    On July 7, 2024 I transferred $2,090,00 by VENMO to the owner of Tree Tops Service to remove a tree, replace sod and plant a date palm in fromt of my house in *******. Used VENMO becasue he said other methods weren't working. He never even started the job. I do have a quote and a string of texts showing all correspondence and excuses for not starting. Now I learned he is in ******, I have requested a refund by text and wil be mailing a letter with the same request before taking legal actrion.

    On December 7th I messaged ************************* about taking our tree down after we had to have a our main sewer line replaced due to the tree root that damaged the pipe. He quoted $3,800. Asked for $1,520 up front to get supplies in order to do the job, but apparently he lost his Quickbooks debit card so he wasn't able to access the money that we sent thru Quickbooks which is what we paid him thru because he sent us the invoice using Quickbooks. We were waiting on a loan to pay for all the work we had to have done to our house so we couldn't pay him the rest until that was received. He asked us to pay him the rest using Venmo or Zelle or Cashapp because he didn't have access to the first payment for awhile. He has come up with every excuse under the sun for not coming out to our house to take our tree down. I've asked for a refund multiple times. In May he accused me of breaching a contract because he was scared I was going to take him to court. I should. If anyone is breaching a contract it's him for taking our money and not completing the service. I've done nothing wrong except give him $3,800 up front and a lot of time wasted going back and forth. He has used the excuse of, our pipe was fixed so now he can take his time coming out to take our tree down because roots don't grow that fast. July 2nd he posted a message about selling his business and moving back to ******. I sent him a message with the screenshot of his post and he came back to say he would be finishing all of his pending jobs. I have all of this in writing over ******** messenger. I just want our money back so I can pay a reputable company to come and take care of our tree.

    Please do not use this company! He (****) quoted $550 to cut my tree in the backyard, and asked me to pay $250 initially. I paid $250 first. Then he scheduled three times to come but every time he had a reason of not coming. Now he doesn't response to my texts or calls. He just took the money and ran away without doing anything.

    Contacted ************************* at Tree Tops Tree Services LLC for proposal to trim tree branches hanging over my neighbor's property and to clear a violation issued by the ***** We agreed on a price on Jan 3rd and he requested an advance Venmo payment to be placed on the schedule for January 8th. I didn't mind sending the payment because it's local established business with a lot of reviews and I thought the Venmo payment was protected. I requested receipt for the payment and he hasn't emailed it. The service was rescheduled multiple times( January 10th, January 13th, and January 15th) and he never showed up to the property or gave me a heads up that he wasn't coming. He has stopped answering text messages and phone calls. He has ignored my Venmo request to refund my payment.

    Scam artist. Please do not use. Called for a quote and guy showed up willing to do the job. Quoted work for two trees and got payed for both and some. Did one than left stating " need to get my kids at 3 pm." Next day got " candy and coffee hand delivered by same guy, who is the owner, the only worker in this company and willing soul to do ultimately anything for free. Payed him 500$ ahead of time ( after that incident rather shoot myself in the foot than pay anyone ahead). He also showed up to clean my AC outside the house which I did not ask to do while I wasn't there. Mind you asked the guy that all I care is the second tree. He stopped by to confirm what branches to cut for the 4 the time but stated that he needs to help a broken down guy on the road. Than next time excuse was that person he did work for asking to stay and do more stating " yey more money for me." cool not like I payed you money just never got work done. Than his kids got sniffles than he had dental appointment than he had sod in his truck than weather than he writes me " I have crush on you. I'll do anything for free. " I payed guy 24 of January. He's a scam. Don't use this guy for anything or do it your own risk. People who left him good reviews must be his friends or a few he did not screw up. use legitimate business. I need my money back or shut his business down. He keeps on doing it to people.

