10/10 made contact w/dealer. Tells me he has 2015 **** Edge, will be ready 10/14. 10/14, not ready, rented a car to keep working my job. 10/18/23, Edge not ready. 10/21, Edge wont be available. 10/22/23 purchased 2015 **** Escape, paid $1,300 down, signed ******************** 30k miles. 10/22/23, 30 min into hour ride home, transmission goes out. i send pic of car ************* dealer. ****** claimed he drove from ******* with no issues and mechanic cleared it. He he does not want to use warranty & wants a quote. I tow the car to mechanic, 10/24/23 get quote and tell him. he doesn't want to pay it, says he will put me in the Edge we discussed 1st. I explain the situation this has put me in, he insists the Edge will be good. 10/27, Edge not fixed, dealer says he doesn't know what to do. I say i will use warranty. Call loan company and warranty, they say its covered and will have an inspection for approval. 11/09 **************** denies claim, says they already inspected vehicle recently in ************** & diagnosed the transmission issue at a **** Dealership 10 miles before the car was purchased by me on 10/22/23. Claim was denied stating the dealer sold a faulty vehicle knowingly. I inform the dealer, he will not acknowledge what *************** said, he says just bring the car back. I tell him that wont work, its been weeks, i have no car, no warranty, out the $1000+ in rental car fees, the insurance already placed on the vehicle, my first payment is due 11/22/23. I said I need this car fixed by a licensed mechanic, what are we going to do. he has stopped answering. I filed complaint with ************ who is investigating, but I'm still left in the worst possible situation. All I ask is that the dealership pay for the transmission and honor the 30k miles warranty I signed and purchased.

    Business response

    11/29/2023

The vehicle was sold through the dealership as-is and we have offered multiple solutions. Also, the customer provided false information. The consumer purchased a warranty from a separate company. She stated the vehicle had an overdrive issue an hour after she purchased it. She reached out to the dealership and was given options including giving her money back although she declined stating she wanted to keep the vehicle. She attempted to use the warranty although they declined due to it having a pre-existing condition. The consumer owed $500 more on the down payment although fell delinquent on that payment. The customer reached out to the *************** with a complaint. The complaint was closed because the options by the dealership were given to the customer to return the vechicle or bring it back to the dealer so the transmission could be fixed. The consumer then reached back out to the dealership and requested that they purchased a transmission and she would use the $500 down payment (still past due) to have the service completed and the dealer agreed. Attached is the purchase receipt of the transmission signed by the customer when it was delivered directly to her today.
