I bought a condominium in the **************** 1 *********************** in September of 2023. It was never explained to me that there was a special assessment for 2024 in the *************** and that the *** will increase when I purchased the condo. I'm upset because I had to pay an additional $2,807.18 in *** fees for the replacement of the roof. The monthly *** fees that are being collected are to cover the cost of roof repairs/replacement, which arises the question are the monthly fees going towards the maintenance of the complex or are the funds going into certain individuals pockets. Also I have been fined twice for parking in reverse in my assigned parking space. I asked why is this a rule and I did not receive an explanation. I continued to ask what is the process to change this rule and did not receive a response. This rule needs to be changed because the size of the parking space which was designed when the complex was built in 1975 does not accommodate the current size of vehicles. I explained to the *** that I'm unable park my car when there are cars in located in both parking spaces on the right and left hand side. Also not to mention behind me. I need to reverse park when all 3 parking spaces are occupied. I want the reverse parking rule to be removed. I'm a homeowner and not a renter.Business response

Special Assessments are presented to membership of an association and require majority approval of owners. ************** requires roof replacement, which is a typical cost of any condominium community. Owners are able to review community financials on the website at any time to see how funds are allocated.
Regarding the fines, upon purchasing in any homeowners association, potential owners are provided community documents who clearly state the rules for such community. ************** does not allow for reverse parking and as such, fines can be imposed due to non-compliance. All owners have the ability to appeal such fines as described in the letter owners. PDS enforces the rules per the documents and the authority granted by the Board.

My Hoa has been going after me relentlessly to the point where I may become homeless. They have caused me so much grief and I have been recently been determined to be SMI seriously mentally ill however despite providing documentation and My doctors office reaching out they have the audacity to threaten to foreclose on me despite the fact I have a disability and further more the hoa has failed to act diligently. They have Not provided accommodations despite both physical and mental health conditions They inundated me with fines and notices after receiving money from the *** Once a violation is corrected they find something else that was not addressed by the hoa as if they are looking for things to get me on There attorney does not communicate in a timely manner and I cannot communicate with management to expedite any accommodations This is absolutely wrong if not illegal I owe 1000 dollars to the hoa 600 of that are in late fees fines which snowballed because they inundated me with violations after I had physical health issues in 2023 even though I have done what they want they find the next thing to go after me for and its wrong and now I may be homeless because of these people its wrong if not illegalBusiness response

As previously stated in past responses; the ***** of ********* make all decisions for the community. PDS does not have any part in any decisions made. The ***** is not intending to cause undue stress but only requesting that ******************** come into compliance on his home in addition to paying his HOA Assessments as this is a responsibility of home ownership.
******************** met with the ***** of ********* on Tuesday, May 14, 2024, to plead his appeal. The ***** decision was to deny the appeal.
******************** continues to place complaints through the BBB instead of following the directions for resolve that he has been given.Customer response

So for one thing I've made this very clear that I have been following the directive and the attorney is not following up with me I submitted this appeal a month ago and emailed ********************* he has not responded he's not communicating what they want done he's allowing things to escalate and furthermore they know I have a documented disability so what do they do they proceed to move forward with this and then they say they're not causing me undue hardship they're threatening to foreclose on my home. But what's most disturbing is that they said I met with the board of directors on the 14th that's not true I would have had to have gone through the attorney for that I was not at the board meeting this is deceptive if not illegal we have made numerous attempts to communicate with the attorney over the last six months and nothing I went as far as going to the State Bar because of it but this is deceptive if not illegalBusiness response

