I was sold a vehicle that broke down and over heated within 30 days of purchase. The vehicle broke down in the middle of the 405 freeway during rush hours. The manager **** told I cannot have my down payment back. Ive taken the vehicle to multiple shops theyve all told me the same thing that the gasket is blown and dipstick is broken inside engine also there is a leak in the car somewhere. **** the manager to me I had to pay to fix it even though I was sold a vehicle that was in poor condition. Also they sold me the car with no oil in it. The oil change sticker was from January 2024. I just want my down payment back being that I dont have the vehicle anymore

    To whom it may concern,

************** purchased her 2011 **** A4 on 3/28/24. As with all customers, when she called in and told us of her concerns, we gladly advised her to take the vehicle to a mechanic we use. She mentioned the oil dipstick was missing/broken but we explained the 2011 **** A4 does not have a dipstick. The oil level is checked from the info system inside the vehicle. That was the last communication subsequent to Car Depot becoming aware that ****************** vehicle had been  repossessed. The customer called after the repo to demand her down payment be returned, but was advised that was not possible. As the customer is no longer in possession of the car there is nothing Car Depot can do to assist her. Ultimately, ************** purchased a car and was responsible to pay all fees associated (tax and license),The partial down payment she made would have been to cover those fees and costs to the dealer, as it is the dealer's responsibility to pay them.

I am rejecting this response because:
That information is incorrect. I gave the vehicle back to the bank due to the fact it was not in good condition. I took the vehicle to get oil that is why the levels are full.
    Sincerely,

On June 8 2022 I found a used ************* I wanted online and did the pre-approval application. Car Depot said I was approved to come in. When I got there I was too excited about being approved with such low credit score, I did not test drive the car. I was told my deposit of ***** was not enough and I needed to come up with $1400 more to drive car off the lot then ***** a week later making the deposit ****** I saw the finance company on my credit on the 8th. So the 10th at the latest they should have decided to not finance me any longer. But instead Car Depot waited till they got more money from me I did not give them the ***** till the 12th When I signed contract and finally drove off in the car. It took me 5 min to realize I bought a ****** I took it straight to a mechanic friend who said take it back you don't want this vehicle he showed me the oil that was caked on radiator and in a puddle on the guard that stopped all leaks. So on the **** I took car back I also needed to get a copy of contract that I did not have (It was changed too) so I get there and **** tells me we have a problem the finance company cant verify your employment so they dropped your financing. Oh great cause I don't want that lemon we can just cancel this transaction and you can refund my money. He said NO not getting my money back not getting car unless I take in another ***** all I could do was put that money towards another car After doing some research on the company and cars they had I decided that there is no way I want to do business with them. They are ****** they ***** ***** from me, then tried ************ me into buying a car from them and not causing them any trouble or taking them to court. But I cant let them steal from me its so wrong they are real ****** ***** to do that!

Business Response /* (1000, 5, 2022/09/30) */ Customer purchased the 2013 ************* on 7/8/22. Car Depot was able to secure financing for the customer based upon the information she provided on her credit application. Subsequently, the lender determined that the paystubs and employment information was fraudulent. She admitted the paystubs were fake. I advised the customer she was in default as per the Retail Installment Sales Contract and needed to pay the balance in full to redeem the vehicle or she would forfeit all monies paid. We also gave her the opportunity to choose a less expensive vehicle and would apply the money paid to that purchase. She said she would do that. We attempted to reach out to her multiple times to finalize a different transaction but she didn't respond or would say she would come in and than not show up. We have attempted to resolve this matter but are no longer willing to accommodate the customer. We are standing by the contractual agreement. I have included copies of the fraud paystubs and the back of the contract disclosing what happens when the customer attempts to fraud the dealer.
