    Yudi Pools was contracted by me to install a pool at our primary home. The work has been completed and the permit was closed on 2/8/23. We received a final bill on 2/8/23. We received an email from their attorney on the very same day demanding payment for the invoice in addition to two others all dated within weeks of the present time. I stated I would pay the full amount upon receipt of a Final Release. They refused to sign without attorney fees included and they are threatening to *** me. They had no grounds to obtain legal representation when I never disputed their invoices.

    Dear BBB: thank you for the opportunity to respond to this BBB Complaint.  Please note that Yudi Pool Services Y Inc. ("Yudi Pools") contracted with ************************* for the construction of a residential swimming pool in her home.  Yudi Pools completed the construction of the pool timely and in good workmanlike manner all in accordance with the contract by and between ****************** and Yudi Pools. 

    The dispute began some time in the fall of 2022. Once Yudi Pools completed the pool, ****************** and her husband requested additional work that was  beyond the scope of the pool contract. Mr. and ******************* requested a 550 square foot patio paver deck, as additional work.  Although not included in the scope of the work, as a courtesy to Mr. and *******************, ********** agreed to delay the closing of the final permit (of which would have entitled Yudi Pools to the final payment at such time) and allow for:  a) Mr. and ******************* to revise the original pool permit in order to allow for the paver deck to be included in the original pool permit (saving Mr. and ******************* a great deal of time and money) and (b) assistance to Mr. and ******************* referring paver installers and materials directly with a third party.

    Yudi Pools agreed to provide this "extra" service, at cost, to Mr. and ******************* (meaning no profit to **********) so long as ****************** and ****************** paid the costs directly to the third party installers and paid for the extra $350 for the revision of the pool permit. However, once the additional paver deck work was completed, Mr. and ******************* avoided paying the third party paver installers, all together, and continued to ignore such third party's repeated requests for payment. After Mr. and ******************* refused to pay the third party laborers, ********** was left with no choice but to come out of pocket and pay the third party deck laborers, directly.

    By the time, Yudi Pools invoiced Mr. and ******************* in February of 2023, that invoice was partially for the reimbursement of what Yudi Pools had to come "out of pocket" to pay the laborers  in the amount of $4,350.00 and the balance was for the final payment under the Contract (of which Yudi Pools had agreed to delay so Mr. and ******************* could obtain their deck) as well as pool cleaning service. Time and time again ********** requested that Mr. and ******************* pay the deck laborers directly and each time Mr. and ******************* ignored the request. Then, in complete disregard of the contract, the applicable government requirements, and the arrangement surrounding the paver deck, Mr. and ******************* completely circumvented Yudi Pools and took it upon themselves to close out the pool permit all on their own (without Yudi Pools' approval), which further evidenced their intent to circumvent having to pay Yudi Pools the $4,350 reimbursement as well as the final payment under the Contract. Yudi Pools was left with no choice but to hire legal representation to protect its interests. Each time Yudi Pools requested payment, ****************** would come up with an excuse not to pay, including disingenuously claiming that they were unsatisfied with the work yet approving the very same work they complained about by closing out the pool permit all by themselves and without Yudi Pools.  Although Yudi Pools sent "invoices" to  *******************, invoices are not required under the contract were only sent as a courtesy to Mr. and *******************. Nothing in the contract requires the sending of an invoice or that payment is due any day other than at the time the services are provided.  Every time payment was requested, ****************** would repeatedly shoot back that he was a contractor in ********** familiar with "the law" and that Yudi Pools "would know who he is". Once legal representation was obtained, Mr. and ******************* made the required payments.

    Yudi Pools regrets the dispute with Mr. and ******************* had to occur; however, such a dispute is not common as Yudi Pools continuously strives to provide the best service and support to its customers.

    I am rejecting this response because:

    Ill start with Invoice-****** for $4,700.  This invoice is dated 1/19/23. We were only 20 days from receipt of this invoice. The invoice includes change order work which was agreed to by both parties however payment terms were not. Upon receipt of invoice we agreed to pay the full amount if it passed inspection since the work was not performed in accordance with our approved plan thus placing Yudi Pools in breach of contract.  The amount of select backfill was not to code and the pavers encroached the 5' set back requirement, again all of which were willing to look past and pay if it passed inspection.  On 2/8/23 it passed inspection and we notified Yudi pools that we were going to pay them. This amount was included in our request to sign a Waiver and Release Form we sent the very same day it passed inspection.

    Invoice-009061 was received 2/7/23 for the amount of $390.  This invoice includes cleaning fees for the last two months.  This amount was approved and both parties agreed this could be paid for by check.  That payment was sent in the mail again the very same day.

    Invoice-009069 was received 2/8/23 for the amount of $1,500. Per the contract Yudi Pools is due this amount upon the permit being closed.  On 2/8/23 the permit was closed and we notified Yudi pools that we were going to pay them. This amount was included in the request to sign a Waiver and Release Form we sent the very same day the permit was closed.

    Yudi Pools also refused to close out the permit.  By refusing to complete their scope of work they breached their contract again.

    We had a check dated 2/8/23 written for the remaining $6,200 and we would have will gladly meet them that day with receipt of the attached Waiver and Release Form. However **** pools hired an attorney that demanded I pay Yudi Pool invoices but also legal fees in the amount of $1250 within three days or they were going to sue ***************************************************************************

    I have been after Yudi Pool Services Y *** for the past 2 years. Attached I have shown proof of everything paid to them and messages in between us. My pool has not been finished and now its deteriorating that can cause injuries to anyone walking in the backyard. I have also attached pictures. All I want is for the job to be finished and fix any issues caused.
