    Hired Restore all, Jude D***, to grade out driveway, put down road base as needed and lay 3 ½ hot mix asphalt to our large driveway on Monday,11/13/23 and paid him in full for the work (Check #*** for $16,500). The work was to start on Tuesday 11/14 and be completed the same day. We felt confident hiring him because he had completed the same type of work at 3 other neighbors, that we knew of. Jude D***, owner, deposited the check right away. On Tuesday his ETA was 10:30am but texted that one of his trucks had a tire problem and they would be there at 11:30am. Upon arrival, he asked for more money as the area was larger than he had estimated. ***** walked the property with him and confirmed the work to be done. We agreed on a price for the extended area via text. At 4pm he texted that the job was going slower due to a problem with a machine. At 6pm they were still working in the dark and then a couple of machines broke down (turned out they let them run out of diesel). They were here trying to load the spreader on a flatbed until 8ish Tuesday night, but weren’t able to. I talked to him that evening to ask about a Plan B because we knew the local asphalt plant would be closing for the season on Wednesday. Jude was supposed to meet us to discuss at 8am on 11/15 but texted that AM saying he needed to get parts for the broken-down paver. In addition, the property was left a huge mess with asphalt piles and poorly laid asphalt without road-base underneath. He agreed the work needed to be re-done properly. Then there are several texts back and forth about why the equipment hadn’t been fixed yet but he promises to get the job done. No one showed up at all on Wednesday and his texts stated it was because equipment was still being fixed. At 3:37 pm 11/15 he texted, when prompted, “If we r not going out there in the right direction by tomorrow afternoon I’ll reimburse u until it’s complete”. Thursday’s text came at 10:50am saying that another machine would be here about 1:15pm that will rip up the bad stuff and get a new grade on everything. Thursday morning, *** ******* ****** showed up to tow the paver around 11:30am along with a couple guys representing Jude. I tried to stop them from taking the equipment so that we at least had it as collateral. The ***** ****** were called on me and I was reprimanded by ******* ***** as the equipment was on an easement so I had no right to block them from taking it. According to Jude, no one would come to our property to do the work because of that drama. At 1:21pm he said he was coming over to talk to us and then we later received a text saying he had to go get a new CDL driver in Gunnison. Told him he can just refund our money and he said he had his CPA lady working on getting money together for us at 2:18pm. He went silent for several hours and at 6:54 pm, (after no call, no show), text was received at 6:54pm stating he would be here tomorrow and have the work done by Thanksgiving. In the meantime, we discovered that the skid steers being used at our property belonged to our neighbors, ** ***** & **** ***** (loaned to Jude by **** ***). Jude had performed work for all these guys and being the nice guys they are, they loaned him equipment. Ed’s skid steer was supposed to be borrowed for a couple of hours but the crew ran it out of diesel so a mechanic had to come work on it. On Friday, I texted Jude at 7:07am asking about what time he would be here with his crew and he responded at 11:16am, “Yes mam I got put n hospital last night I’m getting out n just a bit my guys r picking up trailer to load big loader n head there”. I expressed my worry for him and so he went into further detail that he had a blood clot about a month ago and couldn’t breathe so they think he had a silent heart attack. He went onto say that he felt better and was just waiting to be released. At 2:35pm I texted him that his guys still weren’t here and asked for an update. I followed up at 3:32pm that this was stressful for our family and requested at least half of our money returned. Jude responded at 3:35pm, “Yes if I’m not out today I’m going to have my nephew drive a check over”. There was no response to texts the rest of the day so I texted at 8:25am Saturday 11:18am. He responded that he was back in hospital for a procedure for blood flow and he will be release tomorrow and his guys will be back Monday or Tuesday. According to him, his guys won’t show up without him because they are intimidated by us, including his nephew that was going to deliver the money Friday. I’ve also texted with owner of ****** * ********, and he is owed $5800 by Jude and has been ghosted for about 3 weeks. I continue to text with Jude in hopes that he finishes the job. The contract doesn’t not have a timeframe on it, and it is hand-written and laughable.

    Hired Restore all to remove gravel driveway and install a chip seal driveway as they were doing 2of our neighbors driveway. Jude D*** the owner requested half down$4,500. He immediately drove to Aspen and cashed our check. They tore up our driveway and said they would be back Monday. After 3 weeks I got them to return. They spent 4 hours removing the rest of the gravel from the driveway. They have not been back since. Even after daily phone calls where he says he has equipment issues and is waiting for a part. It’s been 3 months and has not returned. I went to the address on the contract 2923 North ave Grand Junction CO and found a vacant building.
