We have a signed contract for the scope of work at my property at *** ********** Cir. It included paint, labor and materials. I signed that quote and paid the deposit and gave Mr. Morningstar a key to my house. Our agreement was to be completed 9/4/2024. Our initial deposit was paid 8/5/2024 and final payment for completion after several delays was paid on 10/3/2024. I have copies of checks that were deposited for initial and final payments. As of 10/3/2024 Mr. Morningstar has sent multiple texts and links to invoices not included in our signed agreement and threatened liens on my home if I do not pay the difference. I obtained several quotes and before going with Morningstar Renovations. At no point did he send over a revised agreement or change order for approval. He asked for more money after I gave him final payment.

    Business response

    10/07/2024

Customer refused to pay for the extra material cost that were needed to pay for the successful completion of the project. I sent over a final invoice prior to completion. She also blew that off . She looked me in the face and said I’m not paying you a dollar more.

I responded by telling here I do not want any extra money for the labor and only the money for the additional add on of the backsplash removal she’s asked for and the extra materials that where unforeseen due to how much  labor it tooks properly finish the project.

none of the other extra items she added such as outlet deletes and extra cabinet in bathroom painting where charged to her

    Complaint: 22389555

I am rejecting this response because:

We had a signed contract for scope of work to be completed in our home. 1)The work was not completed in the agreed upon timeframe. Beginning on 8/5/2024. Promised to be completed 9/4/2024.  We paid him to be completed so we could move forward on 10/3/2024.

Mr. Morningstar referenced his quote to me was only good for 30 days.

He delayed the start of our job, referencing another job that he needed to address.  Materials didn’t show up at our house until 8/21/2024.  Mr. Morningstar then proceeded to go out of town to Jacksonville from 9/9/2024-9/16/2024.  After already being a week past his quoted completion date.  My husband had to reschedule business trips out of ECP because our house was not ready, costing change fees from ***** Airlines.

2)The work is not satisfactory, paint thin and does not cover cabinets as quoted. The cabinets and drawers were not re installed correctly, you can not open 2 at the same time, drawers rub against drawers causing damage to them. Drips and runs, some broken cabinets, missing hardware, missing bathroom towel holder, missing shelf pegs to hold shelving “Mr Morningstar said he left shelves out so we could put them in how we wanted.” Can’t put them back because the pegs are gone.

Broken bathroom light fixture, bathroom drawers installed upside down, door knobs put on backwards, not functional, toilet not put back together properly, leaked all over the floor, washer & dryer not hooked back up properly, water sprayed every where, refrigerator water line broken in half, again water spraying everywhere, and had to be replaced. Guest room closet doors do not close, 2nd guest room main door doesn’t close. Master bathroom door not painted.

3)We will be paying out of pocket to have our AC coil cleaned because Mr. Morningstar removed the air filter and  left the door off the furnace and left it running at 70 degrees, filling the coil with dust and debris.

Lastly Mr. Morningstar did not take normal precautions to ensure the integrity of our home.  He quoted the job, we accepted that he was a professional contractor and could complete the work as per our agreement. We paid his quote in full, even though we are still not satisfied with his work.  Just ready to move forward. I couldn't upload all the photos in this application, I will email them separately along with this response to the email provided.

    Sincerely,

    Crystal ***
