    My husband and I went to Palenzuela Feed Pet Store to look for finches. *****, the owner talked us into purchasing ************* because he said they would make us a lot of money. He stated he would pay us $2500 per live baby produced. He stated that he had set up a lot of people with the birds and they were now his suppliers. He stated he would sell us each bird for $3000. He purchased 3 birds (2 males and 1 female) from *****. He stated that if it didn't work out or we changed our minds, he would reimburse us.(We bought a female from a private party to put with the extra male after consulting with ***** that the male he sold us would be a good fit because he "was wild.")After 3 months of not one baby, I checked in with *****. He stated we needed to be patient. Our female from a different source produced eggs, but no babies. The male and female purchased 0 eggs. I checked in with ***** at 6 months. He stated we needed to be patient. At 9 months I told ***** I wanted to return them and he agreed, but my husband suffered a major heart attach so returning the birds became less of a priority as I needed to nurse my husband back to health. My husband has recovered so on 12-16-24 I texted ***** to say we would like to return the 3 birds we purchased from him. He stated he would not. He called and I reminded him of all that transpired. He stated he needed to make money. I reminded him that we would not have purchased 3 unproven birds without his guarantee. He said he would only offer us $2000 per bird. ($3000 less than what we paid him.)We would like the $9000 we paid back. He said that "did not work for him." I stated we would accept $8500. He denied that. Therefore, I would like our original verbal contract upheld and the full $9000 returned to us in exchange for the three healthy birds.

    We are willing to receive $6000 for the pair of African Gray parrots who have never laid an egg. We will keep the single male, thus reducing the amount owed from $9000 to $6000.

    We at Palenzuela Feed & Pet are very grateful for our customers and treat our customers like family.  We take pride in always helping our customers to the best of our ability. We don't ever force our customers to buy birds or supplies. Our policy is "No Refund" unless the bird is taken to a aviary Vet with in three days, if the bird is found to have any issues they can bring that report and that is the only time we will refund. We have it posted in the store.  With that being said we do always try to work with our customers.  As a company  we can not pay the same price for a bird that we will sell it for.  We offered to purchase the 3 birds at fair price and even offered to purchase the other birds she had.  We are very sorry she did not accept our offer.  We have always tried to work with the customer. She has to understand we are a business, and we are trying to be as fair as we can.  If she is will we will buy the birds back at a fair price.

    We are not satisfied with the merchants response, but because we didnt record the oral contract, it seems like we are unable to pursue this further. Is it possible to leave the complaint recorded with the BBB so other, unsuspecting consumers can warned?
