    purchased two palm trees for $2107 on november 12 2022.told owner we had construction starting at our home and area where palm trees would go would be torn up. may take month,but i would call when we are ready to install. as delays occurred i stayed in contact with palm source and there seemed to be no issues just call us when ready to install. we set up install may 2 2023 and even at that time there was no issues. several days later owner sent me copy of my contract and said you owe him 10% charge of total purchase each month you delayed install. bottom line he sent us a bill for $983.97 that he said had to be paid before he installed due to my delay the charged for for 4.67 months of delay. we repeatedly stayed in contact with alex his store manager and at no time was we ever verbally told of the additional charge. it was always no problem. while its in the contract there was never any mention that there was any issues with the delay the entire time. it was always i’m good,just call when ready. i have text messages i can provide proving all the conversations.

    We reached an agreement with Mr. ****** to have his own contractor pick up and install the two palms he purchased from us on 11.12.22, and the contractor is picking the palms up on 5.14.23.  In over twenty years of doing business, we have NEVER had a customer not schedule the installation of the plant material within the 30 day time period specified on the Purchase Agreement that Mr. ****** acknowledged and signed, and in this case, his trees have been under our care now for over half of a year (which is why he was assessed the surcharge in the first place and is also specified in our Purchase Agreement).

    In any event and in the interest of moving on, we waived the surcharge in the amount of $983.97, in return for not having to deliver and install the trees and he accepted this arrangement.  Please understand that half a year is excessive to hold someone's property in any business and we were well within our rights to surcharge him.