We do not have a Joshua on staff as petitioner states she spoke with "Joshua". 2. Petitioner alloted that she wanted half refunded when 99.9% of the job was complete. 3. Petitioner requested help with AC which we did do, while there to finish job of 3 very small limbs belonging to neighbors tree. Therefore postponing the work we were there to do. 4. Respondent did purchase outdoor coil cleaner for $40 dollars to clean the heat pump coils. 5. Petitioner wanted to be home for the finish trim alotining only small windows for service. 6. Petitioner said come on Thursday only to recant her appointment time for the up coming Thursday to cancel the job via text. Saying don't come to property prior to the upcoming scheduled Thursday appointment. Thus canceling the job. 7. Petitioner also inquired about AC work on the inside of her home. Sending photos and text in regards. 8. Respondent began to think Ms. ***** was hitting on him so he replied in kind as the Petitioner and Respondent lived at the same apartment complex. She accepted coffee and chocolate from the Respondent. With all the inquiries and requirements to finish .01% of the job remaining and the explicit instruction to not return to her property and the request of staff to just finish what she wants and be done with it she refused and demanded 50% refund and didn't compensate for the time and materials on the outside unit. We had no choice but to offer the .01% refund. She has demanded a cash app for $250. Which is unheard of. As is written so it is. I did not ask him to do my AC. I asked his opinion on the leak outside. He forced cleaning of the unit outside by buying the material and than ask me. I felt the guy forcing himself onto me to see the unit inside by saying " I'll pick kids up and I'll come see it." I refused him to come see it inside and hired a company called " nunez AC" to do it. Than we did not have to wait on the neighbours because limbs are on my side of my property. I only postponed a week because I was not sure he'll cut right limbs and after that he disappeared with his jobs. I accepted candy and coffee because I payed him for his job and a tip on top of that. In my country we accept gifts especially if that person might get offended. Not knowing his culture I did. Guy was hitting on me from day one. Told him I have someone at work and he kept on texting pictures of kids, cats. Told him not interested. I want him to complete work immediately on that tree on allotted time in presence of my friend and I. He hasn't completed all job. He said one tree will be 200 and other 250. I payed him 500. That is how other 3 companies quoted me prior to me hiring him. He's upset because he could not fulfil the job. I can give receipts of items purchased and Mrs. ******** acknowledges that I did a lot of work on her heat pump portion of her AC uni. This platform only let's me up load one text at a time so this is is very labor intensive. I am currently admitted in Orlando Health Hospital room 962 and don't have the receipst for filters and coil cleaners I purchased with my money to complete her work request for the AC. I do not consent to publicly placing these text in public but that's what you like to do so. Mrs. ******** had me working on her shrubs, grass, A/C units, leaf clean up. Mrs. ******** canceled and rescheduled many times. Mrs. ******** was talking to me on a personal level of her own free will. Mrs. ******** told me not to come. Mrs. ******** had given me verbal consent to fix A/C, grass, and Shrubs of which I did. Mrs. ******** refused to pay for all the work I did to her A/C GRASS AND SHRUBS She told me not to invoice her cause she wouldn't pay. Mrs ******** canceled the remaining .01% of the tree work but requested 50% of the money back because she had other expenses for home repairs and maintenance to do on her home. Mrs. ******** called me a con artist, a scam, threatened to file police reports, instructed me to not come on her property. Mrs. ******** was unstable in her scope of desired work to be performed. Mrs. ******** changed work plans and work descriptions so much that I was unable to continue to put her on the schedule per demand. Mrs. ******** was unstable mentally to deal with so I could not keep up with her ever changing mentality Mrs ******** slandered me and my business and part of her mental instability. Mrs. ******** lied about filing police reports about me being a scam artist, and many more things of insult and emotional harm. I am currently admitted in the hospital for an infection and I have to deal with the BBB a completely useless self made business that does not help mitigate any facts but rather extends the abuses of unstable minded customers wanting to rip off businesses. I never said the cost of one tree was $250 dollars and the other tree was $200 dollars but rather said when she asked to make payments she could pay one payment of $250 and another payment of $200. The remaining tree work is .01% of the work remaining. Mrs. ******** faltered in the contract saying "no she didn't want me to do the rest of the job several times I am invoicing Mrs. ******** for the work I did that she admitted in her text that I did a lot of work. I never broke any legal violations to warrant criminal charges. I never slandered her dishonestly like she did me. I was always trying to meet her scheduling windows and she always canceled and I continued to try and schedule a mutual time but she gave up and became rude and slanderous. I showed willingness to continue to meet her demands but she forfeited. I agreed to refund her the .01 % of the tree trimming work remaining but she tried to invoice me for 2× $250 dollar cash app request. I told her I can not issue business refunds through my personall cash app. I am not a bad person or a bad business I don't rip off people but also I don't let people rip me off. It is clear in Mrs. ******** statements that she was happy with me and my hard work and services because she not only paid the invoice but she also tipped me. I am submitting the other two invoices for work done on her property and for millage to pick up the air filters she acknowledged receiving but never paying me for and for the coil cleaner I drove 40 miles round trip to get that she never paid me for. I am still going above and beyond with trying to give her what she wants in these responses. I am willing to refund .01% of the $450 dollar invoice for tree services. Mrs. ******** even tried to get me to do more work in a tree that was already finished per her own statements. Invoice for coil cleaning product and filters labor and millage and time in route.
