The BBB Code ofAdvertising also states, “11.1 Where a savings claim (for example, “save up to40%”) covers a group of items with a range of savings, the number of itemsavailable at the maximum savings must comprise a significant percentage, at aminimum 10%, of all the items in the offering, unless local, state orprovincial law requires otherwise. 11.2 To avoid confusion or any possibledeception, an advertiser should consider including a disclosure of both theminimum and maximum savings available under the offer. In such an instance, theadvertiser must avoid any undue or misleading display of the maximum.”
