    I am writing to file a complaint against Real Property Management for their actions as my property manager. Real Property Management has engaged in illegal and unethical behavior, including extortion, misrepresentation of the facts, and violation of California law, and I am seeking a resolution to this matter. I signed a lease agreement with my landlord in 2016, which did not include any provision for an agent, and the agreement only named the landlord as manager. However, in 2021, Real Property Management presented me with a new lease agreement, which I signed under the impression that it was a legitimate and legal agreement. I later found out that this agreement was fraudulent from its inception and therefore void, as it was not amended or terminated from the original lease, and the landlord did not provide me with 15-day notice of the name, phone number, and address of the agent, as required by California law. The new lease agreement contained several illegal and unethical provisions, including an increased rent amount of $1375 for 15 months, an unauthorized fee of $37 for a "care reward program" each month, and the imposition of several late charges of $150 and threatening $600 in several 3-day pay or quit notices. Real Property Management also issued several 3-day pay or quit notices, threatening me with the late charges. Real Property Management's actions amount to fraud, extortion and misrepresentation of the facts. Their new lease agreement contained illegal provisions that were not disclosed to me before signing, and they imposed late charges and threatening 3-day pay or quit notices in violation of California law. The increased rent amount and unauthorized fee were added without my knowledge or consent. RPM illegally terminated their management position without providing I and fellow tenants with a 60-day notice, as required by California Civil law. Despite this violation, I believe they should be held accountable for their illegal and unethical actions.

    I have utilized Real Property Management out of Porterville for the last few years starting in 2018. I have terminated using them when we decided to sell our house. They sent me a final bill last week charging me for items the tenants were responsible for as well as items I did not request, but they took upon themselves to do, and for an inspection where they never gave me the report as well as it was done 20 days prior to tenants leaving the premises. When attempting to contact them the worker was able to have the tenant's portions removed but would not give me a manager or accounting to talk with. She could only give me an E-mail. Contacting this company can be a nightmare where they do not return calls and rarely can you have someone answer the phone on the first try. The company also claims to screen their tenants; however the last tenants caused damage to the property and were smoking weed in the residence. The company stated the tenants were good tenants and were continuing to rent properties to them. If the company had done the safety check they charged me for, these issues should have been addressed but I was never notified nor provided a report from the check. The check was dated to have been done in April and the tenants moved out in May. I also received a final bill on 7/14 and am being told that they are already going to send me to collections if I do not pay the bill. I have told them I am just now receiving the bill and need to discuss with them discrepancies on the bill. I don't want others to fall into the trap of trusting this company with there investments.

    We spoke with the property owner via telephone on 07/27/2022 regarding the final bill sent. We offered to transfer the call to the accounting department, but the property owner did not ask to talk to the accounting department, and continued to speak with our staff in the office. Real Property Management Evergreen issued the property owner a credit of $1,343.00 on 07/27/2022. The property owner was happy with the outcome and the credit we issued to him. All applicants are screened when they apply. A credit, criminal, and eviction check is ran with each applicant as well as verifying income and their rental history.  If they do not meet our criteria, we do not consider them for the property. The applicants did meet the criteria when they applied. We do not have any records showing or detailing that tenants were smoking paraphernalia inside the property. All semi-annual safety inspections are shared to the property owner via their online portal. If the technician is there and does not see any issues, work orders are not generated. The past 2 reports show no major issues, and no indication of drug use. 

    As detailed above, the property owner called in on 07/27/2022 with a complaint of the bill sent, RPME covered $1,343.00 of the total cost due for the work that was completed, and the property owner paid the remaining owner costs on 08/02/2022. I have attached the owner statement to this email showing a $0.00 balance.

     I am rejecting this response because:

    The response is not honest about the interaction of the phone conversation I had on 7/27/22 nor are they being honest about the property inspections. 

    They did credit me the correct amount of money and I am pleased about that.  However, I do not appreciate the company taking the stance of flat out lies about their interactions with costumers.  If they recorded the multiple phone conversations, I had on 7/27/22, I ask that they please provide them so it can be heard that I asked multiple times to talk to accounting or management.  I was only offered an email to accounting and that email did not work.  

    The property checks are not placed into the owner portal as they are supposed to, and I still question how thorough the checks are.  As you can see from the attached picture of my owner's portal documents page, there is no property inspection after 2021. 

    I am not happy with the response; however, the financial problem has been resolved.  I just want to make it clear that the company is lying and hiding deficiencies within their own company at other peoples expenses.

    I have spoken with our staff in the Porterville office as well as our accounting department, and the property owner was offered to speak with the accounting manager directly via telephone. Our accounting manager was ready to speak with the property owner and accept the phone call, but the property owner continued to speak with our staff in the Evergreen office. I have verified this with both employees. At the end of the day, no matter who the property owner spoke to, the financial issue was resolved and Real Property Management Evergreen covered half of the cost to get a property ready that was terminating management. 

    Regarding the safety check inspections, all safety check inspections are shared through the owners portal. I have included email logs showing the property owner marked our email as spam, which could be why the property owner was not receiving the notifications that a document was shared through the owners portal. Safety Check inspection can also be printed, mailed, etc. if requested at anytime.

     I am rejecting this response because:
    We will have to agree to disagree on the phone call.  However, I still have no record provided of a safety inspection.  The attachment of E-mails going to my spam were all generic mass E-mails sent out to everyone on your E-mail chain.  I checked my owner portal and there are no new uploaded documents.  That is where the inspection reports are supposed to go.  So once again I will ask, please provide me with the safety inspection report done prior to the tenants moving out.

    The property owner has not reached out to us directly to retrieve the safety check report, but I went ahead and emailed it to him directly this afternoon. Please see the attached email for record. The most recent safety check inspection was shared to their owner portal back on 05/02/2022. I have attached a screenshot for record.

    I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me.

    I have attached the screen shot of my owner portal and the documents I have received to make it clear that the safety inspection was never on my side of the portal.  I did receive the safety inspection via E-mail and appreciate it.  It did show neglect on the company's part to follow through with a thorough inspection and report.
