I got to ************** at ******************************* on 11/01/22, to finance a car. Got there a couple hours before close. My cosigner is a trucker and is rarely available, he knew that. I asked about several cars, he said they were bad for working DoorDash and Uber. He refused to let me look at any other cars. We were trying to get approved for couple hours til he was almost closed trying to get us out w/o getting me a car when I needed one after telling me hes in no rush. So I settled on a ********************************* the bank approved a 21 month warranty where the deductible is 100$. After agreeing on the vehicle he said he wanted to do a oil change and put a new battery in. This was after paying for car and checking to see if it was fine by turning it on, and signing the paperwork etc... So Its after 6, I agree to return the next day to pick it up. He said the car was driving fine. I get there, I caught him tinkering with fuel pump and wires. He then gives me only the key and registration refused to give me any other paperwork except the registration, saying it's cause I owe him another 200$ towards down payment, I legally recorded him admitting I gave him the money and the car is mine and is fine. The car broke down before I even got home 9 miles away. Had to park car for days at a friend's waiting for a new fuel pump. That's when I legally recorded him. I have texts and messages with me and him proving cars been undrivable. He took car to fix after fuel pump only slightly fixed issue. Waited a couple days for the car, got it back with the same symptoms and found oil in spark plug well. Took it back after withholding paperwork still. "Fixed valve gasket". Didn't fix issue, and it started ticking. Finally got the warranty, just for them to deem that the car was undriveable since I got it. Mechanic shop said it needed a new engine. He has lied consistently and even said his mechanic covered the warranty which was false. And wouldn't put me in a new vehicle.

I am rejecting this response because:
I am rejecting this response because: 1st I have extra information since filing. And for 2nd the ONLY paperwork he gave me on the day I drove the car, on the 2nd, was the registration. I was constantly trying to get the rest of the paperwork. He withheld all the other paperwork until the 18th. I admit I overlooked the warranty that day assuming it was the car lease, which I never received. On his camera it will show when I received paperwork in court. And the car only had 236 miles in total extra since the day I purchased it on the 1, but left on the 2nd, not 400. Instantly a lie. And he never once said anything about a fuel pump otherwise I never would have paid for one. Also if he gave me the warranty like he originally said, I would have attempted to use it, which by the time he gave me the car warranty after it breaking down a couple times, the warranty refused the repair Deeming there were issues time of purchase. As seen new info I have. Also as seen in the messages I've asked multiple times for the paperwork, he refused to give me them over the phone, until I gave him the 200$ which was supposed to be for the rest of down payment, which he demanded after the 2nd repair, which turned into 270 for "tow" even though my warranty had roadside assistance. The fuel pump was changed properly with battery disconnected. He keeps saying disconnected wires and a fuse was blown because of a wrongly put in fuel pump which is false. there were no wires left disconnected. And besides, how is it on my so called bad repair on me, if the car never made it home on the first day. When he said the car was fine. And he was tinkering with said fuel pump the day I left on the 2nd. Already lost alot of trust for refusing to give me paperwork, and that. He claimed his mechanic covered the warranty both times which was false as I asked the *************** if it was ever used, they said I was the 1st. His camera will show exactly when he gave me paperwork, and I'll be having a attorney get ahold of that info. Also my car was sitting at metropolitan for 9 days from the 19th(tried getting ahold of home and as you see he responded after he closed, I even tried calling before he closed) until the 28th when I finally got a way to get it to a mechanic shop. I do DoorDash and Uber and 236 miles total, between me and him, certainly is a lot of driving apparently. And again not over 400 which is already proven a lie that he's spewing. Also he picked up the car from where my parents lived at the time for the 2nd repair cause again never made it home with the car. We saw oil in the oil well, had him get it again, because again he never gave me paperwork because this was before the 18th. I got the car back, started having issues with a ticking noise and jerking with car and really bad misfires. He waited til later in day knowing I'm in *****, to get the car, by the time I get there, he was trying to close up ignoring my calls and texts the entire way there. So I made it home with the car and waited til the next day, he never responded until he was closed, after 6pm. I tried calling and texting. So tried getting car there at 5, no response, so I got car to metropolitan and parked it until I made money borrowing sister's car, so I can afford the mechanic shop and my bills. Got it there just for them to deny the repair due to them deeming issues with car at time of purchase. He told me thru text he's no mechanic himself, yet tinkers with a fuel pump that needed replacement on top of other issues, (a mass airflow sensor can have a temporary fix for a few miles with a cleaner btw, just like many other parts). Funny he's trying to hold onto the 1st repair, while failing to admit there was issues on the day I left in literally under 2 hours, and very little driving. And then lies about giving me paperwork which the court will see on his camera, and that the car was sitting far more than it was driving as seen by the odometer, and again a attorney will get the footage of car sitting at metropolitan also. On top of the legal recording I have of his. And he states he has reciepts of the repairs he made, thru a "mechanic" covered under warranty, yet never used the warranty 1 time thru him while holding onto the paperwork. I have proof of the car sitting due to issues, alot more than it was driving. And for a car that's fine it sure kept having all these issues with minimal driving after he said he did repairs 2 times. And it's hard to keep trusting him with the car when I constantly have issues with the car every time I picked it up. Which is why I wanted to get the warranty to do a proper repair. Something he obviously never did considering all the problems. Such as oil in the oil well after picking car the 2nd time. Just for the mechanic to deem it needs a whole new engine. Which a car that he stated fine, wouldn't need after barely driving 236 miles (between him driving it for "repairs", and the little time I drove it) that's very little milage for a DoorDash and Uber worker in 30 days.... He was at this point definitely masking a issue or sabotaging the car as I non stop had issues with it. So he can keep trying to grasp onto a lie about the paperwork and the 1st repair, but again he has nothing to say about the issues that arose from him having the car.
    Sincerely,

