    Greetings, I own a condo at *** ******* ******* ****, Golf Villas 5A 1714. Maxet took over the other company in 2023. I was paying my HOA for my condo at that time either monthly or quarterly depending on my financial situation. When Maxet I was paying quarterly. My financial situations now changed and I was unable to pay the HOA quarterly, for this I changed to monthly payments. I paid the full 1st quarter and the 2nd quarter, but in the 3rd quarter due to financial situations I changed the method of payments to monthly payments to accommodate my finances. For this, I edited my profile Maxet and I changed the payments to monthly. Then, I paid the 3rd quarter as monthly payments for this. But unfortunately, I received a statement on 8/20/2024 indicated that I have to pay the month of September now with additional $15.00 for 30 days late interest and $ 25.00 late fee as I'm still paying my HOA quarterly and they never changed the method of payments for me even though I'm the owner of the condo and I changed the method. They did not respect me and they did honor what is right. I think the statement I received is inappropriate and does not reflect the monthly method I choose and the people who work there do not know how to manage their system. As an owner of the condo I have the right to choose the methods of payments as monthly, quarterly, every 6 months, or yearly. They have no rights to dictate and to force the kind of payments on me. I contacted the office of 2 times yesterday and today and they ignore me and they ignore my request. I'm asking Maxet to rectify the premature September statement I received as the (previous quarterly they assume) for my HOA, and to take away the $15.00 interest and the $ 25.00 late fee from the statement, and to continue the monthly payments for me as of September 1, 2024 and so forth.     Firstly, I want to emphasize that the Edgewater Beach Resort Community Association operates in accordance with Florida Statutes, particularly Chapter 718, which governs condominium associations. Under Section 718.116 of the Florida Statutes, each unit owner is responsible for paying their share of common expenses, as assessed by the association, in a timely manner. This responsibility includes adhering to the payment schedule set forth by the association unless an alternative arrangement is formally approved.


    Regarding your decision to change your payment frequency from quarterly to monthly, it is important to note that such changes must be coordinated and approved by the association or its managing agent, Maxet, to ensure accurate billing and compliance with the condominium's governing documents. The association's policy, as outlined in the Edgewater Golf Villas 5A Declaration of Condominium, stipulates that assessments are due as determined by the Board of Directors. Any changes to the payment schedule must be formally requested and confirmed by the association.


    Your statement indicates that while you made adjustments to your payment preferences via the online system, these changes were not reflected in our records. As a result, the system continued to treat your payments as quarterly, leading to the late fees and interest charges you have contested. We regret any confusion this may have caused. However, the $15.00 interest charge and $25.00 late fee were applied in accordance with the Board’s approved Assessment Collection Policy. This policy clearly states that any payments not received by the due date are subject to late fees and interest, regardless of the payment frequency.
    While we empathize with your situation, the association must enforce these policies uniformly to ensure fairness and consistency for all unit owners. The timely collection of assessments is crucial for maintaining the community's financial health and covering necessary expenses such as maintenance, security, and utilities.


    We understand the frustration that administrative errors can cause, and we will investigate your account to ensure that all payments have been correctly applied. However, the current charges must remain as they are due in accordance with the established policies and Florida law.

    I am rejecting this response because:

    I never been informed by Maxet management company that the quarterly payment is the only payments for the associations, also about the interest and the late fee if I changed the payment methods even if I'm not knowledgeable about these circumstances.

    They send me sweet paragraphs about the situation,but the reality and the practices with them are different. They stated that if I would like to discuss a formalized payments plan, they want me to contact the office directly. I contacted them twice before and they weren't helpful and they did not solve this issue. For this I'm requesting that a monthly payment be applied to my account starting with the following quarter, and this to be done now while the BBB is involved in this case.

    Please understand that the collection and structure of assessments are not at the discretion of Maxet Management Group. These policies are defined by Florida statute and established as covenants in the Declaration of Condominium. As an owner, you have agreed to abide by these covenants upon acceptance of your deed. Our role is to ensure that these established guidelines are followed to maintain consistency and fairness for all members of the community, in accordance with the law and the governing documents of the association.


    Regarding your request to pay assessments monthly rather than quarterly, we can certainly accommodate this preference within the existing policy framework. To do so, you would need to ensure that your account reflects the full quarterly assessment amount by the due date of each quarter (1/1, 4/1, 7/1, and 10/1). This can be achieved by making two payments in advance, creating a prepaid credit for the upcoming months. Your subsequent monthly payment would then bring your account to the required amount, aligning with the quarterly payment schedule.


    For example, to meet the 1/1 due date, you would make two payments in November and December, ensuring your account has the required balance by January 1st. Your January payment would then bring you current for the quarter.

    Celadon Panama City Beach ***** ***** ***** ** #2205 . I paying quarterly 2.200 for last 3 years. It is 1.600 for assessment fee and charge extra for 650 dollars . I spoke with President of the Company Thomas ******* ************ and I asked for explanation of this extra charge 650 dollars. He says this charge will be applied forever and He was very ruth and refuse to answer my questions .He did not provide any explanation to what reason this extra money are collected from owners for last 3 years. His Secretary Mary ***** refuse to speak and give any information .

    The complaint should be made against Celadon Beach Owners Association Inc.  and not Maxet Management.  Maxet is charged with the duty to execute the decisions of the board of directors for Celadon.  An explanation of the owners assessment and how the funds are appropriated is found by reviewing the annual budget which was mailed to each owner and also made available to each owner online via their secure owners portal and document library.
