Scott A. Rivkees, M.D., State Surgeon General, orders the emergency suspension of the license of Andrew William Assad, R.PH (Mr. Assad), to practice as a pharmacist and consultant pharmacist in the State of Florida. Mr. Assad holds license numbers PS48738 and PU7109.
On March 22, 2021 in United States District Court, Eastern District of Tennessee at Greenville, in case number 2:18-CR-140-001, Mr. Assad entered a plea of guilty to one count of Conspiracy to Commit Healthcare Fraud, a felony violation of 18 U.S.C. 1349. Healthcare Fraud and/or Conspiracy to Commit Healthcare Fraud are crimes which relate to the practice of, or the ability to practice, as a pharmacist.
Section 456.072(1)(c), Florida Statutes (2020), provides that being convicted or found guilty of, or entering a plea of guilty or nolo contendere to, regardless of adjudication a crime in any jurisdiction which relates to the practice of, or the ability to practice, a licensee's profession constitutes grounds for disciplinary actions.
Section 456.072(1)(b) provides that the Department shall issue an emergency order suspending the license of any person licensed under chapter 465 who pleads guilty to, is convicted or found guilty of, or who enters a plea of nolo contendere, regardless of adjudication, to a misdemeanor felony violation of 18 U.S.C. 1349.
The Department is mandated to summarily suspend Mr. Assad's license to practice as a pharmacist and consultant pharmacist in accordance with section 456.072(1)(b).
In accordance with section 456.072(1)(b), it is ordered that:
- The license of Andrew William Assad, R.Ph., license number PS48738, is immediately suspended.
- The license of Andrew William Assad, R.Ph., license number PU7109, is immediately suspended.
- A proceeding seeking formal discipline of the license of Andrew William Assad, R.Ph. to practice as a pharmacist will be promptly sistituted and acted upon with section 120.569, Florida Statutes (2020).
