            On 3/15/23, my partner, *************************, and I signed a 6-month contract with ******* Pilates and Fitness Studio in **********, **********. On 8/24/23. I asked the studio via email if we could please not renew our contract as we would be traveling for most of the next month. The app that the studio prompted us to sign up with upon registration, FitGrid, noted that our membership ended on 9/13/23, so I was under the impression we could let the studio know we didn't want to continue any time before then. The studio replied that we had missed our cancelation window by a couple weeks and that we would have needed to cancel by 8/13/23 to void paying for the month of October. When I asked how I was supposed to know this rule, they replied that it is outlined in the contract I signed. I asked where I could find the contract as I searched my house and email for a copy and could not find one. They replied with "We will always provide members a copy or they can take pictures if asked." However, according to California Civil Code Section ******, "A copy of the written contract shall be physically given to or delivered by email to the customer at the time he or she signs the contract." This did not happen. With that information in mind, I proceeded to explain to the studio that their contract was not binding since I never received a copy. Once my situation was escalated to front desk manager, I was told that my contract was kept in the app, Mindbody. However, I was never informed that the studio used Mindbody for this purpose as I was prompted to use FitGrid when I registered, not Mindbody. There was no way of knowing Mindbody is where my contract was being stored. If I had known this, I would have been able to check there and cancel my membership according to their timeline.Other things to note: I had not heard from the studio for over a month. Then on 11/2/23, ******* threatened to send my account to collections if I did not pay.
