I am filing a complaint against Imagen Architects **** for failing to fulfill our contractual agreement and for exhibiting unprofessional conduct throughout our engagement. To date, I have paid $14,150 for engineering plans for a spa I am constructing in *****. However, despite repeated requests and significant delays, I have only received incomplete floor plans. The unresponsiveness and continual postponements by Imagen Architects suggest a lack of commitment to my project, resulting in substantial financial losses and potential damage to my professional reputation.

    Business response

    08/24/2024

Regarding case with ******************** ********** Miami, LLC

On July 26, we received a Certified Letter from ****** |******* an attorney at law stating they represent Mr. ********* Our response went out on the following three business days. See attachment (copied our legal counsel in the same response to his attorney we received response requesting the files we attached with all the evidence of this process) we did not receive any more correspondence or email from his attorney or *******************

After working with ******************** for several weeks finally we had a design he liked but back in December 2023 I went to a meeting with ******************* and Landlord in which Mr. ********* space for rent area went bigger and we had to Re-design the Space based on this change, by January 2024 we agreed on a design but later on February-March we redesigned again the layout which ******************** was very pleased with, as the first redesign (#2) had lost some of its appeal to match the landlords request)now with the lasts design #3 we had to reconfigure some of the Mechanical electrical and plumbing, structural slabs cuts and repairs.
We had visited the site on several occasions, but we had not been able to verify some conflicting information with the original existing plans of the building regarding electrical meters supplying the electrical panels. We were not granted full access to the property for this. Another point is the Approval from Planning and Zoning to dispense beer and liquor, this task had been arranged to another professionals by ********************, has not been granted as of this time ( this we explain *************** that would create a set of building documents not fully completed and without presenting the dispensers of beer in the reception area the spa rooms and the refrigerated storage for the beer kegs and the system to dispensers ,this would also be an issue with the approval of planning and zoning this would create a situation where you would have to change the use of the business and the later create a change of use and occupancy creating a fourth set of building documents.

Lastly we did go out there 4 final times no access was granted and the time the person left, We explained that when we have to meet with subcontractors /consultants it is not in our control to keep then on time or on schedule they got delayed and there was no other way to see what we needed to confirm. In every project we are granted full access for ourselves as well as for our various consultants.

To this day we did not get access and as for the information needed, and ******************* mentioned of sending previous existing documents that we had before that is exactly part of the conflicting issue as this plans are conflicting in the electrical service system
At this point Plans are 95% complete due to the above explained issues at site, we are waiting for Mr. ********* attorney to tell us how he would like to proceed.
