    Subject: Formal Complaint: Misrepresentation and Unresolved Issues at Tower Motel Dear Better Business Bureau,I am writing to express my grievances with Tower Motel, located at ***********************************************, where I have resided since July 5, 2023, and have paid $11,322 in rent. I am seeking assistance due to misrepresentations and unaddressed maintenance issues that significantly impact my living conditions.Initially, the property was misrepresented to me by the manager, *****, as an apartment complex, but it was later disclosed to be a motel. This misinformation has affected my expectations and rights as a tenant.Furthermore, several maintenance issues including a non-functional air conditioning system and a persistent bug infestation remain unresolved despite multiple requests for repairs. This has led me to withhold rent as a last resort to induce action from the management.Additionally, there are concerns regarding the legality and appropriateness of the security personnel employed at the motel. The security staff member, *****************************, reportedly lacks the necessary licensing for his role and has a concerning criminal record related to a sexual offense.Due to these issues, I am requesting a full refund of $11,322, citing the initial misrepresentation and the failure to address significant maintenance issues.     My disabled husband checked in at the tower motel in Bakersfield on July 12,2023 1:48pm he paid in cash 960.00 I have a copy of the receipt nowhere on his copy does it say that his wife cannot be on the property nor have I ever been told in the past that I was not allowed to be on the property I personally never had an issue the one time that I stayed my husband was shot in the head a year and a half ago he has aphasia he’s on SSI due to the disability of learning how to speak right talk eat he’s lucky to be alive, but due to that crippling injury he has a traumatic brain injury that left him with the facia. He cannot make contracts legal binding contract without me. I am the legal representative for him in any business matters. I was not with him at the moment when he rented the room he was excited to be next to his brother, who stays here, but due to the fact that I guess unknowingly, the office lady doesn’t like me I was unaware of or I wouldn’t of even been OK with my husband running ahead of me in renting the room if I would’ve known that when I got onto the property, they were going to be demanding us both to get off the property he’s disabled, and that they’re keeping his money for the whole 30 days that he paid and he’d only been here two days we refused to leave the room we stayed in the room being quiet no disturbance telling them that he’s disabled they can’t treat us this way. It’s not right that he say nothing saying I couldn’t be there, but even. if they say he did, he legally cannot sign binding contracts. The security guard came banging on the door a few times demanding that we let him in which we did we followed all the rules till the last one when I was assaulted by the security guard ***** *********, who has an ankle monitor on and is on the registry for sex offenders. I doubt he’s even allowed to be a security card or children are staying nights here but I’m in the shower soap in my eyes in my hair. He’s demanding me out the shower, I come out the shower, grab a towel. He’s already seen me naked, but whatever at this point, he’s so close to my face that he’s spitting his body fuilds in my face, calling me out my name and pushing me so hard with his shoulder out towards the front door, telling me to.he calling law enforcement on me which I say please do so I can report this assaults Me and my husband are not sex offenders we’re not wanted by the law we’re not felons were not on any kind of house arrest with monitors on unlike the security guard, I pay my taxes I follow all laws and rules. I would not have even let my husband go ahead of me to pay for the room. If I would’ve known this was gonna happen, but my husband is disabled and cannot be discriminated for that you’re screaming. They don’t give a shit that it’s his problem not theirs they want us out, but will not give us a refund for the rest of the 28 days that we paid for

    Hello,

    My husband and I own the Tower Motel.  You sent us a first notice on July 16, and a second notice on July 21 and demanded a response within 5 days.  We don't live in Bakersfield, and we get our mail from there every 2-3 weeks.  Additionally we were in England for 2 1/2 weeks.  All of this is to say that we just got these notices and wish to respond.

    The person who is complaining about her treatment has stayed on the property before.  She and her husband fought continuously, so after they left we did not desire to rent to her another time.  When her husband asked to rent again, he was advised that the two of them could not rent a room.  However, he assured us that it would only be himself in the room.  After a couple of days Dawn Gonzales, his wife, appeared and the troubles began.  They fought and disrupted the other tenants.  They were asked to move out.  

    He had rented the room on 7/12/23 for a month for $960.   He was told that if he left the room in the same condition as when he rented the room he would only have to pay for the 5 days he was there.  We normally charge $53 per night, but we only charged him $32 per night.  We charged him for 5 days.  $32 x 5 = $160.
    He had paid $960 so we subtracted the $160 and REFUNDED him $800 in cash on 7/17/23.

    We bent over backwards to be fair to this tenant.  The entire complaint is unfounded.  Please do not put this ridiculous narration against our property.  We look forward to your response.

     I am rejecting this response because:

    Every single word was a lie my husband is incompetent. I was shot in the head a year and a half prior to now he couldn’t make any arrangements due to the fact that I am his legal representative and my husband stayed on the property one other time with no issues I was never asked to leave that we did not constantly fight nor did when we rented the room. Did we have any altercation between each other? Only problem was that the sex offender security guard was not technically even allowed to be on the property there’s another register, sex offender who lives their children are not safe on this property they do not protect their guest or anyone else. They do not follow California state guidelines or laws that a sex offender cannot be a security guard
