I had a judgement in place with ************ Kirkorsky, P.C. Attorney at law I was set up with auto pay Starting 6/26/2020 In 2021 someone in their firm decided the judgment wasnt good enough and wanted more. Unable to pay more, I said Im sticking to whats in place. The last payment they pulled was in 8/2022. I noticed my 9/2022 payment wasnt pulled so I reached out trying to pay them, even fallowed the automated payment system to find I was locked out and my account didnt exist. Confused, I called several times and they wouldnt answer their phone or return the messages I left.I received a judgment in the mail months later dated 9/13/2022 Clearly they intended to act like I was the one at fault and today 3/10/2023 They managed to attach my wages and now i cant afford my mortgage. How can they get away with this and I wonder how many people have they have done this to.Please, i need help

    Business response

    03/14/2023

Our Law Office represents ******************* (Westar).  **************** incurred a debt with Westar which remained unpaid.  In order to resolve the debt, Westar placed the matter with our Office for litigation.  After litigation was commenced, **************** on 08/11/2020 signed a Stipulation for Entry of Judgment, thereby acknowledging the debt.  The Stipulation was filed with the Court, which on 08/17/2020 resulted in a final Judgment.

While payments were made toward the Judgment balance, payments discontinued.  The last payment was applied on 08/30/2022. Between 12/16/2022 and 01/10/2023, our Office made no less than six attempts to reach **************** by telephone at **************.  Because our Office was unable to make contact with ****************, our Office initiated a wage garnishment as a means to enforce the Judgment.  On 2/17/2023, our Office received a voicemail from ***************************, the wife of *****************  In response to her request, we attempted to reach her at **************, the telephone number she referenced in her voicemail.  Again, we were unable to reach *****************

According to **************** Complaint, he wants to reinstate a payment plan to resolve the unpaid debt. For that reason alone our Office has quashed and released the garnishment and invite **************** to contact our Office and speak with **********************  ************** is aware of this matter and will discuss with **************** a payment plan reinstatement and related details and instructions.  Our Office will take no further action for a period of thirty days to allow **************** sufficient time to contact **************  With regard to the calls **************** claims he made to our Office with a response, the account associated with this matter does not reflect any inbound calls from **************** as he describes.

We appreciate the opportunity to respond to your inquiry.  Should you wish any additional information or assistance, you are welcome to contact our Office anytime.

    Sincerely,

    ************ Kirkorsky, P.C.
