On March 3, 2022, Kurbo Inc. and its parent company entered into a settlement agreement with the Department of Justice on behalf of the Federal Trade Commission Case 3:22-cv-00946-TSH.
The complaint stemmed from allegations that the sign-up process for the weight loss app marketed towards children encouraged younger users to sign up claiming they were over 13. It was also alleged that in 2020, although the signup process was revised, Kurbo did not put mechanisms in place to ensure the parental sign up option was actually being done by the parent. According to the complaint, Kurbo, Inc, collected the personal information of these younger users without the consent of their parents which is in violation of the Children’s Online Privacy Protection Act Rule (COPPA Rule).
Without either an admission or denial of the allegations, the settlement requires Kurbo, Inc. to delete the personal information from children under 13 that was obtained illegally. In addition, the company will destroy any algorithms that used the illegally collected information and will pay a $1.5 million civil penalty.
