    Hello BBB,We hired Vinnie Painters, LLC to paint an addition to our house, interior and exterior, as well as part of the interior of the existing house.The total quote we agreed to with Vinnie Painters was for $9,000. Vinnie (the owner) came to paint the exterior of the addition and he left it incomplete and he decided to wait to finish the it in the coming weeks when he came to paint the interior. At this point we paid him $2,500. When it was time to finish the exterior and start the interior, Vinnie Painters sent a group of painters that were not part of his normal painters, Davidson and Valdir. Vinnie called me to explain the he was too busy to do the job, but that ******** and ****** would paint the house and we should pay them directly. We added small details to the scope of work but they were never executed nor paid, for a value of $700.We observed that these painters were using a poor quality paint (one we didn't agree to in the contract) , which was not covering adequately the surface, not preparing the walls by sanding, and using flat paint on carpentry that damaged the wood grained texture. We called Vinnie to complain about the quality of the work and ask for help, and they abandoned the job. At this point, we had paid them $7,000 but there was proportionately much more painting left to in the house. Vinnie came to our house to see the job, he said that he hardly knew ******** - during this visit he took notes on the remaining work and confirmed to us that ******** should either return the money or that Vinnie Painters would finish the job for the contract price. We waited two weeks for them, but they never came. At last Vinnie told us to hire someone else and he would talk to ******** to return some of our money, we think $2,000 is a fair amount given what's left to paint. ******** has the money but Vinnie Painters is responsible as our contract is with him, he sent ******** as part of his team. He agrees we overpaid but won't complete the job.

    Yes, the attached contract was initiated by Vinnie Painters LLC, we finished the exterior painting, for the amount of $2800 as stated in the contract, but I received a check for $2500! approximately 2 weeks after finishing the external painting, I sent 3 painters to start the internal painting, Valdir an excellent painter with more than 10 years of experience, **** also with more than 10 years of experience and ******** who had known less time (never said I barely knew ********). The client then began to add more work to the scope of work, negotiating directly with ********, in addition, the client made payments directly to Davidson. the only payment I received was $2,500 for exterior painting, which was perfectly finished (I have a copy of the check) After that, the customer is demanding that I return the amount of $2,000, how am I going to return something that I didn't receive? If she added things and was negotiating directly with ********, why now does she want to hold me responsible for that? do a quick search online and you will see that I have no negative reviews or complaints about myself or my company!

    I am rejecting this response because:

    On Sunday, September 3rd, Vinnie confirmed that he would be coming on the following day to continue painting, but to my surprise, he sent ****************************** and **** to carry out the project for Vinnie Painters and he called me by phone specifically to tell me that he could not come, but that ******** would be in charge, and he asked me to write a check to ******** directly for the painting services. I had some doubts about this procedure, because I hired Vinnie, not Davidson, but Vinnie insisted that I write the check to Davidson directly, and he sent me a text saying that he would send me a receipt for the payment just as it were Vinnie Painters.

    It is clear that the problem is between Davidson and Vinnie Painters, but the person that I hired to do the job is Vinnie, and neither of them executed the job.

    I hired Vinnie back in 2020 to paint our house and the was pleased with the experience. For this reason, I called him again and I understand that he is having a dispute with one of his partners, but he is ultimately responsible for the contract and for the people that he sends in the name of his business. 

    I have paid $7,000 to Vinnie Painters for this project and Vinnie came to my house and corroborated that the work done was not worth that amount, given that much more was needed to finish the job. Now he is saying that he didn't receive the money, but he instructed me to pay ******** (who acted in the name of Vinnie Painters to execute the project at our house) who has the money. It is a problem he needs sort out with ********, and ultimately, he needs to reimburse me for the overpayment.

    I am sending the four checks that I paid for the project that I hired Vinnie Painters for, and these checks total $7,000.

    As Vinnie Painters has confirmed, he sent ******** as part of his team, and I have evidence that Vinnie told me to pay ******** because he was a representative of the firm who was executing the painting contract signed between Vinnie Painters and me.

    The checks where paid to Vinnie Painters, to execute the contract with Vinnie Painters and as Vinnie Painters requested. Vinnie the owner asked to pay ******** directly as a representative os the company. And I have written proof and this has been confirmed. The company is responsible for its affiliateds and.

    The checks were not paid to Vinnie Painters, as can be easily proven by the checks sent to BBB by the client **********************, Vinnie Painters Does not request payments from third parties, even if they are employees, the check was written to ********, who was never a representative , partner or owner of the company Vinnie Painters.

    I am rejecting this response because:

    I have a text message from Vinnie telling to pay Davidson, and offering a receipt for the payments made to Davidson. ******** came to our property to complete the project for Vinnie Painters without previous notice or agreement with us, as I never called or knew Davidson and he was sent representing Vinnie Painters. As the business has confirmed in one of the messages, he sent Davidson and Valdir as painters to complete the project for the company.

    If you continue to deny responsibility, we will have no choice but seeking legal action.
