  Hired to build a custom Pergola, using ********** pro-referral option, this is not a company it's one guy working out of his SUV. There is no office, his web-site is not accurate. The work is very sub-standard, many missed cuts leaving gaps and open cuts, the entire roof system is scrap as is the built in shelf. The sunshades don't fit nor do the decorative panels. Left the jobsite in terrible condition with my concrete slab splattered with stain. He did not allow us to do an inspection of the work site per the contract, he only sent an invoice. We were not home when he finished the job because it was the sixth day of the project he estimated to take only "a couple days". We had a dinner reservation and had to leave....never saw him after that and he will not come back as we have requested.

  There is a lien filed against the house for this issue and a cease-and-desist to remove all negative complaints already filed with the courts if this is not dealt with within one business week there will be further legal actions outside of the  remaining final payment that you have not paid. We will be seeking damages for Bible and slander as we have photos of every part of the project as it was when we left it. And nothing that you have complained about worse things that would not have been dealt with if you did not refuse to let one of our workers back into the job site to finish some small details after paying for the work rendered. Instead you chose to hire or bring in a different Contractor whether you feel like it is or not if you read the contract and intellectual property rights is a breach of contract . Once again if you do not remove ****** Better Business Bureau and every other negative complaint you have made we will start a lawsuit. You need to stop trying to force us to respond through different complaints and talk directly through our lawyer

  I am rejecting this response because:
  After receiving an invoice, I made a reasonable offer to settle the issue.  ******************** from the company, I did offer to let him come back and fix the major issues with the Pergola with an appointment.  I did not hire anyone to bid or complete the project!  I merely asked someone's opinion on the problems I had question about.  I have informed the contractor per the signed contract I welcome the opportunity to settle this using binding arbitration.

  The complaints about the solid material screens are void as this is the item selected by customers and would require additional charges on a change order for altered scope of work. The other screen was installed as per the contract, any change in color or size would also require a change order. The cuts for fitting the screens could be altered from 90 degrees to 45 to look more subtle however it is not required by the scope. We have plenty of photos of the table and it had no unusual features, if a gap where it was attached is present it would be covered by trim requiring a different change order. We do not have any requirements to add any additional change order for customers who have not been reasonable about timely payment. A lien has been issued and that is not going to be removed until the payment is made or the police auction the property.

  I am rejecting this response because:
  Most everything in his response is either completely false or misleading, we had no input for either the shades or the decorative panels!  We did show him a photo of what we had in mind but per his email he "found something different".  I have not only pictures (which I'm pretty sure he doesn't) but I have the so-called finished product.  Again, per the contract binding arbitration would be the best way to resolve this, I would entertain a reasonable offer to get this settled.  If a lien has been placed on the property, I have ample recourses to defend my property.
