My understanding is what the company president ************** Avery told me via email, is what he tells others: that he has no records of the house sale and then demands proof. I supplied with more than he needs, then heard nothing. Im willing to share emails with you as proof. I am sending you documents and receipts in a following email. The repairs for the tiny home we purchased from him come to around $2,465 ( I will check). I have repeatedly asked him for reimbursement. Thanks so much for your help.

As I told ************, we do not have all our units that we have sold on file because a previous employee has taken all the files with her so that leaves us with no warranty information. This being the reason I ask ************ to provide warranty information on his unit. We cannot pay invoices that are unapproved by the manufacturer just because someone demands us to. First, we wanted to make sure we were dealing with one of our sold units. This ex-employee has had units built by other manufacturers. This being the reason we had to get verification that it was one of our units.  ************ has demanded for items to be paid for that is in building compliance or not a warranty issue. His house was out of warranty on December 9th, 2023, some of the invoices were not dated or after the warranty period. I have agreed to pay 2 of the invoices of the leak in the shower and shower drain, totaling $175.00. ************ always wants a response in 72 hours but takes up to 17 days to respond back to Avery Cabin after requesting information before filing a complaint as soon as we don't respond in 72 hours. I've tried attaching emails between ************ and I but they are to big to send.

    Complaint: 21860998

I am rejecting this response because:

    Dear BBB:

The following is in response to Mr. ******************* response:

The homes warrantee begins when the home was hooked up, which was 6/23, so we are indeed under warrantee.

The call regarding the weekend emergency flooding could not be expected to wait until Mr. ****************** was back open for business on Monday.

The mini-split wires were required to have been placed in the walls and underneath so that all our hired electrician had to do is connect the mini-split to the wires. There were no such wires placed by ****************** causing an expense to me of $1,038.

According to Alabama law, there must be a builder warrantee for each home. Im asking Mr. ****************** to produce a copy for my home, as we never received any warrantee from him.

Additionally, I am asking for a copy of the homes approved 3rd party plans by TRA. Despite Mr. ******************* claims of document theft, he can have the approving 3rd party send it to me with the date for my house.

Id like the inspection sheet showing where each section was signed off as it went through inspection, and which has each appliances serial numbers. It is a state legal requirement for him to have these records.

As to the stairs, no building code at any time or any place regardless of how lax allows for such a safety hazard.  Any photo of these steps would convince any judge of the steps being such a hazard risk.

    Sincerely,

    ***********************

Attached is a Welcome Letter for each of our units that supposed to be given to you by your salesperson when your house was delivered. In this document it clearly states on page 2 that the 1-year warranty from the date of delivery.  The emergency plumbing issue that you had, an email or phone call on Monday morning stating that you had issues, and it was an emergency so we could have known to except a bill or invoice. It is not our policy to research each invoice before we pay any invoice we receive. We cannot pay an invoice just because a customer demands payment. We have to research the invoice and ask questions to make sure the invoice is legit. Hope you understand that.  Yes, TRA is our third-party inspection company but is does not do a report on each unit we build, so a report is not available. We do have the serial numbers for the appliances that are in your house in our files. On the wire for the Ac Unit, there is a wire from head to outside unit but by code an electrician has to run a wire to disconnect switch to a 3/4" pipe coming down from the breaker box. The stairs are built to the drawing you sign off on and agreed to. We can install ladders as well as stairs that are very steep to increase space within the unit. All these are accepted to the tiny house code. Once again, I apologize for any problems you had with one of our units, but we try to build one of the best tiny houses on the market.
