    In response to this complaint - We are handling this claim for ****, who took over the insolvent carrier ****** ******** * ******** ********* ******** The claim is for water damage to the kitchen ceiling and the upper cabinet trim. An adjuster went to their property and inspected the damages which came to $3,151.13. A check in that amount was sent to the ***** residence on 3/2/23. *** ***** contacted us a few weeks later and was concerned about being able to match the upper cabinets with the lower cabinets. We then sent another adjuster out to document the damages and prepare an estimate to replace ALL of the cabinets in the kitchen. I relayed the amount to Mr. and Mrs. ***** which after taking the policy deductible of $1,000, came to $16,706.37. They were happy with the new adjustment, so I sent them a release for that amount, which they signed and returned. I promptly issued the full payment of $16,706.37 on 5/12/23. The check was cut and mailed from ****'s office in *********** on 5/15/23. 

    When it was explained that the mortgage company was going to be included on the check, Mrs. ***** changed her mind and said she wanted to cancel the release. 

    I have since in been communication with Mrs. ***** to try and settle this matter for an even higher amount, even though they willingly signed the release. 

     

    I truly hope that our going above and beyond in handling this matter for Mr. and Mrs. ***** does not have a negative impact on ******* ****** ************ rating/reviews. I am sure you can see by the facts of the situation that we acted diligently and fairly in the settlement of this claim - as well as the reopening and supplementation of the payment.

    I am rejecting his response. *** ******* has been in contact with me and his new offer will only cover the cost of the cabinets. Not the removal and install of the new cabinets, the counter tops, the back splash, the sheet rock repairs, the plumbing and electrical work.

    I have attempted to contact barret claims management via phone and emails for the past 7 consecutive days and no response .My previous insurance company failed to pay my claim and barret claims management is in charge of payment reimbursement. Currently the property has severe damages to it which make it Currently uninhabitable .All I ask is for my claims to be paid since it was made in September of 2022

    The insured's son is represented by an attorney. We are not allowed to speak with him if he is represented. His atty has not responded to communication efforts. The insureds settlement check bounced as a result of their insurance company "AVATAR 'going insolvent.

     His complaint was the first we have heard that the check did not clear. His attorney only mentioned his outstanding attorney fees he is due. I called *** **** and explained that his claim is in litigation and FIGA also has an attorney. All discussions must go through the attorneys... he understands the legal requirements.
