    Please see attached Word document for detailed complaint. ****** ****** of JNA Transport and Removals trashed my car (driver's door, hinges and front fender) while offloading it from his trailer. He has refused to give his insurance details and will not cooperate. He refuses to let his insurance company repair my car and instead believes it is acceptable to just send me bits from other scrapped cars. From our phone conversations it is obvious that he has been operating without commercial insurance despite claiming that he does have on UShip. Because he declared that he was fully insured I did not accept UShip's insurance and so cannot claim through UShip. I see this as fraudulent activity. Please read all accompanying information and help to stop this man hurting or killing someone else with his irresponsibility.

    I’ve dealt with these assumptions and behaviours outside of here as well. What I’m about to say ******** already knows and this is what he continues to leave out.

    About 2.5 months prior to me heading on the the trip  our semi had a very big failure twice with the same component. The 2.5 months being down were a big hit for our small business especially just coming out of covid etc. 

    I had done my job fully and have never had an accident or incident in all my time of transport. 

    This was the first and the last, when I arrived to pick up the said vehicle for ******** the car was driven around the parking lot for about 10-15 minutes with no issue at all brakes working and everything running as it should. As Mr. ********* had made me aware of prior to picking it up is that it was a running and driveable vehicle that he had planned to restore.
     
    Mr. ********* was aware of this as I spoke with him at the time and was telling him for an auction vehicle how good it ran. In no way shape or form was it road ready without a safety but did run well, as it was driven onto the trailer and stopped without issue. Placed in the very front to protect from any debris and road mess we might encounter on the trip from Edmonton, AB to Halifax, NS.

    The trip back across Canada went without a hiccup, the car was safely brought back to Halifax. Before I could finish taking the car down too Mr. ********* I ended up having a heart attack which put me out for another month.

    At this time until I was cleared I was not able to drive, also at the same time financially from the hit we took we had to unfortunately close our doors.
    Within the time of being back in NS and taking Mr. ********** car too him we completely closed long before the car was delivered.

    I have proof of all documents to back up every single statement made as well. 

    At the time of unloading Mr. ********** car it was the same procedure, start it up and use my spotters to safely take the car off of the trailer. The car did not need to be winched etc, but while backing off the car dies and loses all power. No brakes, nothing.

    Myself and two colleagues put ourselves in the way of this heavy vehicle and were able to stop the car but unfortunately the door did receive some damage. Not a situation anyone caused or could’ve seen coming. A freak accident.

    Right after it happened, I informed Mr. ********* and apologized and we had a plan to figure it out. ******** had been fully aware of the situation and I personally informed him it would be taken care of.

    Not once have I turned Mr. ********* down, and have offered an alternative solution within what I could afford because my insurance etc had already been pulled before the incident.

    I sourced and found the parts at a very reasonable price and all that would have had to be done was to get the parts I sourced painted. Which I also said I would cover. It is all I can offer and the only solution I had with the circumstances, I have proof of this as well. 

    So not once did I deny Mr. ********* but I think a lot of the anger and hate he’s spewing is because I cannot accommodate things the way HE wants them done. 

    As far as fraud etc that’s all a lie, I have emails from other platforms with Mr. ********* saying I’m going to kill someone, I’m using false addresses, and saying I didn’t have insurance when I did. When my company closed doors Mr. ********** car was already in Halifax from Edmonton, Alberta.

    False address: not true, the Irving 24 hour is a truck stop within Dartmouth where multiple companies and owner operators go to park safely park their trucks. As a local driver I also utilize this service.
    Another thing making this claim false is the Mr. ********* was given and invoice from my company which includes the tax number etc and my business address.

    No Insurance: Also false as I did have insurance the whole time Mr. ********** car was in transport and for a during of time while it sat in Halifax. Like I’ve said I had no choice but to close doors due to the financial status and few months prior.

    I’m not going to dive into the other silly things Mr. ********* has said about me as I think it’s pretty juvenile and silly. Yeah be tried to reason with him many times and I just get called names, belittled and false accusations thrown my way. 

    That’s exactly the situation and there’s nothing more, I’m sorry I couldn’t have accommodated Mr. ********* like he wanted but I did have an alternative with the same outcome. Offer always stood and I never once turned away.

    The name calling and accusing isn’t needed and this is way I said it’s now becoming harassment because it’s all I’ve dealt with this entire situation.

    Mr. ********* has my contact and I’m always willing to talk things out and meet on even ground. After reading this maybe he’ll want to do so, but until then this is what happened, this is my offer and I cannot do anymore at the time.

     I am rejecting this response because:  This is the first time he has told me he was going bankrupt, yet he was still happy to accept my contract and take my money.  He accepted a binding contract to deliver my vehicle safely and without damage.  Accepting this contract knowing that he did not have enough money for diesel to deliver my car is also fraudulent.  There is a pattern emerging here.  He told me that he had his heart attack on the Wednesday night, yet he was driving my car off his trailer only four days later while banned from driving.  This is not only irrisponsible but makes him even more liable for the accident as he was in no fit state to be handling my vehicle.  He did not start the car to offload it, just pushed it off with his friends and I have a voice recording of one of the other two people offloading to prove this.  Did he really try and stop such a heavy car 4 days after a major heart attack?  This is the first time he has told me he let his insurance lapse so he really was uninsured when he had the accident, making him personally liable.  Once again, I am asking ****** politely to send me his lapsed insurance details so that my insurance can ascertain the exact date the policy lapsed and coordinate recovery of losses.  His insurance might possibly pay the damages and seek them from ****** in installments making it more affordable for him.  Has he sent you any of the documents he continues to say he has but never sends to me?  His financial problems are really not my concern and what he can or cannot personally afford is irrelevant as we had a business contract.  This mess is completely his fault so why should I have to agree to inadequate repairs because it is all he can afford.  Like I said before proper businesses are insured so they don’t have to offer imaginary, hopeful, desperate plea-deals to clients because they cannot afford to pay for the damages they caused.  At least he has now confirmed that he was using the truck stop as a commercial address.  The address hidden on his invoice is a personal, residential address.  Where are these parts he has supposedly bought being stored?  As with the paperwork I haven’t received any. 
    Once again the only things I want and am asking nicely for are his lapsed insurance details so we can see when the supposed policy was canceled and to pay the bill for the insurance approved quote I have to fix my car.  Scrap parts are not only inappropriate but after purchase, shipping, fixing, painting and fitting would cost more than the shop quote.
    ******, you have already admitted full liability and are responsible for the entire costs of repairing my car.  It was your choice to cancel your insurance, if indeed you did have any, before your contract was fulfilled.  It is completely irrelevant what you can or cannot afford.  Would you go into a car dealership and say you wanted to buy a Ferrari but all you could afford was 5k?  Of course not, or maybe you would.  Be a man, grow a pair and pay up.  If not continue to procrastinate and wait expectantly every day for your court papers to be served.
