A week before June 28th I received a phone call saying that I "won" a RainMate air purifier from a contest I entered at 'Spirit Fest'. I was asked when I would be around to receive ****** said June 28th would work for me. I thought it was odd to have them deliver it but didn't give it too much thought. Once they arrived, they brought in a giant box and it turned out to be a $3K+ vacuum cleaner! I did get the air purifier - it was wrapped in saran wrap and had no box, no warranty or a manual. It looked used or refurbished. After the 2.5 hour presentation I declined the purchase cuz I cannot afford a $3K vacuum cleaner. So the *** packed up and left. 2 days later my air purifier stopped working. When I reached out to the person who originally contacted me, she insisted it worked but I pressed on. Then I had to wait for some one who was on vacation. Then after vacation I got the whole story about their husband going through chemo for his cancer. I mean, not only was this a bait and switch tactic, but I got the runaround and then was made to feel bad about someone I don't even know. And still - no one reaches out to me. To top it off - the air purifier I received wasn't even the one they were advertising to win. The 1 advertised to win had a changing rainbow color and mine was just white. Bait and switch SCAM!!!

I'm not sure why Ms. ******** sent this complaint in on the **************.  She is dealing with the North Port office.  That owner is **** not myself.  However I spoke to **** and she did get back with ********.  She tried to ask her to spin the pump to see if I would start.  Ms. ******** said she threw the air cleaner away and doesn't want us to contact her anymore.  I have copies of the text messages if you need them.  Her main complaint was the lights in the Rainmate (air cleaner)  were difernet then what we showed at the Public exhibit.  She called it bait and switch.  First there was no bait and switch as Ms. ******** didn't pay for anything.  However we do have a big disc under the Rainmate which is flashing lights to bring people over.  If she wanted a light for it we can give her one, but as we buy them on ****** for $12.00.  IF she would like us to repair or replace the Rainmate that she says is broken she just needs to swap it out with the original one.  It would also be best to deal with her local office but ************** will be willing to assist also.  All pictures were too large to load.

I am rejecting this response because:  they were doing a contest for a new air purifier and it had changing lights.  I apologize if the color changing lights drew me in - but it did.  I entered my information and about 4 weeks later they called me and said that "I won".  When they delivered it - it had no box, no manual and no warranty AND it had no color changing lights.  Wrapped up in ***** wrap like a refurbished device.  I would soon realize that I had "won" nothing and that this was a bait and switch tactic in attempts to sell me a $3000+ vacuum cleaner.  I did not purchase the vacuum cleaner after 2 hours listening to the sales person.  A couple days later the unit broke.  I had texted many times (and I have those too!) and I was put off to wait and wait and after many attempts at trying to troubleshoot the device (and yes I did everything they mentioned) AND after waiting for someone to get back from vacation, still nothing.  I gave up and threw it away since they clearly did not want to stand by their product.  If the air purifier doesn't work, why would I buy a $3000 vacuum cleaner?  As far as Orlando vs North Port - I am not familiar with their business nor where their offices are located.  Just filled out the form and BBB contacted Orlando.  Even thought the air purifier was broken - the vacuum cleaner pitch is a joke.  They lure people in with their "free" gift and do not tell them on the phone that they will spend 2 hours listening to person talk about a vacuum cleaner and that is wrong and that is the point of this complaint.   Aside from the "free" air purifier which is junk, they con the unsuspecting person into buying a vacuum cleaner and THAT is the main complaint that these people are not understanding.

    Sincerely,

    Complaint: 22066945

I am rejecting this response because:  I have NO Idea why the other person is talking about **************** Just shows you they cannot keep anything straight.  Listen - I am complaining about a business (**********) that one minute tells you you won an air purifier and then turn around and try to sell you a $3000 vacuum cleaner unbeknownst to the prize winner.  Two hours of listening to this person trying to sell this product is CRAZY when all I wanted was the air purifier I won.  Is anybody actually reading these?!?!?!  I am talking about a bait and switch act and one person is worried about replacing the piece of c*** product while the other is worried about ****************  This is a joke just like the scam ********** is conducting by taking advantage of air purifier contest winners and pedaling an inferior product.  If the air purifier breaks and doesn't work after one week, what makes you think I would turnaround and by a $3000+ vacuum cleaner?  This bait and switch act needs to stop and ********** needs to be transparent about their attempt to sell you a very expensive vacuum cleaner before accepting your 'free air purifier'.    And to the other guy responding - try eating something first because your message made no sense.  Where the h*** did ********** come from.  Wow -  this is a colossal joke.

    Sincerely,

On December 24, 2023, I intended to make a Zelle Payment to my husband for Christmas groceries, but inadvertently sent $134 to Gegelman **** Despite my immediate attempts to cancel the payment, I was unsuccessful. Subsequently, I have reached out to Gegelman **** through various channels, including social media, phone, email, and text, seeking a refund. It's essential to note that I do not have an account with this company. My only interaction with Gegelman **** was on October 8, when I signed up to receive a demo and purchased a $20 scratch-off prize ticket. This transaction is what appears in my Zelle history.Despite my efforts, Gegelman **** has not responded to any of my attempts to communicate with them. It's important to clarify that I never intended to establish an account with this company, as I conducted thorough research before doing so. At this juncture, all I desire is a prompt refund of my money.

