see if there were cars parked without the pass. Yes, there were actually few cars. Few minutes later, I witnessed the Benjamins towing truck present at the parking lot. Wow! It was like a spider was waiting and watching faraway to prey the victims to eat on the spider web. The predatory towing, that i just have witnessed. Since you mentioned that your company was just told to tow, that means your company has a contractual relationship with your client who is relying on your professional knowledge of any law, rule and bylaw on towing and legal towing services. Your client must expect you to properly advise them to comply all the law, rule, bylaw to tow legally from their private property. Instead of advising them, you let your client to neglect and have extensively continuing making profit in your clients property.
If I go to CRT, I will have to involve your client and your company at the same time. Your client obviously didnt comply the signage bylaw for towing, and your company has been practicing deceptive business. I will also considering other legal action as well.

Dear Khurban,
Unfortunately, we cannot provide you with a refund as you had violated parking regulation in the private property by parking your car in a reserved parking spot.
The parking lot is full of signs and the parking spots are freshly painted and marked. it is only your responsibility to follow the parking rules and regulation.
We would recommend you to pay more attention to the parking signs where you park your vehicle to prevent such an experience in the future.

According to the client, he parked his car and left to get a drink he did not come in for a parking pass until well past 8AM.
As mentioned to the client many times, all visitors are required to have a parking pass from the College and the College does not surveillance or control the parking lot area.

On 16th May 2023 I parked in the visitor parking of a residential building that contracts Benjamin towing. I obtained a digital parking pass that expired at midnight. Rules posted state you cannot park beyond midnight in visitor parking and the digital pass cannot be extended.There was a widespread power outage across ********* and ******* beginning around 11pm. I went down to remove my vehicle before midnight. The parkade gates would not open as there was no power. Several vehicles were left in the visitor parking; some had notes on them asking not to be towed.I went to sleep and power came back on at some time in the early hours. At 6am on next morning I went to get my car and it had been towed. No other vehicles had been towed.The Benjamin Towing signs on the wall of the parkade post the INCORRECT ADDRESS for the lot. They state ******************. No hours are given for the impound lot.I paid for an Uber to the address. It is an empty lot. I then had to walk to the correct location for Benjamin towing, only to find it does not open until 8am. Their phones are also not answered until 8am.Complaints:[1] I expect to be re-imbursed for my Uber ride to the incorrect address provided by the company on their signage.[2] I expect to be re-imbursed for my time waiting from 630am - 0800am (this is valued at >$300) - since no indication of anything less than 24 hour opening were provided on the signage. If you're going to tow a vehicle, you should make it available for retrieval at all hours. You can perform the duties in your contract with the strata organization, but you must not unduly cost people their time [3] Show some decency - towing a car that could not be moved due to a power outage outside the control of the vehicle owner, who was otherwise complying with posted rules. There is no way you weren't aware of the power outage. I suspect you took this situation as an opportunity to entrap unsuspecting victims.Business response

Benjamin Towing is the towing service provider fro the property. Benjamin Towing is not responsible for the power outage and has no control over it. We have been given straight forward instruction by the strata and we are doing our job accordingly. On our website there is a "vehicle lookup" section, you could search your vehicle's license plate number or VIN number on our website to located your vehicle and get all the required information including the impound hours and other ways of communications. Releasing vehicles out of lot working hours is possible and requires booking in advance. 24 Hours is regarding to road side and towing services, not office hours.

