            On September 2, 2022 I reached out to ******** in ******* for a payment processor and explained that if there was an initial fee, I would not be working with them. On October 5, 2022, I signed a contract that was titled with AVPS, but it was signed with Paybotic.Paybotic declined to work with me, to go straight to AVPS, as I did not make enough money as a company for them to take a cut. On December 20, 2022, AVPS sent an email saying I was approved. It included an initial setup fee of $399, and the bank would hold 10% of all sales for 6 months. AVPS sent a new contract, and asked me to sign it. I did NOT sign the contract. I declined using the services.On January 4, 2023, I discovered two charges to my bank account. They were ACH withdrawals for $50 and $217.90. They were from Greenlight Merchants. I emailed AVPS, and requested my funds back, and not to work with them.On January 5, 2023, I received a call from AVPS collections. They said I was in violation of my contract, and to pay them $8,000. AVPS had breached the old contract by adding new fees without my signature.AVPS sent me two differing Terms and Conditions. I asked for my $8,000 bill (it was never sent).On January 15, I received a bill from AVPS for $215.70. They also continued to call me 2-3 times a day demanding money. I reached out to them by email, and notified I retained an attorney, and all information needed to be documented in writing. On January 31, 2022 I received a certified letter from AVPS that I owe $4230. They had refunded the previous $215.70 on this same bill. The letter says I have 30 days to pay them or I will be taken to court. Again, they breached the contract, not me.

            AVPS has reviewed the file.  We will proceed with waiving the liquidated damages for this account and all collections proceedings.
