    Date of Transaction: January 18th 2023 Amount Paid: $600 Deposit for the purchase of a pure bred male puppy.The puppy was to be handed over around the dates of 28th or 29th of January. At this point the dog was be of 8 weeks of age , vaccinated, microchipped and ready to go. The breeder suggested we pick up the dog on the 27th of January as she had a doctor's *********** in ********, ******. We where unavailable due to personal commitments on that date, however we were available the entire weekend from the 28th thru to to the 30th to pick up our puppy.On January 26th the breeder texted us indicating that "I have someone else interested, I will just send your deposit back". On January 27th the breeder texted again stating " deposits are non refundable". The nature of the dispute is such that we would like to be refunded in full as the breeder did not honour her word nor obligations. We made an attempt to resolve this issue, upon which she refused.

    I take deposits to ensure that people are serious and that I don't hold a puppy and then people do not just say they want them and then don't take them.  It is non refundable.  I tried making several different times to make arrangements for pick up.  if you notice she ignored my other suggestion.   I still have this puppy and have not had another home for him as I had told the other inquiries he had a deposit on him.  those people purchased another dog.  

    As you can see I sent several requests for a different day other than Friday.

    I am rejecting this response because:I am rejecting this response because: It is clear from the text messaging that she provided that she had on sold the dog to another buyer. This is a clear breach of ethics by the dog breeder. Once she realised that her potential new buyer was no longer interested in purchasing the dog, she made demands that the deposit was non-refundable. Reading the initial text she sent it was stated clearly by her that she would refund the deposit. The fact that she initially offered the refund and then categorically rejected it as an option in a later text only strengthens the claim of misrepresentation in the context of the sale. She would have sold it to her potential buyer with complete disregard for our position and the fact that she held our deposit.