Let me address each issue one last time cuz it doesn't seem like the management company is following directionFirstly I never attended the board meeting on Tuesday that is a flat-out lie for them to sit there and tell the better Business bureau that I was never there I would have had to have communicated with the attorney to even attendWhich leads me to the next part of this issue is that he simply doesn't respond the directive is to reach out to him but he doesn't communicate he doesn't say what needs to be done and then it drags out and then for the last 2 years oh it was just your yard well when the yard was done they find something else it's the roof now it's bullying is what they're doing
And it's simply not true that we're not making efforts to get the home into compliance the landscaping was done in the front yard the gravel was put in in the backyard and the *** attorney did confirm that it was in compliance but then the *** decides to find other things like the roof it's intentional they know I have a disability they know I'm financially strapped and that's why they're hitting me for it it's harassment
And it's against the law for them to not even acknowledge the fact I have a disability despite getting not one but two documents from two different medical facilities and not making any type of reasonable accommodations in fact I can't even communicate with management for directive
And find it funny that they want to complain about me having my home and compliance well that's kind of hard to do when you've racked up $1,100 in fines most which are late fees and violations so I don't know what you expect me to do
And and those fines were initiated during a time when I had a physical health issue and I could not do it I could not risk my health and they were well aware of that the attorney was well aware of that so much so that I had to get my family involved

As ***** of ********* I have legal rights to act on her behalf.The complaint: (bellairtownhouses.com) website is 100% managed by PDS, PDS has denied statutorily required access to documents and information made available on the website. Access to HOA documents and information, according to state statute 33-1805, cannot be denied. Access is required to manage MS. ***** affairs and to ascertain Board and PDS compliance with ****************************** Declaration of Covenants, Conditions and Restraints (CC&R), and state statute. Website access was previously denied as the complainant is not an owner in the community. *** was received and her email address has been added to the system so now has full access. The *** received however, does not give the complainant the legal ability that she states as reviewed by the Associations attorney but allows the complainant to represent the owner at the Board meetings.
The Board President contacted the complainant directly offering to meet her in person to resolve the matter and come to an amicable resolution to the complaints and viewed threats from complainant, and was denied.
The information being requested through BBB has not ever been requested in writing. The only item that was required of the manager was to send a letter of apology, which in reviewing with the Board agreed that it was a valid concern. The notice was a first notice only and involved no financial penalty.Initial Complaint

I live in a condo complex, ******************** where I had a water leak inside my unit. Tuscany Condos HOA is managed by 'Planned Development Services' (PDS) which is who I am filing a formal complaint against. I noticed the leak (3/29/23) and filed a claim with my insurance to fix the outstanding issue. The water mitigation company came out and fixed the leak but there was substantial destruction to get to the source (April 11th). My insurance reviewed the ***** (Covenants, Conditions, and Restrictions) for the association and it stated that my insurance is responsible for the first $10K in repairs and the insurance for my HOA was responsible for the remaining repairs. The insurance for my HOA (being managed by PDS) confirmed the accuracy of my insurances (USAA) findings and upon receiving the invoices from the construction company, RMJ construction sent a check to PDS so they could pay RMJ to complete the repairs (May 12th). PDS confirmed receipt of the check and explained that once funds were made available (after standard reg CC hold) they would send the payment to RMJ so my repairs could begin. May 22nd PDS confirmed that the funds are available and would send payment to RMJ. After completing multiple requests from PDS (invoice est, 2nd invoice, cert. of liability insurance, new vendor checklist & ****************9) they confirmed that payment was being sent to RMJ May 31st. I have been unable to speak to the community mgr, ********************************* or her supervisor, ******************* (Executive VP of Mgnt ****) since March 31. Myself and RMJ Const have called daily as well as sending emails consistently. I confirmed through other reps that no payment was ever sent. I will call PDS and speak to other representatives and they have passed multiple messages, sent emails, forwarded my calls so I can leave voicemails and despite all attempts to contact there has been no follow up from PDS. At this time I am at the mercy of PDS or I will continue to have no bathroom.Business response

This issue was resolved in the summer of 2023 once insurance authorized the payment and those funds were approved by the Board. The owner who placed this complaint is no longer an owner in the community and all items have been addressed. PDS considers this matter closed.Initial Complaint

I have had ongoing health issues for the last year and I have been struggling and the *** has been nothing but make my life more miserable I have reached out to the Arizona ********** of ******* to get assistance with my *************** however ********************* it's not currently set up to accept payment from the ********** of ******* and I submitted this application months ago now *** is threatening to put a lien on my home even though I'm trying to get help from the state and it's their fault because they're not set up to take payments from the ********** of ******* and I was advised by the ********** of ******* that they have to by law and now they're putting stress under me I've tried to communicate with them but they made it difficult because the attorney I'm tired of this but they need to resolve this issueBusiness response

