    - Date of transition - we closed on the home on 11/6/23 - Amount of money paid to the business - $330,000.00 - What the business committed to provide to us - grounding all electrical in the home before closing - What the nature of the dispute is - I've attempted to reach out to resolve in May ******************************************************* breach as we have electrical outlets that are ungrounded. I was told Harmony Holdings Group will not assist and we bought the home "as is" yet we have an addendum contract signed and dated stating they would ground all electrical before closing on 11/6/23. We have sent them 2 quotes on ways to resolve the ungrounded electrical issue from an electrical company that we had to hire to resolve our first power loss. They requested all future communications be via certified mail. I had an attorney reach out with our requests to make right on our contractual agreements again via certified mail. Harmony Holdings Group and their lawyer will not engage in conversation, but only sent an invoice of their "repairs" for grounding electrical. The invoice is from an HVAC/Plumbing company...not electrical. We lose power often. Our outlets are still not grounded. - Whether or not the business has tried to resolve the problem - no, they refuse to communicate whether be owner or attorney.- If the issue involves advertising...- N/A

    Business response

    12/09/2024

We appreciate the opportunity to respond to this concern.

On November 6, 2023, the buyer purchased a property from Harmony Holdings Group. Prior to closing, the buyer requested that certain outlets in the home be grounded. In response, we hired a licensed contractor to complete the requested work. The contractor completed the scope of work as agreed, and we provided the buyer with receipts confirming the repairs. The buyer had the opportunity to inspect the repairs prior to closing and proceeded to accept the property "as-is" upon completing the sale.

Several months after the sale, the buyer contacted us requesting additional electrical work, citing ungrounded outlets. They provided quotes for rewiring the home and asked us to cover these new costs. These additional requests were outside the scope of the pre-sale agreement and pertain to issues that occurred after closing. At the advice of our legal team, we respectfully declined to assume responsibility for these new concerns.

As a seller, we have no control over what happens to the property after the sale is finalized. However, we remain confident that we fulfilled our obligations prior to the closing date. We regret that the buyer is dissatisfied and encourage them to work with a licensed electrician to address their ongoing electrical issues.

Harmony Holdings Group takes all customer concerns seriously, and we strive to conduct business with integrity. We believe this response adequately addresses the matter and demonstrates our efforts to resolve the buyer's initial request prior to closing.

Thank you for allowing us to clarify our position.

    Complaint: 22614010

I am rejecting this response because:

On November 6, 2023, the buyer purchased a property from Harmony Holdings Group. Prior to closing, the buyer requested that certain outlets in the home be grounded. In response, we hired a licensed contractor to complete the requested work. The contractor completed the scope of work as agreed, and we provided the buyer with receipts confirming the repairs. The buyer had the opportunity to inspect the repairs prior to closing and proceeded to accept the property "as-is" upon completing the sale.
    - We would like to clarify that we did not request that "certain outlets in the home be grounded." Our request was for all electrical outlets to be grounded (see attached photos from submission of this claim). This is the first instance in which Harmony Holdings has even acknowledged our request for grounding the outlets since we initially reached out to say this request had not been fulfilled. To be clear, we are not pursuing a frivolous lawsuit. Nor do we care to have counsel involved. Our position is based on the contractual agreement signed by both parties which stipulated that the all electrical outlets would be grounded by the closing date of 11/6/23. As of today, any qualified electrician can confirm that the home is still not in compliance with this agreement, despite Harmony Holdings' assertions and claims that it was by closing. I have documentation to support this agreement and it is important to note that nowhere in the contract does it state that we only requested grounding for "certain outlets. Please take note again, unequivocally, we requested ALL of the outlets within the entire property to be grounded.

    - Reiterating that we did not ask for anything that was not specifically requested before signing the contract. If the outlets had been properly grounded, we would not be here discussing this issue. The fact remains that we are in breach of contract because the services, including grounding the electrical outlets, were not completed before closing, as per Harmony Holdings' agreement through the signed contract. Our request was made before closing and the breach only became apparent after we moved into the home. The outlets didnt "unground" themselves; they were simply never grounded as agreed upon. We proceeded with purchasing the home because Harmony Holdings explicitly agreed to ground the electrical outlets and provided documentation that led us to believe this had actually taken place. After realizing that the work was not completed, we requested a receipt for any electrical work that had been done. On 5/15/24, we were told:
Harmony Holdings Group paid a licensed contractor to ground the outlets. I am sorry that your buyer is not happy with the repair, but they do not feel obligated to rewire the home as that was not the requested repair. Please send any further correspondence via certified mail to Harmony Holdings Group *******************************
However, no receipt was provided to substantiate this claimuntil our lawyer got involved. When our lawyer reached out to their legal counsel, ******* ********, we received an email stating: We have nothing to discuss, after their initial contact. Again, these are not new concerns. We were fully aware of the ungrounded electrical prior to closing per our inspection and so was Harmony Holdings which is why we were then requesting in an addendum that the electrical outlets be grounded. Had they declined to honor our request, we would have reconsidered our decision to purchase the home. Furthermore, the receipt we eventually received for the alleged electrical work was from ************************, a company specializing in HVAC, plumbing, and roofingnot electrical services. Yet they list electrical work on the receipt. To add to the confusion, the phone number on the invoice is no longer in service.

