    Hi BBB, The details requested are in the attached file labeled "Timeline and Documentation." To summarize, on 18-May-2023, I contracted Russell Builders to complete the Scope of Work as defined in the attached PDF titled "Initial Scope of Work." This contract is also included in the PDF titled "Contract between Homeowners and Russell Builders." $8000 was paid from myself to Russell Builders in the form of a check on 18-May-2023. The issues are as follows: 1) Russell Builders have breached contract by: - Not having started work on or near the contractually agreed-upon date of or around 18-May-2023 (work actually began on 28-Jun-2023) - Consistently acting in bad faith by: -- Consistently changing who will be doing the work at their home -- Providing false guarantees of when the work will begin or end -- Approving work outside of the initially agreed-upon scope of work -- Blatantly lying to homeowners on reasons for delays and on submission of supplemental documentation to NBIC 2) Russell Builders approved subcontractor STB Handyman to perform work outside of the agreed-upon scope of work without approval from insurance: - Replacement of support beam in sunroom area - Removal and discarding of all siding on house fascia (beyond what was in original scope of work) as well as additional house framing, insulation, plywood, and more external house - Removal and discarding of master bedroom windows Proposed remediation: 1) Russell Builders refund the $8000 deposit paid by homeowners less what work has been completed under the initial scope of work 2) Russell Builders compensate homeowners for the costs to repair their home for the work Russell Builders approved and that was completed by STB Handyman that was no included in the agreed upon scope of work If helpful, I am happy to discuss over the phone or elaborate over email.     We had a water loss at our home and signed a contract with R****** Builders LLC., to rebuild our playroom. The date was 7/26/2022. We gave Todd R****** $3,500.00 to complete this job. The completion date on the contract was 9/26/2022. He never finished the job. He wouldn't show up at the job for days, never called. When he did come it was excuse after excuse. The job that was done was deplorable! He only put one nail in the trim over the windows and thus it fell, only put one screw in the railing going upstairs and I almost fell down the stairs. The so called paint job was just awful! His subcontractors only came 3 times due to the fact that I was told he never paid them. He screamed at me one day after I pointed out his horrible paint job and as he was screaming he was breaking sheetrock up with his fists. He had a verbal fight with my husband. He walked off the job in October and never returned to finish the job. He promised us the world and we got nothing! He breched the contract by not finishing the job and my husband had to correct all his errors and we paid for materials out of our pockets. We are now asking for some help with this matter and we want what we paid him back. We have all documentation and pictures to back us up.

    Gentlemen:  I just received an email from your office stating that this complaint was closed due to the fact that I did not respond.  I never received anything from you until yesterday. If you are basing it on the letter that he sent to you let me say this that is filled with misinformation!  Mr. R****** broke the contract.  We never intended to keep any of the insurance money and I have all checks to prove it.  I was the one who informed him that the ******** reported their findings to the State that asbestos was detected and that it needed to be resolved.  After the abatement who I might added were totally professional, he did not start right away.  It was excuse after excuse and I have my text messages to prove this statement.  The work that was done by him was absolutely awful.  Moldings only attached by 2 nails, plaster never sanded, closet door put on the wrong way, paint job loaded with holidays, molding over the stone fire insert fell down and railing to go upstairs only had 3 screws holding it to the wall.  I could go on and on.  I have all the photos to prove our claims.  As far as 4 subcontractors walking off the job, that did not happen!  I brought them water and snacks when they were here and in fact the last day when one came to fix the flooring that was not done correctly, he was telling me that Mr. R****** has not paid neither him or the other 2 subs and that he had no money.  He was picking up his children to go to the airport to travel to his home country so I gave him cash to get some gas for his truck.  As far as my husband telling him that I was having my arm amputated, my God, I had shoulder surgery, how did he come up with that statement!  No one did a walk through nor did the adjuster see the work.  Mr. R****** nor anyone else ever came back!  We and I can't say this any plainer, DID NOT KEEP ANY Monies from the insurance company!!!!  Mr. R****** told us repeatly that he knows how to work the system!!!  I hope that no one else goes thru this like we did.  Job was supposed start in July and believe it or not was not finished by him.  My husband had to finish the job and fix all the mistakes that were done.  For a job that should have only taken a couple of weeks, he stretched it out for four plus months and my husband had to fix everything.
