J&K roofing was contracted with to replace my house roof due to manufacture defective shingles. Work was completed 2/28/24, city inspection done 3/30/24. I gave the site manager a list of minor items that needed to be completed 3/1/24. Some of the items were completed 5/21/24. There are two items remaining that have yet to be completed after numerous emails, texts, phone calls to site manager and his manager *****************. They are #1 - there was one broken gutter and in other gutter spots that have been pushed away, and down, from the soffit/fascia edge. These were all fine, running properly, and now they are not. There is also paint missing in a few spots, showing black where thrown shingles hit gutter edges. #2 - tv antennae needs to the straightened & tightened. #3 - the billing amount for the plywood underlay is incorrect from quoted price. I would really like to wrap this project up but won't be paying the final bill amount until I am satisfied with the above corrections being completed and while I am there monitoring the work.Initial Complaint

Original contract was for $16K. "supplements" were submitted for a total over 57K.This for a small single story ranch. This is FRAUD and MISREPRESENTATION. This roof was previously shingled showing 29.25SQ while the "supplement" now shows 47.3.This is fraud and total misrepresentation by the saleman ******************* and fraud by *****************.Business response

Hi,
Our supplement department made a mistake entering *****'s square footage data that impacted her initial supplement total. We would have corrected the error before the supplement was finalized (see attached). For example, her initial supplement tear off number was corrected from ***** Squares to ***** Squares. A supplement is a common process with insurance claims. We understand her concern, and take responsibility for our clerical mistake. This is not fraud or misrepresentation. This was a clerical error that would have been corrected prior to her insurance claim being approved.
For clarification, her insurance claim had not yet been approved. Her claim was in the middle of the supplement process. We don't order any materials or schedule a start date, until the insurance claim is approved and reviewed with the customer. We do not request any type of payment on residential re-roofing projects until substantial completion of the roof install. ***** decided that she did not want to continue the process of supplementation, and stopped mid-process. She has been released from her initial contract and is under no contractual obligation to continue to work with ******* Roofing. I do not believe that her requests to remove our A+ rating, or restitution are valid.

I am rejecting this response because: 1 line item was addressed. What about the remaining 21 items which are ALL based on fraudulent data. Secondly, your supplement was submitted to my insurance carrier and 37k of it was approved by them AGAIN BASED ON FRAUDULENT data. ******************* stated, when he was at my house trying to justify the 57k, that they knew the full amount would not be approved but would accept the amount approved by the insurance company and insurance checks had already been issued. This roofing company's initial estimate was 16k which was a lure to get me to sign with them. This is total misrepresentation on their part and then they falsify data to insurance companies to get the largest payout they can possibly get.The fact that ************ tried to justify $57000.00 shows me that they knew exactly what they were trying to pull off and I wonder how many other 70 year old women they have ripped off in the past. This matter is NOT RESOLVED.

I see *****'s response. It's listed again below. Regarding her note about the 21 remaining items -all items tie back to the square footage number. A correction of that number updates the entire estimate. Here project manager walked her through the very common supplement process with insurance claims, but it does not appear that it was understood. If she had gone through the entire process, the clerical error would have been caught prior to her insurance claim being approved by her insurance company. This is not fraud, misrepresentation or any type of smoke and mirrors. The insurance claim has not yet been approved by her insurance company as she stopped the process. ******* Roofing is an established roofing company that has a proven track record of providing trusted roofing, windows, siding and solar services to homeowners and business owners. I am rejecting this response because:Again she is wrong. The supplement was submitted by them, to my insurance company and approved for $37742.90 on 9/28/23 based on their falsified data. My insurance company had already paid $10553.51. An additional check for $16858.06 was issued on 10/4/23. Luckily both checks were made payable to me and my mortgage company. I have no doubt had they been sent to this roofing company, no corrections of their supplement would have been made and they would have happily walked away with a nice profit. Going from a contract showing $16181.26 to 57k or even 37k absolutely is misrepresentation and a sales tactic this unethical company uses to sucker people into signing up with them. The fact that ************ came over and tried to justify the 57k and state they accept what the insurance company pays, again shows me how they do business. These are NOT minor errors that were made and no one including ******************* bothered to question how you jump from 16k to 57k for a roof on a small single level ranch. Prior to submitting claims to an insurance company, you would think someone at this roofing company would learn how to use a calculator and take responsibility for their actions.

We have tried sincerely to answer your questions and explain the supplement process for homeowner insurance claims. However, you seem to be struggling to understand it. We apologize for the clerical error in the first supplement. This was corrected in the second supplement, but you were no longer under contract with us at that time.
Regarding payment, insurance claim checks are typically not sent directly to the roofing company. They go to the homeowner. This is outlined in the information provided to you by your insurance company. The homeowner is then responsible for paying the roofing company based on their contract. There is no contractual obligation or any money that is due or that has been requested of you or paid to our company. We would be happy to answer any additional questions. Im sorry that you were not happy with our company, but this is not fraud or misrepresentation.
