    On or about July 15 I answered a ad for a house for rent. I called United Real Estate and met with *****************. He said house is available. I had to give him the security deposit in the amount of $1,650.00 in a forum of a check and he would write up the lease. I came back the next day to sign the lease and *** said the guy now wants $2250.00 for the house I told him that is too much. In the memo area on the check I put the address for the house on it and said for security deposit. *** told me he has another house coming up shortly. All my stuff is on a uhaul because I thought I was signing a lease and moving in. So 2 weeks go by *** is saying the house was a mess and he has to get it fixed. I said ok. So a month goes by and still the house is not done. Mean while I am paying $50.00 per day for all my stuff is on the uhaul. I got a call from *** around Monday saying the lady wants to sell the house now. It's now September 12th. Uhaul called me and threatened to tow the uhaul and charge me with theft of there equipment. I texted *** that. Got no response. So I went to another realtor to find me a place for my family. Found a place on Tuesday. Signed lease on Wednesday. I told *** who is ***'s father who also runs the business. On Wednesday that I signed a lease for a house and to tear up the check. He said ok. The very next day that check I wrote back in July for a house I never got. He cashed the check. I asked him why he would cash the check. He said he had to put it in a escrow account. I said we where going to rent a house not buy one. Get this straight I didn't sign ONE peice of paper. I didn't enter into any binding agreement or contract. I plan on filing a complaint with the ******* realtor board. Since that money has come out I have been charged over $450.00 in overdraft fees by my bank. I will continue to receive overdraft fees as bills come. *** has texted me on several occasions saying he will just hold on to the check till i sign a lease. Help me.

    The Plaintiff did not call us on the Wednesday, September 13 that he took another lease.   

    The plaintiff fails to mention that we moved him into a temporary  home until the home he wanted would be finished upgrading. 
    The Plaintiff was notified on Friday, September 15 that owner was not leasing the home anymore and that they decided to sell the home.

    The Plaintiff did not move out from the temporary house we put him into after he signed a new lease with a different owner. He could only stay in the temp house for two weeks rent free to help him. He moved from out of state to come here with no signed lease and no place to go. 

    So we helped him with temp living space. It is time for him to move out of the temp space. 
    We deposited his security check in a trust account, not escrow account until he moved out from the temporary.

    This money is used as security to cover any damage or poor condition he leaves the temporary home in  

    We just want him to move out now that he had a place to move to  we want him to be happy and want him to move out and leave the temp housing in good clean condition  When the Owner of the Rentsl decided not to rent  We offered the plaintiff another fine home with immediate move in  it wasnt until we mention this to him on Friday, September 15, thatwe found out he rented another place  

    He promised he would leave on Saturday, September, 16 no later than Sunday, September 17  

    We made an agreement to these terms  His money was deposited in a trust account and would be given back to him when he moved out of the temp house  

    All should be good by the end of today, Saturday or tomorrow Sunday if he keeps his word
