    Rented from them from them for almost 11 years put down an $1800 deposit, including a $300 refundable pet deposit, I ended up moving out of said home and still have yet to recive any of my deposit back, and I know for a fact that 98.6% of any damage or repairs needed were what the state of colorado concider normal wear and tear, minus the scrap metal that i left in the back yard cause i didnt have the time or space needed to transport it or turn it in, andcthe couple yard bags of tide up trash, i stored in the basement agonst th outside wall, im scarcely thinking and continplating filing in *************** .

    Your deposit was processed in November of 2023. Your reconciliation was mailed to the rented home since you didn't provide a forwarding address. You will see that you still have a balance due with us. You will see in the attachment a copy of what was mailed on 11/1/2023. Your unpaid balance primarily consists of unpaid rent for several months & eviction costs. Please let me know how you'd like to care of your remaining balance.

    Of you read the deposit guide lines written into colorado state rule my deposit s for normal wear and tear on the home, not unpaid rental money, that might be owed.

    Security Deposits can absolutely be used for nonpayment of rent. Please refer to Colo. Rev. *****  *********

     

    (1) A landlord shall, within one month after the termination of a lease or surrender and acceptance of the premises, whichever occurs last, return to the tenant the full security deposit deposited with the landlord by the tenant, unless the lease agreement specifies a longer period of time, but not to exceed sixty days. No security deposit shall be retained to cover normal wear and tear. In the event that actual cause exists for retaining any portion of the security deposit, the landlord shall provide the tenant with a written statement listing the exact reasons for the retention of any portion of the security deposit. When the statement is delivered, it shall be accompanied by payment of the difference between any sum deposited and the amount retained. The landlord is deemed to have complied with this section by mailing said statement and any payment required to the last known address of the tenant. Nothing in this section shall preclude the landlord from retaining the security deposit for nonpayment of rent, abandonment of the premises, or nonpayment of utility charges, repair work, or cleaning contracted for by the tenant.

    Violating ******** law. Advised refrigerator was not properly cooling. Company didnt send out a tech for 6 days to check on the fridge and I am still without a fridge or an estimated time frame for receiving a working refrigerator. I have two minor children living in the home and the company is fully aware.

    No laws were violated. Resident submitted a work order after hours on 5/19, notifying us that her fridge wasn't properly cooling. The next business day, the work order was sent to a 3rd party appliance repair company. The repair company scheduled directly with ***** to visit the home on 5/25 (3 business days later). Once the tech was able to evaluate the issue, it was determined that the unit needed to be replaced rather than repaired. Once our office received notification that the refrigerator needed to be replaced, the owner of the property was notified so the purchase could be made. A new refrigerator was ordered but cannot be delivered  until 6/03. A rental refrigerator was provided to the resident and delivered on 5/26.
