    * Telephoned Business: First day inquiry 2/1/24 I spoke to a woman named ******************************* @ **************. Conversation included her explaining services and processing of paperwork/contract agreement. We communicated via phone, email, copy center scan, zelle/bank wire (my family's zelle account), and walk-in bank wire, to execute and initiate a contractual agreement long distance.* Transaction: 2/2/24 I wired $ ******* was posted via bank to Miami VIP Recovery, LLC's account. The services I agreed to were paid in full, except the mandatory IV Drip that is to be paid for after surgery at recovery suites site.* Miami VIP Recovery, LLC and ************************* had a contractual agreement.* 2/5/24, A. The only portion of the agreement that was provided, a driver picking me up from *********** and bringing me to the surgery clinic for my pre-op exam.* 2/5/24 I was required to fill out medical forms at clinic office. I reached out to ****** to obtain this information requested by the clinic and that's when the problem began. First, I began texting her and when I did not get a timely response I then proceeding to telephone her, and was unable to speak to her. Moments later she returned my call. As she spoke to me first her tone was disrespectful, demanding me to "only text her one time only", she was also reluctant and dishonest by saying put "anything" for the address required on the forms, giving me the wrong address. Her explanation for not answering her cell phone texts is that she was in the Dentist's chair and could not get to her phone. She stated that it seems to be a problem already and I have not even arrived to the suite yet, and we have to be around each other four more days, if it's like this, I should consider finding elsewhere to go/stay. Getting off the phone with ********* I was taken back in my feelings that she brought about making me feel i have been "had" and i now unclear on what i will do to assure my safety and stay. I filed a police report *******

    Attached hereto, please find a copy of the contract agreement entered into between *********************** and ******************************* d/b/a Miami VIP Recovery Suites, LLC (Miami VIP) on February 2, **** omitted from the complaint.

    Per the contract agreement, under section DETAILS OF PAYMENT, All sales are final.  No refunds of deposit or final payment will be issued. Under section TERMINATION In the event that Client desires to terminate the services of the Company, all payments are non-refundable and non-transferrable.  Under section CANCELLATION No refunds will be issued in the event the Client is hospitalized, chooses to shorten their stay, early departure or miss any nights. 

    ************** was made fully aware of the policies and procedures prior to booking with Miami VIP Recovery Suites.  ************** was unable to proceed with surgery on the scheduled date because she failed to obtain all required pre-operative clearances prior to surgery in the state she resides.  Therefore her original date was canceled and she failed to notify Miami VIP Recovery Suites in a timely fashion.  However, even though *********************** is not *********** a refund per the contract agreement, Miami VIP Recovery Suites reached out to *********************** on February 7, **** @ 3:47pm by way of email (copy attached) to offer a partial refund.  To date, ************** has failed to respond or comply.

    Telephone and text communication has been disabled by Miami VIP Recovery Suites due to Latifa ****** rude and demanding tone. We were unable to get in a word while she screamed and yelled through the phone, made insulting remarks and verbal threats if her money was not returned.
