On May 23rd, 2022 I purchased, via credit card, a solar powered greenhouse fan from Western Harmonics for the amount of $254.00. On or about October 4th, 2022 I emailed *******************************, owner of Western Harmonics, to inquire about the status of my order and request a refund if the order was not likely to ship in the near future. In an email response dated October 5th, 2022 ************************ stated that I would not be issued a refund and additionally had won a free solar fan. I confirmed my mailing address at this time. I enquired on October 7th and 10th when I might expect shipment of my solar fan. On October 14th ************************ emailed that he would provide more information the following day. Later that evening I received what appeared to be a mass email stating that production had been delayed by global shipping problems and costumer complaints. The shipping problems are understandable but the lack of communication was not. On October 19th I emailed asking whether it would be possible to provide an ETA for my fan based on Western Harmonics production schedule and my place in the purchasing queue. I received a follow-up email from ************************ on October 20th stating that my order was ready to ship. On October 21st I received a subsequent email stating my shipment would be delayed until the next or the following Monday. After receiving no communication or shipment I emailed ************************ regarding the shipment on November 3rd and again on November ***************. On December 1st I received an email from ************************ indicating that he was working on my shipping label. After another week of hearing and receiving nothing I again inquired of ************************ on December 6th.

    Business response

    12/16/2022

In response to the complaint, ************ has left out quite a lot of discussion, particularly any response to his emails.  His item has been shipped Via UPS Tracking Number:  1ZW783VT0320001219 prior to this complaint, and prior to its arrival in his possession.  Further this is another example of the results of the libel and defamation communicated by a third party online.   ************** pressure to ship and send was responded to as quickly as the business could do it.  Regardless of his lack of any consideration about the fact that his purchase is a PRE ORDER, part of an effort to overcome exclusionary practices in finance that results in no available funding in terms of lending to company like mine that manufacture solar powered equipment in ******, *******.  ************ choose to ignore pre order terms.  They can be found at this link and are required to be agreed to in order to purchase from my company.  These terms are written to protect not only myself and my company, but my customers that are affected when folks come in to exploit the situation to harm my company, its reputation, and etc. https://westernharmonics.com/terms Per pre order terms, per orders are a non refundable purchase and guaranteed to ship.  I have met the terms of this regardless of *************** choice to ignore the agreement at purchase and come up with own terms and demands.  And yes, he did win a fan in the contest last summer.  So apparently there isn't much that could satisfy him.  And honestly, I am not even sure he actually placed the pre order because he doesn't answer the phone or respond to my emails.  And when you do call his number there is a third party female that is on the answering machine with a different name.  Non the less, per the terms of pre order, this item is already shipped, and is a non refundable purchase.  This complaint is seeking a double dip of the item and a refund too.  The item has been shipped, and all pre order sales are final.