As a seller, we have no control over what happens to the property after the sale is finalized. However, we remain confident that we fulfilled our obligations prior to the closing date. We regret that the buyer is dissatisfied and encourage them to work with a licensed electrician to address their ongoing electrical issues.
    - On 12/3/24, my attorney received an email from ******* ******** stating that Harmony Holdings would be sending their contractor to our residence to assess the prior repair and that he would inform my attorney if there was any change in their position. This communication came only after multiple attempts by my attorney to make contact, as previously, their lawyer had stated that they believed there was "nothing to discuss." As of today, we have yet to hear from their contractor or from Harmony Holdings. It wasnt until we filed a complaint with the BBB on 11/27/24 that we received any response. Now, Harmony Holdings claims that "they take all customer concerns seriously and strive to conduct business with integrity." It is disheartening that it took reaching out to the BBB before we received any acknowledgment or action on their part.

Harmony Holdings Group takes all customer concerns seriously, and we strive to conduct business with integrity. We believe this response adequately addresses the matter and demonstrates our efforts to resolve the buyer's initial request prior to closing.
    - We believe the points outlined above effectively rebut this last claim made by Harmony Holdings. We are eager to resolve this matter without involving counsel, but Harmony Holdings has made it clear that this issue has not been a priority for them despite the signed agreement. Had we known they would not honor their contractual obligations, we would have chosen a different homeone more suitable for raising our then 2-year-old. Thank you, BBB, for providing us with the opportunity to have our concerns heard.

    Sincerely,

    ********* Brewster ******

We appreciate the opportunity to provide additional clarification regarding this matter.

Harmony Holdings Groups position remains consistent: we took steps to fulfill the agreed-upon terms prior to the sale of the property. At the buyers request, we engaged a licensed contractor to complete electrical grounding work on the property.

The contractor carried out the scope of work as outlined in the agreement, and we provided documentation of these completed repairs to the buyer prior to closing on November 6, 2023.

The buyer was given the opportunity to inspect the property and repairs, and they accepted the home and its condition upon completing the purchase.

We understand the buyers position that their request was for all outlets in the home to be grounded. However, our agreement and the executed addendum stipulated grounding within a specific scope of work, which was completed prior to closing.
As a seller, we are unable to guarantee the state of the home after closing, and we are not in a position to address changes or issues that may arise post-sale.

To further assist the buyer,we have provided the name and contact information for the licensed contractor who completed the work, so they may address any concerns directly. This demonstrates our continued willingness to assist within reasonable bounds.

We regret that the buyer feels dissatisfied with the outcome. However, we respectfully reaffirm that Harmony Holdings Group met its obligations under the terms of the agreement and the sale of the property. Any further concerns regarding electrical issues should be directed to a licensed electrician or the contractor who performed the work.

Harmony Holdings Group takes great pride in conducting business with integrity and transparency. We believe this response fairly and accurately reflects the actions we have taken to address this matter.

    Complaint: 22614010

I am rejecting this response because:

I would like to address a few key points regarding Harmony Holdings handling of the electrical work and documentation, specifically with reference to the items outlined in your previous response.

    - Provision of Documents: November 2024 was the first instance where Harmony Holdings provided any receipt or documentation regarding the alleged electrical work. Our contract clearly stipulated that these documents were to be provided before the closing date of 11/6/23. Additionally, I requested the receipt in May after discovering that the work had not been completed as claimed. Please confirm the exact date when these documents were finally provided, and clarify the method of delivery (e.g., email, text message, etc.). If we are incorrect in our understanding, we would appreciate your detailed correction.

    - Scope of Work: According to our records, the only work that appears to have been completed is the replacement of outlet covers. However, I would appreciate it if you could provide a clear and detailed description of the full scope of work that was actually completed by the contractor, as there seems to be a significant discrepancy between what was claimed and what was actually done.

Additionally, it is important to note that as of today, Harmony Holdings has failed to follow through on their commitment to have their contractor inspect the work which was promised two weeks ago. My lawyer notified me of this retraction shortly after receiving this latest response. This ongoing pattern of contradictions and unfulfilled promises continues to undermine any confidence that customer concerns are being taken seriously.

In light of this, I remain open to directly contacting the contractor to coordinate how to proceed, but again the phone number provided on the invoice is out of service. We will continue working to resolve this issue on our end despite Harmony Holdings recent refusal to assist or engage in mediation - as outlined in our contract as the next step in this phase of resolution.
