    We hired Southcoast Tax Resolutions in August 2019 to resolve our tax debt. We paid the entire $8.400 up front. We had trouble getting them to communicate with us until we threatened to file a complaint. Eventually, the owner, Ryan Bolrn, called. He explained that we would be in Non-Collectible status, and that we would negotiate an offer and compromise to resolve our taxes. He did get us into Non-Collectible Status. By early summer of 2021, we were hearing from the IRS that documents needed to pursue our Offer and Compromise were not provided. Repeated voicemails and Emails to Ryan were ignored. It was not until we filed a BBB complaint that he finally called us back. He assured us that he was taking care of everything, and that he had sent the IRS the documentation. At his request, we withdrew the complaint. Our Offer and Compromise was denied by the IRS for lack of documents. Ryan said that it was an IRS mistake, and that he was appealing it. We have not heard a word from Southcoast since September, 2022, despite our sending numerous Emails and phone messages. Last week we heard from the IRS that we have 30 days to file the paperwork to put our 2019 tax debt in non-collectible status. (Southcoast had gotten us into non-collectible status during the year 2019; and Ryan had written us that he would be including the 2019 taxes in the offer and compromise. Because nothing is happening with the offer and compromise, those taxes are now a huge issue.) It has been three-and-a-half years since we hired Southcoast. While we were pleased with being in Non-collectible status, the tax problem continues to hang over us until it is resolved. We have been ghosted by Southcoast. At this point, if someone can’t force them to finish the work, then we want a full refund, so we can hire someone else to do the work.

     We have discussed this several times in length regarding the case, the issue is that the IRS saw the bank account that has the large balance in it along with the equity in the house that disallowed the OIC from being accepted because the IRS shows that you can "full-pay" the balance. I need to express my disappointment in your actions in filing the complaint. We have gone above and beyond in protecting you from any form of collection action from the IRS and placing you into the Non-Collectible status and expressed to you that we would continue to place you into the non-collectible status continuously as a courtesy. You filed the 2021 tax return and incurred additional taxes and this is the reason why the account was taken out of the non-collectible status and in addition to that the offer would have been rejected for incurring additional taxes and being non-compliant. Again, we were NOT retained for an offer in compromise as evidenced with the retainer agreement that you signed stating that we were placing you into the non-collectible status and we went above and beyond to attempt the offer in compromise for you to get this settled permanently! Your complaint states that we did not furnish the requested information to the IRS for the offer and this is not true, we supplied everything that was requested, but the large balance in the account prevented the offer from going through! Furthermore, the IRS will typically mandate that you send in the funds to go towards the liabilities, but we were able to prevent that from happening and securing the funds for you. At this point, I feel that you have damaged the relationship with the complaint and as we would always continue to go above and beyond for our clients, your misunderstanding of the process and what we were retained for is extremely concerning to me as you file the complaint AFTER we have completed what we were retained for. 

    I understand that you stated in your email that you were not going to retract the complaint, but I am hesitant to continue to go above and beyond to place you into the non-collectible status with the outstanding complaint. Just as I understand your position, I am sure you can understand ours. We are more than happy to discuss this in more detail if you choose to.

    I am rejecting this response because:

    I have attached proof in the form of email communications we have had with R*** **** that he agreed to submit an offer in compromise 12/20/2019 and that he instructed us to liquidate Lisa's 401k account.  Additionally, I have attached an email communication in which Ryan also decided not to place our 2019 debt in non-collectable status and instead insisted that it be included in the offer in compromise.  Now that the offer has been rejected, we are left in a worse situation because the 2019 debt cannot cause our other debt to be removed from non-collectable status.

    In R***'s response he stated that our funds were taken out of non-collectable status because we owe a balance for 2021 taxes.  It is true that we owe a balance, but this is due to a type on our daughter's social security number.  We are in the process of submitting an amended tax return to correct the typo which will result in a refund.
