Execon installed a solar system put in power on June 7, 2023. Since then, the system always showed issues base on communication between the Solar Edge inverter and the application on my phone. Situation lasted until last July when the inverter ceased to work at all. After a lot of emails exchange and insistance a new inverter from Solar Edge was ordered by Execon. After 16 days of wait (and pure loss of money because no production) even if Solar Edge on its advert said replacement is done within 3 days, the inverter was replaced. It did not solve the issue and demonstrate a discrepancy between the data coming from the grid and what is shown on the SolarEdge phone application. Execon technician came on site Friday September 20 and spent 3 hours searching. Result, the inside counter is not in working order. A new one was supposed to be ordered. Today the inverter ceased to work AGAIN. SolarEdge client service always asks to go with Execon as installer.

    Service or Repair Issues
    Status:

    - Our chimney cladding was damaged as a result of errors and omissions on the part of Execon. - We contend that this issue was caused because Execon: a) demolished the chimney below the roof line; b) failed to repair the chimney; c) failed to extend the roof over the chimney cladding, leaving room for ice to build up on the surface of the chimney; and d) did not respond to our request for service in a timely manner. - More than 7 weeks passed before Execon took action. Meanwhile ice build-up and infiltration caused the stucco to separate from the chimney. - We have held back our final payment of $1,913.82 (only 6.5 percent of the total project cost of $29,443) until repairs are made to our chimney and roof, which our contractor estimates will cost between $1000 and $2000. We have incurred additional interest costs as this issue has prevented us from accessing our Greener Homes loan and grant money. - Execon takes no responsibility for the damage. We feel we have exhausted our options as the owner has chosen to deport himself in an unprofessional manner and has made a number of misleading and unsubstantiated claims about the condition of our chimney and foundation. - Further, the car charger installed by Execon has already failed and requires repair or replacement. This has further eroded our confidence in the ability of Execon to do quality work and to honor their contractual obligations. - We are asking that Execon: a) cover the cost of repair of our chimney and the extension of our roof line; b) repair our car charger; c) correct our credit reports, if such a report has already been made; and, d) provide a letter committing to honoring their warranties on all work.

We have reached out  to customer for a settlement. Unfortunately stated claim from the consumer is in our opinion incorrect. All worked included in our scope or work in the contract was completed with proper workmanship as stated in the invoice. Unfortunately the client opted to not completed the last milestone of the project (completing an eavestroughing repair) This negligence is leading do damages to chimney wall that is outside our scope of work. The client was requested by our team several times to complete this work, and informed that further damages could occur if not completing is due time. We even installed a "deflector"  and had in writing that we would complete to installation for free a discharge of any liability and immediate installation of gutter but the client.  We have been very supportive and accommodating with this particular client, only once we threatened with credit agency was this complaint published, indicating to us a defamatory intent. In an effort to zip up this file we actually offered to reduce our final invoice price by 600$ plus HST even if this is no fault of our own, With that offer we would have continued to honor our warranty and move forward in solving the car charger settings issue (which was only signaled to our once we read this complaint online). The client has refused and our offer has since expired. We hope this explanation warrants not having this complaint published on the website as we would be forced to take credit reporting action against the client, at the moment that is not our the intention.

At Execon we have always been able to find resolutions to any conflicts big or small, most often negotiating in the favor of the client to resolves issues in timely manner to direct our resources on other aspects of business than conflict resolution. 13 years of doing business completing hundreds of projects and this is one of the most difficult client we have ever faced, we spoke with other contractors that have completed work at this address, and all of them seems agreance that no further business would be carried out with the client as even using "white gloves" is not enough. With all this said, we will not be repairing the complainants chimney, we have made an offer to settle an amount no resolution has come from it, we hope this brings a better understand to the situation we are faced with.

    Thank you.

    Complaint: 20211261

I am rejecting this response because:

Execon continues to misrepresent the record of events we have documented in our complaint, the scope of work, their contribution to damage to our property and their general lack of professionalism, from their staff working at heights without protection, to other clients' confidential correspondence being sent to us in error. We plan to use the hold back for it's intended purpose, to address deficiencies and damage caused by Execon to our property.

Additionally, the fact that Execon is refusing to honour the warranty on the charging station they installed, and are instead using it to extort us of more money, is yet another example of their management's dishonesty and unprofessionalism.

    Sincerely,

    ********* ******

    Hello ****,

Have you fixed the gutter? The "damage" you claim will continue until you complete that work.  You can neglect to complete the repair, and yes your chimney will continue to be exposed to water coming off your roof in addition to the rain that it has always been exposed too. Wall aren't made to be downspouts.  Eavestroughs are meant for that.  Anyways, you refused our offer, I can extend it but I won't be putting anymore on this file. If you refuse it, that's fine. I'll leave your overdue balance be, I've done what I can. You'll just need another company to service your solar and roof.

    Complaint: 20211261

I am rejecting this response because: Execon has not changed their position and continues to refuse to take responsibility for compromising the building envelope, failing to respect the scope of work outlined in our contract and refusing to honour the warranty on the car charger they installed, which has been unusable for several weeks.

They have been negotiating in bad faith and cannot even be bothered to read our replies, since they are not even addressing their responses to the right person.

    Sincerely,
