I paid Auction.com a $999.00 refundable bidding registration deposit several months ago. Today I went onto the auction.com website to bid on a property and was not allowed to because auction.com said I had no money on account to be allowed to bid. Now I now I sent them $999.00 a long time ago and I never used it, I just left on account in case I wanted to bid on a property, like today. I never thought my money would be gone! I called up Auction.com and first they told me they didn't see my deposit, but after I provided proof they said their policies have changed and they were refunding all of the deposits prior to the new bidding policies. Well I never received my refund and I really don't want to send them another $1000 to be able to bid until I get my first deposit back of $999.00. When I asked them when will my original deposit be refunded, they didn't have an answer. Below is and email I received from them on August 12, 2024. As stated in the original complaint details, the $999 deposit refund was initiated by Auction.com on 8/12/24.  No further funds are due to be refunded at this time.  Auction.com strives to provide great customer service with friendly staff.  It is unfortunate some people feel it's necessary to use foul language and be abusive over the phone, and make false accusations about reputable businesses being crooks.  Auction.com provided notice to complainant that a refund had been initiated weeks prior to complainant calling customer service on 9/3/24.  Any auctions or registrations requiring a deposit be placed are clearly explained PRIOR to placing a deposit, with acknowledgments being required by anyone placing such deposits.

I purchased a foreclosed home through Auction.com. I had clothes on the home and was ready to move into the home and the day that I went to move into the home my lock or changed. I got a contact with Auction.com. They told me that it mustve been an oversight on the mortgage company and then were gonna contact with them. I got the runaround for several days. They never changed my locks. I had to call a locksmith a second time to change the locks on the door and to take the lock off my garage door. I reached out to Auction.com and Carrington mortgage to see if I can be compensated for everything that happened, and they kept saying that someone will call me back and I never received a call back and I never received my money back. I feel like this is Poor customer service, unprofessional, and almost a lawful for them to come into the home and change the locks and put signs on the doors that this is their home and to not enter into the home I would like to be compensated for the money that I lost in the process.

Thank you for bringing this to our attention.  An ACH Transfer is an electronic funds transfer handled by the Automated Clearing House (ACH)as a way to move funds securely from one financial institution to another. That transfer only occurs when directed and initiated by one of the parties to the transfer. In this case, you directed two transfers of $500 each to Auction.com so that you would be able to bid on a property up for auction.  Auction.com does not control that process, and since an ACH Transfer is secure, it does not give one party access to the other party's account. One of the $500 transfers was returned to your account and should show availability as of today,6/11/24.  On 6/10/24, we received your request to return the second $500 ACH Transfer.  That request is being processed and will be returned to you within 5 business days of the request as stated in the Frequently Asked Questions applicable to the bid deposit process. If you have any other specific questions, you may contact our **************** team at **************.

Auction.com has stated something totally different from what I was told over the phone as well as what is posted on their website.

Please note that the "5 day hold" was not disclosed in their reply?  Their website makes no reference to a hold on all deposits for a minimum of 5 days.

Also note that they indicate 5 additional days for the refund.

In addition, the deposit account being an interest bearing account was also not disclosed or stated in their reply.

Auction.com has had this same issue with previous bidders.

    Business response

    06/12/2024

The 5 day hold information is available on the website as previously stated, and is always provided when speaking with customer service.  Customer directed the $500 transfer in order to have his account unsuspended for failing to follow the terms and conditions of bidding on the platform, and subsequently canceling an auction he was the winner on.  Unfortunately, this repeated behavior is why the account was suspended.  The fact that customer requested the transfer back to his account prior to the funds being confirmed into the "non-interest bearing" escrow account also contributed to the refund delay because the funds were not yet confirmed.  Auction.com is unable to refund money from a "non-interest bearing" escrow account if the funds are not there.  It is entirely legal and good business practice to confirm funds prior to processing the return transfer.  The final refund is processing and should show in customer's account most likely today, 6/12/24.  The account will remain suspended in the absence of the required $500 suspension deposit.

    Customer response

    06/12/2024

The responder is not forthcoming!  My initial complaint of my 500 was well past the 3 to 5 days!  In fact, I received an email informing me that my refund was initiated and that I should receive it the next day!  ACH does not take 5 days to receive!  My initial complaint was that the funds were not received and when I called your Agent informed me that there is a " 5 day hold on all deposits". I actually have this verbal communication recorded!  Happy to pass it along for your review!

Interesting that just yesterday you indicated that the funds will be returned in 5 days(however you neglected to state exactly when the 5 days begin) yet after you received my complaint from the BBB my refund was received the very next day?

It appears to be a pattern with Auction.com to "create" requirements that are not posted on your website!

please provide proof of the "non interest bearing account". It is illegal to collect interest on deposits and not return the funds along with the interest accrued!

Auction.com listed my newly purchsed home for auction on their website and on zillow when there has NEVER been a foreclosure on the property. We closed on the property on March 6th, the seller paid off their mortgage and we have paid ours. After speaking with both my lender and closing attorneys, it is an error on auction.coms part and **********, Anschutz, Schneid, **************** LLC. Clearly they did not do any research, if they had they would see there was never a foreclosure on the property and it was recently sold. It has become a safety issue with people tresspassing due to this fraudulent listing. Please remove the freaudulent listing!

