Renting a house from first realty with another person me and the other person wasn’t getting alone so I left and asked to have my name removed from the lease but they said in order to have my name removed the other person that is on the lease have to sign a release form which they haven’t and they allowed another tenant to move in and write their name on the lease with a pen they never retyped the lease they just added them to the existing lease but never notified me that they was adding another tenant since my name is still on the lease I should’ve been contacted about adding a new tenant to the lease but I wasn’t and they knew it was wrong because they wrote her name in ink instead of retyping the lease for everyone to sign since they fail release me from the I didn’t get a say so if I would like to add another tenant so it’s two original tenants on the lease and a new tenant that never had a background check performed before moving in

On 08/27/24, complainant notified our office via text of her intent to be released from the lease but would not sign over the security deposit to the remaining tenant. On 10/2/24, the complainant visited the First Realty office but was unable to reach a property manager to discuss their complaint. The following day, 10/3/24, First Realty corresponded with the complainant via text message explaining the formal process of removing her from the lease, which process has not been completed by either party. The complainant called the office to speak with the property manager at which time the property manager tried to explain that the name of the new occupant was noted for informational purposes only, as the office had been informed that another person was now living in the property. However, the new occupant had not been formally added to the lease, as both the complainant and the co-tenant must provide written authorization in order to do so. The complainant insisted that First Realty had allowed the new occupant to move in without her permission, but the property manager clarified that they had no control over who accessed the property between the tenants. The complainant then abruptly ended the call after expressing her concerns.

The issue between the tenants is that the complainant wishes to be removed from the lease but refuses to release the security deposit to the co-tenant, which is required under our business policies. This matter is not the responsibility of First Realty and shall be settled between the tenants.

    Complaint: ********

I am rejecting this response because:

    Sincerely,
As you can clearly see that the lease states that anyone that have been occupying the 3 or 4 nights a week must be added to the lease and once again I never was informed about anyone being added to a lease that I signed and they just go up under and not retype the lease just have them sign in pen that is technically falsified Documentation Because not once did I agree to anyone being on the lease where I can still be held accountable for and you’re correct I did not want to sign over my security deposit. I would like my security deposit back and they could put their own security deposit now like I asked you you could have give me my security deposit back and added their security deposit to their rent you went and let someone else sign a lease without my consent and I feel it is only right to get my security deposit and have my name taken off the lease without the co-tenant signing a release form I didn’t have to sign anything for you all to add her to at least so it’s only fair that you’re gonna release me from the lease and give me my deposit back because what you have done is really fraud. That is criminal. I never agreed to be on lease with anyone other than the person that originally signed that lease with me.

I've made multiple complaints about noise upstairs with a dog which clearly stands in lease no pets or smoking but I was hit with a violation of smoking all because my stove was raggedy which they decided to replace . I called about a backup in my bathroom before I went to work and the same day I was fined $250 for lease violation for so called strong odor in which they said was smoke. It's like pulling teeth to get anything done around here I've sent multiple request to get something done but nothing has happened. I have proof people here have pets which it stated in the lease no pets allowed but its overlooked and the disturbance is out of control.

A First Realty representative was needed to open Mr. ***** door for plumbers to repair an issue in his bathroom. Upon arriving the representative noticed a strong tobacco odor in the unit which lead to the $250 fine in accordance with the lease agreement.  When Mr. ***** contested the fine, I went to his unit with another coworker. We both noticed the tobacco odor was still in the unit. Thus, the fine remained. Mr. ***** then complained that his stove smoked every time it was used. A technician was sent and determined that the smoke was coming from dirty stove eyes due to lack of cleaning and was a fire hazard. The decision to replace the stove was made due to the knobs being worn and hard to read. As for the upstairs neighbor with a dog, it is a registered ESA. I have reached out to the tenants about the noise level. Please feel free to reach out with any additional questions.

I am rejecting this response because: they saying it smells like tobacco smoke in my unit and that is not the case everyone knows me knows I smoke outside because now if the smoke is a problem traveling inside they can fix my door which has a gap in it I told the lady sometimes I have my windows open I mean I can have my windows open if I choose too and to have someone come out to my unit while I'm there and tell me what my unit smells like. and just because its a so called service dog does that mean I just suppose to be disturbed day in and day out with the noise etc which I still go thru prime example this morning and over the weekend

    Sincerely,

    ***** *****

I would be happy to allow ***** ***** out of his lease if that would be acceptable. I have reached out to the upstairs neighbors but due to ADA laws, I can not have the animal removed.
