The advertisement must clearly and conspicuously disclose any material or significant limitations of the comparison and the advertiser must be able to substantiate all claims made. BBB is requesting that Gutter Minds provide substantiation of this claim but did not receive a response.
Its website includes logos for Haag Certified Roof and Wind Damage Inspector, the Copper Development Association, the National Association of Home Builders (NAHB), and the American Institute of Architects (AIA). The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB. Gutter Minds did not respond to BBB's request that it provide written proof of current affiliation with these organizations.
Its website states that its gutters come "...with a lifetime guarantee." When using the term “warranty” or “guarantee” in product advertising, the advertiser must clearly and conspicuously include a statement that the complete details can be seen prior to sale at the advertiser's location or viewed on the advertiser’s website. When advertising lifetime warranties or guarantees, the advertisement must clearly and conspicuously disclose its intended meaning of the term lifetime. BBB requested that the business add the terms of its guarantee and add clarification of its use of the term 'lifetime' to its advertising. The business did not respond or make adjustments to its claims.