I bought a rainbow vacuum and the company was going to reimburse me if I completed a plan of 12 visits and 2sales. It was a scam and I fell for it. After working 8 hours plus over time, I went with them in those 12 visits, helped them sell 3 vacuum cleaners and after all for nothing.

I bought a product and wanted to return it. They will not allow me to cancel my contract because they say that I had 3 business days from the date of signature, which was Friday 9/8/23. I contacted them by email on Wednesday to cancel. They stated it was too late. I'm pretty sure a business day is defined as any day not being a Saturday, Sunday or legal holiday. They counted Saturday as a day and told me too bad, no refund.

    Business response

    10/23/2023

Here is a screen shot of her contract.  As you can see the cancellation notice is 9/12/23.  ****** states she emailed us on 9/13/23 and unfortunately, Gegelman Inc, CAP, or GI Money have any record of receiving and email from her on that day or any other day.  However on 9/14/23 she did call the finance company (GI Money) and told her she could not cancel 2 days or any day after the cancellation date.

    Business response

    10/31/2023

According to FL ST 501.021 (Home solicitation sale; definitions) gives us the answer.  Subsection (2) of this statute states “‘Business day’ means any calendar day except Sunday or a federal holiday.”

Because of this, Saturday is considered a business day. As far as an email, it states in the contract that there should be a written cancellation sent in via mail or telegram. Email was not an acceptable form of cancellation nor did Rainbow, Gegelman Inc, and GI Money Finance receive a cancellation email. The email the consumer is referring to is a third-party email from the program that is used to create electronic contracts for the consumer. When calling to inquire about a cancellation, all representatives refer the consumer to the cancellation policy located at the bottom of their contract and it is up to the consumer to read and understand the process of cancelling the contract in a legal manner to successfully void the contract by the cancellation date that is written in the cancellation portion of the contract.

    Customer response

    11/15/2023

That statute is outdated.   The newer statute, 559.3902, lists Saturday as not being a business day.  Also, I was informed by the first person I spoke to at GI Financial, Lisa, that they would accept a photo of the signed cancelation form, then was denied that opportunity.   As for Gegelman,  they promised to help me earn money to pay off this loan, by giving them names of other people to sell to.  Then when I did they didn't bother to show up.  They have also told me I would have to give them more names and more sales to qualify then I was originally told because I have a job and can not accompany the sales person to the appointments.  I  told Sislyn, the person that sold me the unit, before I ever signed anything that I would not be going on the appointments, she said that would be worked out. I did not realize she meant by adding extra sales requirements.  Other issues, I have been now told that they don't give any priority to appointments in the Jacksonville area because of distance from their home office, this was not told to me up front.  Every time I speak to someone,  they make some new requirement that makes it impossible for me to complete the program.   This is a huge pyramid scheme.

I did my neighbor a favor by giving a presentation, they gave me misleading information and never told me about the 3-day cancellation. I also signed a "contract" that I never got to read because it was on the employees phone nor did she offer to hand me the phone or explain to me what I was signing. At the end of the night they left me a packet with all the requirements which I do not qualify for so I do not know how I was able to get the vacuum. I fell for the scam and thought I received a free vacuum by just doing twelve demos. I am a teacher so I was going to ask twelve teachers. EASY? NO. I had surgery the next day and I was hospitalized until March 17. Which is when I read all the misleading information. It states that to give a presentation your significant other must be in attendance or you must be married and/or living with someone. So right there I do not qualify. Then I realized the date was wrong and saw 5,000 for a vacuum? When she clearly stated 3,400 if I did not get the 12 presentations. I quickly messaged her one day after cancellation apparently, and she was nasty and stated she can change the date without my approval in the office and it was too late to cancel the contract. She then went ahead and changed the payments without my consent. I told her she could not without my signature or approval and that was illegal. Also the contract says Aileen & meaning I should have a significant other? I contacted finance to no avail, sent all my proof. I contacted Todd G*******, and he claimed it was signed from the same IP address when in fact I sent him the only contract I had with proof of his employee stating she would change the contract in the office without my approval. I just want them to come pick up their vacuum and cancel their illegal and invalid contract.

We are sorry that you believe you were misled during the in-home sales process. As FL law, there is a 3-day business cancellation period for in-home sales which is stated on the contract. The finance company provided us with the verification call that was made in your home on the date of the sale. After reviewing, there was no indication that you were at the time upset about the payments being made, along with no questions about the contract you received via email. The sales person let you know during the time of the verification that she would be redoing the contract to state you had a deferral in your first payment due date which you agreed to on record and was aware of. It was also done in your home before the sales person left, as all contracts that are redone need a new signature. By law, when you are signing, you are stating that you have read and understood the agreement and have consented to making financial payments towards the product. The program that was explained to you, also states all the rules and conditions which you were aware of and signed for at the time of the sale. That was also provided to you via email. Stating that we have misled you in anyway seems far fetched as you went over all if this information in your home at the night of the sale and agreed to the terms.

The sales person doesn't say the contract will be changed.  She says they will change the date the money is taken out of her account from 4/25.  She never said the contract will be changed.  What the  sales person meant to say, " Because of the (3 month deferred) option that is on the contract she actually has until 7/25 to have the money taken out of her account.  Either way NOTHING was changed on the contract as it's IMPOSSIBLE to change a contract after it's been signed.  I have explained this to Ms* ****** numerous times.
