    I hired Sam to build a fairly complex elevated deck to also support a hot tub. He asked for 10,868 down. He stated in a text this was to purchase material, he explained how he’s a small business and needs that. I paid. A month later he started and gave reasons for not purchasing the material. He started on the concrete footings and placed them 8’ off of the drawings we agreed to. He acknowledged that but said it would be ok. Later he missed his first deadline and I had a crane scheduled that I had to pay $950 to set the tub but the deck was not finished. The night he poured the concrete footings it dropped to 16* here and Sam left the concrete unprotected. Upon examining them 3 days later they were flaky, I also noticed they were less than 4’ apart. The hot tub pad was 8’ x 8’. I did some research on footings for elevated hot tubs and the calculations suggested much larger than the 10” he placed. I re did them myself because of the spacing, size, frozen material and wrong location. Sam then attempted to use non treated posts to place on top of the footings even though in his agreement via text he said this would be treated. I offered to pay for treated posts so I did. Sam placed and cut these posts 18” lower than the opposite side. He ended up purchasing new posts placed them a few days later. When I came home and he was there I immediately noticed the deck was unlevel. He disagreed even after I placed my 4’ level on it and showed him the deck was 4” low on the back side. He didn’t seem to understand and tried explaining to me how it was fine. I also measured the squareness of the deck and saw it was severely out of square. At this point I decided Sam might be past his skill set and since he had not purchased the materials either I decided to terminate our contract due to his performance. I do not trust what he’s built, his judgment on calculations or his financial ability to finish the project. I asked for a refund which he will not provide.