I am rejecting this response because:

I already paid the fee to the mechanic. They already called me today, 12/02/22, and said you still yet to get car. That's on you for it being there. Also, the car at time of getting to mechanic only had 236 miles. 400? I wish it even made it that far after 2 repairs that you said we're covered by the warranty. Nice try lying again though. And anyone knows if the car was driven for 30 days doing DoorDash and Uber,  the car would have over **** miles extra easy. And those 236 incude miles put on it by you and the mechanic between the time you had it for "repair". And I relinquished my rights to the car and am going to DMV to let them know the car is yours again and turn in my tag. And again the car broke down and stalled in less than 2 hours, never made a mistake with the fuel pump again, as the battery was disconnected, and it never fixed the problem. You lied about the warranty being used 2 times, lied about the paperwork, lied about saying the cars in good shape, gave car back to me in worse condition both times, and the warranty company deemed issues at time of purchase. Nice try with the lies though. The court will definitely prove you a fraud and a liar. The fact you are still ignoring almost everything I say, is proof. You also refused any help until I make a BBB complaint with info and proof of your failure as a dealer. You stated  "I never had any problems like this before" but a quick search for **************** under BBB says otherwise. Oh and the bank will find out how you do business when the case goes to court. I don't want you, a liar, who all of a sudden wants to help, even though you failed to provide a reliable vehicle at time of sale, as I literally didn't even make it home. And BOTH repairs YOU are responsible for as the car was a lemon, and again the warranty deemed the car had issues at time of sale. I gave up trusting you getting a nice car to me. As you failed every step of the way. And why should I trust you and your mechanic, the mechanic you claimed used the warranty that you withhold from me until the 18th, that never properly fixed the car cuz otherwise I'd still have it working. Oh and btw the car he sold to someone as I was waiting to pick up the car, I believe was a 2014 kia ***** was already returned days later. That wouldn't happen if even that car was "fine" also. Again I request my money back. I gave up trusting you to properly fix the car, or me in a nicer car, as clearly your trying to scam me again. Otherwise as I said, I'll see you in court. As it's clear your determined to be proven wrong. The court will also fix any problems against my credit, as I have proof you lied, and deem YOU owe them money, and deem I don't owe anything for the car. And  owe me money. Good luck. See you in court. Which even they'll bring up the consumer rights act of 2015.

    Sincerely,