This is an false Advertisement on my Mother's property this Company posted for Auction and my case is still pending! I find that as an insult and embarrassment! This leaks out my personal business to Family and Neighbors. What Auction.com had done was an invasion of my personal privacy what has caused me worry and pain! I would like to have this ad removed from my Mother's home until otherwise! I have contacted them days ago and got no response! This is very unfair, dirty and evil business practices!

    Business response

    04/16/2024

Thank you for your inquiry.  Auction.com is contracted by foreclosure firms and banks to market properties.  This is the case with this property.  You are encouraged to contact your lender for assistance.  All listings stay active until a loan modification is approved and all stipulations met.  At that time, the foreclosure firm or the bank will direct Auction.com to cancel the marketing of this property.  As of now, neither the foreclosure firm or the bank have directed Auction.com to postpone or remove the property from marketing.  Please let us know if Auction.com can be of further assistance.

Not buying this! Auction.com put my property up for auction violation unfair advertising and privacy acts! There are Laws in this Country to prohibit and protect the Consumer's personal privacy! I was in Court via Zoom to request a loan modification but never had a chance to speak because of an communication error with court unmuting my smartphone! This is all due to miscommunications. Until I appear in Court this Auction should not be posted on our house by the Company! I don't want strange people nosing around our home and taking outside pictures! I have a say in my rights this because of the Consumer Protection Act in which Auction.com is violating!

As stated in the previous response, no further action can be taken by Auction.com. The reasons for this were also provided.  Auction.com encourages the complainant to continue to work with the financial institution responsible for processing the foreclosure.  When that financial institution instructs Auction.com to remove the marketing of their property, Auction.com will remove that marketing.  Auction.com is unable to respond further on this issue.

I was asked to inquire about a property that was listed on auction.com that did not appear for sale anywhere else (which is unusual). When I called their number, I got a very awkward and long menu process that just led to recording after recording. The chat on their site seemed artificial, but eventually led me to a phone conversation with a human being. That person would not share any information about the property or if they were even allowed to be auctioning it. Since they would not assist me, and refused to give me any contact to the individual licensed in ** to sell the property, I looked up the owner and contacted them directly. No one I spoke to from the lending company had any idea why this property was listed there as this is not where they typically sell their properties. Everything about auction.com seems suspicious and untrustworthy. I believe they may be a scam company or, at the least, a company that is okay with being used as a storefront for scammers.

Thank you for your inquiry.  Auction.com is by far the nation's largest marketing platform for distressed properties.  We have been in business for more than a decade, and work with the nation's largest banks and trustee's in an effort to provide exposure to investors and private home buyers looking for properties.  We also work with private sellers on occasion.  When a property goes to foreclosure, it is often not listed on traditional real estate sites.  Auction.com provides marketing for these types of properties.  We do not currently use AI or a chat bot of any kind in chats or through the phone system.  When calling Auction.com, there are a series of questions and answers designed to provide on average more than 40% of the FAQ's that we have found resolve customer questions.  But there is a way to select options, as was provided to ****************** in the chats, to reach a specialist more quickly.  Once a Buyer Experience Specialist is reached on the phone we help customers with additional questions or concerns. Our website is extensive, and full of helpful and informative links to assist buyers through the process.  As part of our marketing agreements with sellers, there may be some information that is not published publicly, so Auction.com may not be authorized to disclose certain specifics, like who the seller is, until after the property is in contracting.  Auction.com always encourages prospective buyers to perform their due diligence, and we are available through chat, email or phone call to help direct customers to the best available sources of information.  Information that is requested is always provided to the extent Auction.com has knowledge of and/or is authorized to disclose.  As was the case with the request made for contact information in this instance through our chat feature.  Auction.com hopes this answers any questions or concerns you may have.  Please reach out to us directly at ************** for further assistance.

On October 14th, 2023 I notice that my house was up for auction on auction.com when my house most certainly is not for sale and should not be up for auction on their site. I email auction.com about the issue that same day and didnt get any response. I contacted auction.com via phone call the following Monday oct. 16th to inform them about this fraudulent activity and that some unauthorized seller is trying to falsely sell my property on their website. They didnt not seem concerned at all and denied that anyone would be doing that. They said they would open a claim to contact the seller but will not remove the posting and wouldnt disclose any other information on the issue. Therefore I believe the company is allowing for fraudulent activity on their website.

Our property is listed on Auction.com as a foreclosure auction. THIS IS NOT TRUE! Our debt was settled with PNC Bank and *************************************************************************************** in mid-September as evidenced by the attached documentation. We have filed Chapter 13 to stop a foreclosure sale originally scheduled for July 11, 2023. The foreclosure sale trustee, National Default Servicing Corporation, "postponed" the sale to September 19, 2023.Via email, we pleaded with Auction.com to remove the foreclosure listing. As of the date of this complaint, our home is still listed on Auction.com - ******************************************************************************* despite the fact the Bankruptcy court ordered a stay, our home is listed as "Active - Scheduled for Auction." People are constantly knocking on our door and offering "cash" to buy our home. This is very distressing. How difficult would it be for Auction.com to implement a system to "report problems?" We did not receive a reply to written requests to remove the listing that has been online after the bankruptcy stay became effective on July 10, 2023
