On February 18, 2022 I contacted Mustafa T. to do legal basement in my house. I don't know which day, but later in March he came with his business partner Oktay K.. They told me they work together, each of them has different skills. It never looked that they have conflict among them. Once we agreed they would finish end of April orally. They told me it is only 3 weeks job. Since he was my friend's father's friend , I didn't think of making written agreeement. Oktay insisted me send money quickly, because material prices were going high. He wanted to send me asap so he could buy and stores materials. I trusted Mustafa T. and Oktay. I send 10.000 Cad on Mar 24, 2022 and 10.000 cad on March 30 to Oktay K.March 25 2002, I sent 30.000 cad to Mustafa T. by etransfer. This was the mouth agreement because Oktay told me I should have paid 1/3 of money in the beginning. After sending money, I had to call him to check if there is any progress. He told me that he is working hard and he contacts people. He came with architecture to my house to draw plan. This was happening in April. On May 6, I had to fly back home for 4 weeks and he promised me he would apply to get permission from City of Brampton for legal basement. After I return on 3 June 2022, I called him several times, he didn't pick the phone. He answered my call June 9. I asked him about applying permit. He said he was expecting the official names on title deed. Basically they didn't bother to call me or text me to find out my ex husbands name which is on title deeds. I contacted them first on February 2022, they didn't do anything till June 2022. I said I don't want to work with them and send my money back. Mustafa T. sent my 10.000 cad. Oktay again ignored my calls for long time. I managed to talk him in the middle of June. I said what happened to my 20. 000 cad. I said he didn't bring any material or any other job done in my house. He admitted he purchased other people's material.

    Business response

Business Response /* (1000, 5, 2022/07/09) */ I have been called to do her basement, and we went to see the basement with my business partner, Oktay K., and we gave her an estimate and we agreed for 70,000 CAD. Oktay wanted to have the 1/3 price of the project to be paid in advanced to be able to buy for material. She sent 20,000 to have sent him and he was responsible to buy the materials and 10,000 Cad was sent to me for future expenses. In her statement she says "March 25 2002, I sent 30.000 cad to Mustafa T. by e-transfer." However, she sent me 10,000 CAD on Mar 25, 2022, not 30,000 *************************************************** Furthermore, Oktay was also responsible with all the paper works to be done for the basement such as permits and architectural drawings. He wanted to have the responsibility of the paperwork because he was speaking English well. (I don't speak English), therefore I was responsible with the construction and demolition parts of the project. He asked for an architect to draw plans and they where done and ready to apply for permit from the city. meantime she was in holiday, and she didn't pick up her phones and we needed information about the property and ownership. There fore we waited for her to come from holiday so that we could get the information and apply for permit. In addition to that as we didn't get any permit and confirmation from city, we didn't sign any official contract. When she came back from holiday, she was angry about permit wasn't ready when she was in holidays, and she wanted to be refunded. As she stated above, I send her money back with e transfer ****************************************************** And I told my partner to refund the money back to her. I was responsible with paying the money that's been sent me and as Oktay was responsible with what's been paid to him. I believe my partner is trying to pay her back as soon as he can. Regards, Mustafa T.
