    Dear **************:,
    I would be remiss if I didnt report one of your agents, *********************, for her poor performance in the selling of our home.  Her performance has made the last five months stressful and difficult.  ***************** signed us up with the supposed help from *****.  **** did not know how to sell outside of Water Oak/Sun Communities and we dont blame her for our trouble.  She has been above board with us, trying to help when she has to get advice from ***** who seems to be unable to execute as promised.  It is our intent to let the public know how awful selling with ReMax/Foxfire was and we will be submitting a complaint to the ****************************** and on ********* BBB, and any other we can think of..  
    The following is the order of the last five months. Because most docs were not dated, some dates are estimates.
    November 25, 2023: Signed with ********************* and *****************
    2.  December 2023: Asked why the home was not on the market. ***** said to wait until January when the snowbirds would be present in ********  I responded that they were already in ******* and there was no need to wait.  They then promised to show and put the house on the market.
    3.  02/26/2024: Signed contract with buyers from out of state.  First    Closing was set for March 4, 2024.  In that Contract on page 2, it states; DEFAULT BY BUYER: If buyer fails to perform any of the covenants of this contract, all money paid pursuant to the contract by the buyer as aforesaid may be retained by or for the account of the Seller as consideration for the execution of the Contract and as agreed and liquidated damages and as full settlement of any claims and damages or pursue other remedies at law.
    4.  April 5, 2024: We were told that the buyers needed more time to sell their home.
    5,  April 2024:  We flew to ********** and put $2,400 on a new condo.  We also contacted movers and paid a deposit of $2,800 for the move..
    5.  April 2024 The buyers shared that they didnt have a down payment.  They were never told of the need for pre-approval before we signed a contract. Please note:  We were not told that the sale was contingent on their home sale and *****/**** said that they didnt know this either, which seems a fairly serious error for a professional real estate agent,
    6.  April 2, 2024 we received an email from ***** that the buyers needed to sell or close or lose the $1,000 deposit.  Because of this delay, there had been zero movement or effort in showing the home to potential buyers who may have been able to purchase the home.  By April 2024, all of the snowbirds had already purchased property or were leaving the state for the season-so we lost the window to sell.
    7..  April 13, 2024: **** hosted an Open House.  This is seriously late for a home that has been on the market since November 2023.
    8.  April 2024: The buyers informed ***** that they had a buyer for their home.  As a result the closing date was moved to May 21, 2024.
    9.  Late April:  We were informed that the buyer for their home could not get financing.  At that point, being thoroughly disgusted, we asked **** to release us from the contract and she agreed if her manager agreed as well.
    The long and the short of it is that because we believed in this sale, we had a garage sale and sold most of the items we were not taking with us including items that increased the curb appeal.  In addition we sold the golf cart which was a common form of transportation for us in this community.
    During all this, I urged *****/**** to list the house in the Daily Sun, while snowbirds were still in ********  ***** refused because we are not real estate.  It is absolutely clear to us now that ***** is not real estate either.
    We really trusted ****, who took our information while she worked for Sun Homes.  When she informed us that she was no longer employed at Sun, she brought ***** with her to our signing of the Contract with
    ReMax/Foxfire.  We trusted ***** to advise her because when we had questions, she had to ask *****.
    At this time, we request remuneration of $2,400 to compensate us for this fiasco.  Because we trusted ReMax for the sale to go through, we put a deposit on a new condo in ************ of $2,400.  We will lose the condo and the down payment because the sale of our home was handled poorly.  In addition, ****************** included sending the $1,000 ******* money back to the initial buyers.  Thus, $2,400 we are owed includes the $1,000 forfeited by the initial purchaser and another $1,400 to cover our down payment on the condo.  We feel ********************* was a terrible agent and should not be listing homes to unsuspecting sellers.
    We have enclosed the relevant documentation to support our claims.  We look forward to your addressing this matter quickly.

    We have spoken with *********************** and resolved the issue on our end. The listing was listed in a timely manner and ***** has also signed the agreement releasing the $1000.00 back to the buyers. We have attached our documents showing all signatures with Dates.

    We were not informed of what we were signing, therefore after seven months of waiting and not showing our house for backup buyers, the realty company should reimburse us as a goodwill offer.

    This Sale stated in the additional terms that it was contigent upon the buyers selling their home. the sellers signed this contract right underneath the terms that were expressed. when the buyers were unable to sell there home the deal fell apart and both the buyers and sellers signed a release that stated the buyers receive their ******* money deposit back. We never told the sellers to sell their goods and put a depsoit on the condo prior to the sale of their home. Our agent explained the contracts to the sellers and they signed all documents. Remax Foxfire is not liable for any losses incurred as the contract outlined the terms of the deal, including releasing the money back to buyer.