I was at the A&W on the evening/early morning of Saturday October 15, 2023 and had pulled out of drive-thru with food purchased. I had pulled out of drive-thru and did ******************************************************************* this area. Due to the sharp turn my car pulled into stall within lines but diagonolly. While I was eating a police cruiser that had also been in drive-thru a few cars behind pulled out and decided to do a sobriety check which I passed but was detained for an unrelated matter. I was informed my car would be towed upon being arrested. I was removed from the scene by one officer while two officers remained behind I assumed to await the tow truck. I was held at ********* **** cells for few days where I was moved to another facility for several weeks. I attempted to contact to locate my car from the institution I was being held at and was unsuccessful due to the businesses needing to accept call from corrections. I was released from custody on Friday November 17, 2023. I started phoning around to try to locate my car on Sunday November 19, 2023. ********* Towing that has the tow contract with ********* **** and with Impark at **************** was my first call which was unsuccessful as they didn't have any record of my car. I then phoned the ********* **** and spoke to the receptionist about the location or company that they had used to tow my car. She retrieved the file and informed me there was no record of my car being towed. So I phoned back ********* Towing for assistance in locating car which they gave me names of few other tow companies with storage lots. I phoned them and was told there was no record of my car by all of them. So I phoned ICBC and ********* **** and reported it stolen. I had also phoned the A&W to see if they were aware of location of my car and they weren't and said they didn't recall having it towed. I then left it for a few weeks as I had many other things to sort due to my absence for almost 5 weeks. During this time I broke my phone and needed it replaced with new number. I did an interview with ICBC Monday December 11, 2023 regarding the details of the theft of my vehicle. At the end of the interview ICBC informed me my car was never put in the stolen car database and to follow up with the ***** So I did and was then informed that my car had been towed to Benjamin Towing in Port ********* which is one of the tow companies I had previously contacted in mid November. I contacted them again after being given this information where I was informed the car was there and had been towed from Pinetree Village on October 18, 2023 due to parking violation and that the bill is now $3000. I don't have that much money to retrieve it. I had money to retrieve it the month previous when trying to track it down but had been told it wasn't in their possession when it was and had been for a month. I never received any mail or paperwork informing me of impound. I was in custody at ********* **** for few days and was never informed that they had chosen not to tow my car and rather abandon it or I would have arranged to have it removed. I was never given the opportunity to have it sorted. I never intentionally abandoned my car I was mislead and misinformed by not only the **** but also the tow yard. I have clothes, tools, work items and personal possessions in car and the car has sentimental meaning to me. I'm looking for a reasonable solution to regaining possession of my car and possesions. I arrived and parked my car at 10:51 am today - proof is in the **** as the temporary building manager, who I'm sure is in on this, showed me the video footage while denying that it was her who had reported my vehicle. I spent a couple of minutes trying to get the Parking Pass registered. Due to limited reception in the underground parking, I was unable access the website. I left to go upstairs at 10:53 where I could get reception to register my car. At 10:55, the **** shows the towing company entering the underground parking to tow my car, and then leaving by 10:58 with my car. Within TWO MINUTES of walking away from my vehicle to get reception so that I could register my car with a parking pass, someone had reported my vehicle and towed it away. I have to work a full day to earn enough money to pay off what you charged me...and for what?! A mere few minutes of not having registered my car due to insufficient reception underground. How efficient your team was at earning $234.99! So while you happily take that money from me, and certainly from countless others before, now I have to figure out how I'm going to balance my budget during an already challenging time. How unfortunate it is that anyone would make it their mission to profit from situations such as these.Business response

The mentioned vehicle was park in a visitor stall of a private property and no visitor parking pass was issued for it when the patroller was there checking the cars. As you mentioned, this property is taking advantage of a digital parking pass system which is provided by a third party and we have no control over it. One of the most important features of a digital parking pass is that you are able to issue your parking pass at anytime even before parking on the spot. It shows on the system that you registered the car at 11:11 o'clock while the parking was checked by a patroller and the car was towed at 10:55. Unfortunately, we cannot do anything about it. I would recommend you to follow the parking rolls and regulations wherever you park your vehicle. Please understand that we are the towing service provider for this strata as well as so many other places within Tricity and our job is to follow the instruction we are given.

The building manager says it's not them who reported it and you guys are saying that you don't tow without having received a complaint. So who is the one responsible for working so efficiently at getting my vehicle towed? And yes, the vehicle was towed at 10:55, again, two minutes after I'd left my vehicle...as if someone was watching and waiting. How is it possible that someone could report me and you guys show up all within TWO MINUTES?! To add to my luck, of 3 elevators, only one of them was available, making it take nearly 10 minutes to finally get to where I wanted for Wi-Fi access. Who knew that by the time I'd finally managed to register my vehicle, it had already been towed 15 minutes prior to that.

We never said "we don't tow without having received a complaint". This towing company is under contract with the Strata Management Company of the building to patrol the parking lot randomly and tow any vehicle which is not registered a visitor parking pass. At the time the patroller was checking the parking lot, you vehicle was parked and was not registered. Again, with a digital parking pass system, you are able to plan ahead and even register your car (issue a visitor parking pass) even prior parking in the spot to avoid the chances. The signs on the parking lot explain everything. Remember, generally, when a parking spot requires a pass or validation or payment, it requires it all the time and at anytime you are parking in the spot. In this case, if you had your car registered before leaving the car in the parking your car was never been towed, yet, you took the chances knowing the parking rules and regulations and left the car without a parking pass.