********************* has the ability to accept payments from the ********** of ************** *************** has no control of the time it takes for a payment to be rendered on behalf of an owner. The process through the state begins with a caseworker (for the owner) reaching out for the applicable details for a payment to be issued. The homeowner should check with the ********** of ******* to see the status of where their case is in the process. Additionally, please have the caseworker reach out to ***************************** *************) who can assist with ensuring they have what is needed from the association to facilitate payment.Customer response

I spoke with a caseworker last week they confirmed that they're going to be making a $700 payment or years worth of dues whatever the total is at some point however I reached out to the HOAs attorney weeks ago first before filing this grievance with the Better Business Bureau because this is a serious matter that's why I escalated it to the BBB however ********************* rudely responds and gives me a hard time about the Landscaping because I had also followed up with him because I first hand saw my next door neighbor literally dumping bag after bag of trash in my garbage can and I'm supposed to reach out to him if I have these type of concerns however he very rudely responded to me and gave me grief about the Landscaping which was already agreed upon that I have a final extension till March 23rd of next year but I find it very rude the way that he came off in his email I've explained to him that I have extenuating health issues right now not to mention my financial issues that have been caused by this and I am making a due diligent effort to at least have the dues paid but with everything going on in my life right now I just find it very rude the way that he came off in his last email I've been not well for a long time and I am just trying to get back on my feetBusiness response

PDS will look for the payment as stated.
The current complaint does not involve a PDS employee. ********************** as mentioned, is a lawyer, employed by the association and the complaints against him should be brought up against that company.
Additionally, the Board has given ******************* numerous extensions to take of his property. In December 2020 the Board provided a 120 day extension. In March 2022 he was provided a 6 month extension. In September 2022 he was provided a final 6 month extension. This is for both the front and back yards as he doesnt meet the minimum landscaping requirements for both.
PDS does not make these decisions, ******************** is aware of the process. They have been very accommodating.

So let me make this very clear that they have given me a final extension for the Landscaping until March 15th that was communicated from the lawyer however the *** is now trying to pull a fast one I get an email the other day saying that they're doing view fence inspections gee I wonder why I think they know that they got payment from the ********** of ******* and now they're going to try and extort that money by issuing out fines for the backyard they're going back on what they said they were going to do minded that that they should have brought this issue up when I wasn't in Dire Straits back in 2017 no they waited 3 years before they issued the first violation for it my yards always been like this since 2017 and they wanted to make a fuss about it in 2020 but I'll tell you if you try to put they try to pull a fast one on me they're asking to get sued at this point and that's where we're going to have to go with this because I'm having medical issues and the last thing that I need is more issues from the *** and I will not hesitate to pursue them legally at this point I am tired of the way they've treated meInitial Complaint

I was out of work for 6 months and I received a letter and a fine indicating I did not have the correct amount of plants in my front yard, I advised the manager and she gave me a dead line of 5/2022 to resolve the issue. I finally found a job in May and asked her if I can extend to **** to save money to purchase the necessary plants. She denied my request, since then I have received two additional fines and a certified letter that I now have to pay for the service. *************************************** does not consider the current economy we are facing and not once have I been late for my monthly payment fee for HOA, they are inflexible and do not have any regard for the homeowners who are struggling financially. I left a message for the assistant manager to return my call and it's been 3 business days with no return call, they are unprofessional and I wish I could move out of the neighborhood.Business response

Management partners with the Board to effectively enforce the community Covenants and Rules and Regulations. While your concern is noted, the Board provided notice in 2021 that landscape minimums were to be complied with by August 2021. This deadline was not met and another violation letter was issued,at the direction of your Community Rules. You were provided a 5 month extension then that took you to May 2022. You have provided an appeal that will be reviewed in the July meeting for the fines. Management has worked to provide you multiple opportunities to cure your issue.Thank You.