I had my vehicle towed by said business recently. When they charged me with the fee's it tallied almost $300 dollars. I asked to see a breakdown of the services rendered and was shocked to see so many other built in fee's that were un-necessary. For example, the towing distance was approx. 2KM from where the vehicle was towed to the towing yard, but the charge for a 'fuel charge' was over $40. Also, i was charged an 'overnight fee' but they said my car was charged at 6am and it was ****am when I picked it up. They would not release my vehicle unless i paid the full fee so my vehicle was essentially held ****** unless i paid all the un-necessary charges. Hello,
As you know, the attached bill is related to an impounded vehicle. The vehicle was impounded from a private property due to parking violation. Unfortunately, we cannot offer any price adjustment regarding an impounded vehicles. We went through the bill, all items are valid. Fuel surcharge is %26 of the towing fees. Our overnight shift is 11:00 pm to 7:00 am and any vehicle being impounded within this timeframe are being charged a minimum extra charge of $25.
All impounded vehicles must be paid in full to be released and there is no exception. What other companies are charging for their services is out of our business and what is being charged in another city is not what we can refer to for our pricing.
We are sorry that you had to go through such an experience, we understand how frustrating this might be for you. But, unfortunately, we cannot help you with this case. We would recommend you to follow the parking roles and regulations where you are parking your vehicle so this would never happen to you again.

- "Fuel surcharge is %26 of the towing fees": this is an unreasonable method of calculating a surcharge. Surcharge should be based on amount of kilometers driven, not a flat fee. My car was towed 2km's from the violation incident and to charge over $40 is completly unreasonable and the charge model needs to be adjusted.

On Monday, March 21st at around 4:30 PM, I parked my vehicle in what I thought was a valid parking spot (see photos below.) The parking spot in which I occupied did not have any visible signage or markings on the pavement, and I would argue it is the responsibility of the parking lot owner to maintain proper upkeep in order to prevent confusion that could lead to a reasonable person mistaking the parking spot for a public space. The parking lot in which my vehicle was towed belonged to ********* ******* on **** ***** *** ******** ****. The parking space was bare of any sign, post or markings on the pavement. Because the specific parking spot in which I parked was devoid of any visible marking as you can see from the photos, I would argue that a reasonable person could mistake the parking spot for a valid spot for public use. What is worse, is the manager of whom I spoke dismissed all concerns and claimed that there is no recourse option for consumer to dispute any false charges, unwarranted tows, or damages occured to the consumers vehicle. This invoice of which was given to me outlines fees totalling to $261.24, including "Dollies," admin fees and after hour release fee. This incident occurred in the late afternoon (shortly before 5PM) on a Monday, so any after hour fee should be explained by the company which was not done. The manager refused to go over any details of the invoice and just told me it is "common sense." At the very least, as a Canadian consumer, we should expect a detailed information of the invoice charges and this was not given to me at all. I was told to call back today (Wednesday morning) to speak with a "Manager" who hung up the phone after being asked details of the invoice, in which he responded was "common sense." There was also damage to the passenger side window. Upon bringing this up to the manager, I was directed to call ****. My question of whether or not this would trigger a deductible on my comprehensive coverage was not made clear.Business response

Your vehicle was towed as you had violated the parking regulations. There are signs on the wall of the parking.
The manager explained you everything over the phone on the several phone calls you made in the morning of March 23rd, 2023 while you were absolutely disrespectful.
The manager also explained you that nothing had happened to your vehicle while towing and the towing procedure was done safely and professionally, although, if you believe any damage occurred to your as the result of the towing, you may claim it through ****. This company is fully insured any questions about the claim procedure should be asked from the insurance company.
All the charges explained to you in detail, including the "After Hour Release Fee" for which as the title says, it is for your car being release after working hours. As it is explained to you before, this item is not for your car being towed after hour it is for your car being released after hour.
The manager did not refused to answer any of your questions, the reason he hang up on you was you being rude and aggressive and we do not tolerate this here at Benjamin Towing Corp.

My car got towed on Feb 2rd,2023. I paid unreasonable high towing fee which is $****** for 20mins. I was parking my car on correct reserved parking lot, but they towed my car due to the parking ticket did not displayed on windshield. I went to their company, and found out the parking ticket was felt down to my seat. So I showed the parking ticket to the the company coworker and explained the situation to the worker. However they did not offer any discount on the towing charge. I do understand I should paid some money for my mistake, but ****** is too expensive for the towing!!! Hello,
The spot where you had parked your vehicle is a visitor parking and as the signs says there a parking pass must be displayed. We understand that you may had the pass but as the pass was not displayed on your vehicle at the time your car was park in the spot, your vehicle got impoundment due to "Not showing a valid parking pass". Unfortunately, we are not able to do any discount for the impounded vehicles, and the amount you had to pay is the towing and impoundment charges. The towing costs are part of the charge and there are some additional fees for the impoundment like the storage fee and admin fee on top. Please understand that our coworkers cannot make any personal decisions and the have to follow the instructions. I hope you can find this information helpful and please follow the parking regulations so this could never happen for you again.

I would like to file a complaint regarding one of the drivers who refused to provide his name. On the morning of Thursday, November 25th, 2022 at 4:45 am I moved my car into the visitor parking lot of building located on **** ******* **** as I was leaving for the airport and wanted to load up my car. I forgot to put on the parking pass as I was just going up to get my wife and our luggage and coming back down. By the time we got down which was maybe 5 mins, the driver had hooked up our car already. I explained to him our situation but he refused to listen and forced us to pay $160 to unhook our car. The driver could clearly see our car was wet while every other car in the garage was dry and our luggage. We even showed him our parking pass but he did not seem to care. I feel like they ***** the money from me as I believe the driver could have shown some discretion and human decency.Business response

I understand how frustrating this experience could have been for you but unfortunately, we cannot do anything about it. The parking lot you went in and parked is a visitor parking and as you already know, you need to display a valid parking pass to park your vehicle over there even for 5 minutes. The patrolling are done randomly and the patrollers are not allowed to make any personal decisions. Unfortunately, your car was parked without a pass inside the parking lot while the patroller goes to that place. To avoid this happening again, please make sure you put a valid pass for the place you are parking if it is required.
Due to the type of the business we have, drivers are not supposed share any personal information, though, our commercial trucks could be recognized by the truck number or license plates and totally trackable on our side. Please understand that the tow truck operators are just doing their job based on the instructions they already got from the head office and there is nothing personal.

Nov. 3rd, 2022 *Benjamin Towing load and drop off our car at a ********* *****. *Car L# ****** *Amount paid for dropping car from their tow truck: $154.25. *We think it is too expensive for dropping a car from their truck. *We phone for certain refund reasonably and an open price list. Manager said the charge is based on the type of car, which is not make sense to me as their business liability insurance should cover all type of car, and there are almost no time span for our car at their property. * Also the "no parking" sign is not very clear either, *** *** ***** *** ****** ******* ***** ******* ********* *** *** ********** ** ******* ***** ** ****** *** ********* ** ****** ****. Good morning,
As the manager explained over the phone, your vehicle was ordered to be impounded and a tow truck had been dispatched for this parking violation. As your ***** ***** * was already loaded on the tow truck to be removed and dropped in the impound lot and as you showed up on the scene, you had the option to pay the drop-off fee to release your car on the spot or to go to the impound lot and claim your vehicle in another time. In this case you choose to pay the drop-off fee on the spot which was $154.25 and was cheaper rather claiming it from the impound lot.
Prices could be different depending on the type of the vehicle mostly because of the type of the work and equipment that are needed for different type of vehicles. About your ***** ***** *, the tow operator needs to be trained for electric vehicles and also dollies need to be deployed for the tow.
Regarding the signs we have to say that there are more than 2 dozen signs posted in that plaza. Some of the are big ones in the middle of the parking lot and some around and they are totally legible. For your reference, the attachment is one of the signs which is about 3'x4' posted in the middle of the parking lot, taken randomly. above of all, maintaining the signages are the private properties' responsibility, not the towing company.
We understand how this experience could be frustrating for you, but please understand that if you had followed the parking regulations this could never happen to you. We as the towing company just did our job based on the contract that we have with that place, just like other 600+ locations that we are contracted with. We are not taking advantage, we are just doing our job, although there are some people who are taking advantage of free parking in private properties.
